PART I - THE SCHEDULE
SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS
1. B1.08-2(b), Utility Service Region is hereby amended to reflect the addition of "PE Potomac Edison".
2. B19.46 (a) Electricity is hereby amended to reflect the addition of "for schedule on the Day Ahead market".
3. B19.46 (b) TRANSACTION FEE, Note 3 is here by added to reflect "Any credit premiums associated with the purchase of the blocks shall be included in the Transaction Fee."
4. B19.46 (c) OTHER MARKET CHARGES, NOTE 3 is hereby amended to read NOTE 4.
5. B19.46 (c) OTHER MARKET CHARGES, NOTE 4 is hereby amended to read NOTE 5.
6. B19.46 (c) OTHER MARKET CHARGES is amended to include the following:
(1) Renewable Energy Credits – Contractor costs to comply with the state renewable portfolio standards (RPSs) associated with each of the accounts shall be passed through to the Government. The Government reserves the right to direct the Contractor to purchase Renewable Energy Certificates (RECs) with those costs to be assigned to the applicable accounts and the RECs purchased by the Contractor to be used to satisfy the state RPS requirements associated with the applicable accounts. The costs associated with state RPS compliance are to be expressed as a per-kWh charge, applicable to the account and distributed over the calendar year, or the PJM planning year (June through May), as applicable based on state RPS regulations, in proportion to energy usage by the account. Pursuant to FAR 52.212-5(d), the Government has the right to audit the price quotes or other information submitted by the Contractor’s REC suppliers in order to verify price reasonableness and best value.
(2)Capacity Costs – The cost to secure capacity to comply with PJM capacity requirements shall be passed through to the Government. The price of capacity charged to the Government shall not exceed the product of the Contractor’s Daily Unforced Capacity Obligation and the PJM Zonal Capacity Price net of the Capacity Transfer Rights Credit. The Daily Unforced Capacity Obligation is equal to the Obligation Peak load multiplied by the Final Zonal Reliability Pricing Model (RPM) Scaling Factor times the Forecast Pool Requirement, as those terms are defined by PJM, for the relevant time period and zone in which the account is located. The Government reserves the right to direct the Contractor to purchase capacity with those costs to be assigned to the applicable accounts on the basis of their respective PLCs.
(3)Transmission Costs – Non-UDC transmission costs associated with each account shall be passed through to the Government at the applicable PJM tariff rate as prescribed in the OATT. Any Auction Revenue Rights (ARRs) revenues associated with the account loads shall be credited back to the Government, based on the Government’s share of the Contractor’s overall load. Both the transmission charge and any credits to the Government shall be shown as separate line items on the monthly invoices. Transmission charges shall be billed according to the following formula:
Transmission Charge = Applicable Transmission Peak Load Contribution (kW) x Network Integration Transmission Service Rate (relevant PJM UDC zone) / 365 / 1000
(4)Transmission Congestion & PJM Losses – Transmission congestion and PJM losses, herein referred to as “Congestion Charges,” associated with each account shall be passed through to the Government. The congestion charges for energy and load scheduled Day- ahead, i.e., the block power purchases and equivalent load, shall be computed as the difference between Day-ahead LMPs at the PJM West Hub and the Day-ahead LMPs at the relevant delivery zone.
The congestion charges for energy and load scheduled Real-time, i.e., the energy requirements and load outside the block purchases, shall be computed as the difference between the Real-time LMPs at the PJM West hub and the Real-time LMPs at the relevant delivery zone. The Government reserves the right to direct the Contractor to fix congestion costs over a specified time period for a specified level of load, with those costs to be assigned to the applicable accounts on a per-kWh basis.
NOTE 6: The following table is a basic example showing how the energy should be scheduled/ settled (real time vs day ahead), including the block purchases:

7. B19.46 (c) OTHER MARKET CHARGES is amended to remove the following:
(1) CAPACITY – The capacity price shall be the established PJM Auction price as defined on the PJM website, for the applicable Zone. Contractors will be required to provide documentation for the capacity charge calculation.

(2) TRANSMISSION COSTS – Transmission costs associated with each account shall be passed through to the Government at the applicable PJM tariff rate as prescribed in the OATT. Transmission charges shall be billed according to the following formula:
Transmission Charge = Applicable Transmission Peak Load Contribution (kW) x Network Integration Transmission Service Rate (relevant PJM UDC zone) / 365 / 1000
(6) TRANSMISSION AND DISTRIBUTION LOSSES – Transmission losses (charges and credits) and Distribution loss charges shall be treated as a direct pass-through to the Government and shall be the sum of the transmission and distribution losses charges/credits applicable to the account load for the month. Credits to the Government shall include PJM Marginal Loss Over-Collection Credits associated with the account loads. The Contractor shall provide the methodology and documentation of how these credits are calculated. Losses shall not be calculated by grossing up metered consumption and shall be calculated as follows:
For each billing period, Step 1: Calculate Average Load weighted LMPs (using Day Ahead LMPs for relevant PJM UDC zone Zone) in $/MWH = ?(hourly loads X hourly LMP) / ?(hourly loads)
Step 2: Calculate Unit Loss Charge = Loss Factor X Average Load Weighted LMPs
Step 3: Loss charges = Unit Loss Charge X Total Actual (i.e., metered) Consumption
(8) UNACCOUNTED FOR ENERGY (UFE) - UFE is to be passed through with a 60 day true-up.
(9) EDC LOSS DE-RATION - The EDC Loss De-Ration Factor shall be a direct pass-through with no mark-up and applied in relation to Hourly Consumption and the Transmission and Distribution Loss Factors as follows:
Hourly Consumption x (1 + Distribution Loss Factor) x (1 + Transmission Loss Factor) x (1 – EDC Loss De-ration Factor)
8. B19.46 (c) OTHER MARKET CHARGES is amended to add the following:
(11) Ancillary Services Costs – The cost to secure ancillary services to comply with PJM requirements shall be passed through to the Government. The price of ancillary service charges to the Government shall not exceed PJM’s charges or the market clearing price from the relevant PJM-administered market for the relevant time period and zone in which the account is located. Ancillary service charges passed through to the Government are those charges for: (a) scheduling, system control and dispatch (PJM OATT); (b) reactive supply and voltage control from generation services (PJM OATT);
(c) regulation and frequency response service (PJM Operating Agreement); (d) balancing charges in operating reserves (PJM Operating Agreement); (e) operating reserve, supplemental reserve (PJM Operating Agreement); (f) operating reserve, synchronized reserve service (PJM Operating Agreement); and (g) all other Ancillary Service Charges incurred to supply the Government account.
9. B19.46 (c) OTHER MARKET CHARGES NOTE 7 is hereby amended to relfect the addition of "An amount of load equal to the block purchase shall be scheduled into the day ahead market."
10. B19.48 SUB-ACCOUNT/SUB-QUALIFIED SCHEDULIGN ENTITIES is hereby amended to reflect the removal of:
(a) ENERGY. For each hour of the month, the Government shall pay the Contractor the product of the Day Ahead Locational Marginal Price (LMP), for the Contract’s UDC zones and the account’s loss-adjusted metered load to the same ISO Load Zone.
(b) TRANSACTION FEE. The Transaction Fee is the product of a fixed fee multiplied by the account’s total metered energy consumption in that month, as measured by the UDC’s end use retail meter. The fixed fee shall compensate the Contractor for all services performed, and costs incurred, whose recovery is not specifically provided for by the Energy and Other Market Charges components described in this section. The fixed fee shall remain constant throughout the Contract. The Government will not pay a transaction fee on transmission & distribution system losses and Unaccounted for Energy (UFE). The Contractor shall not include any charges identified in Paragraphs (a) Energy, or (c) Other Market Charges, of this clause. The transaction fee shall be fixed and identical for each kWh supplied under this Contract.
SECTION C – STATEMENT OF WORK/SPECIFICATIONS
11. C804 STATEMENT OF WORK/SPECIFICATIONS NOTE 1 is hereby amended to as "or ISO" to the language.
12. C804 STATEMENT OF WORK/SPECIFICATIONS NOTE 4 is hereby removed from the solicitation.
13. C804 STATEMENT OF WORK/SPECIFICATIONS NOTE 5 is hereby added to read "ADDING FUTURE ACCOUNTS. It is possible that additional accounts not included may be added to this resultant contract(s). In that event, the Government will provide the Contractor with the facility’s electric requirement (if available) and the two parties shall enter into good faith negotiations to determine a price. A bilateral modification will be executed adding the line item on the Standard Form 30, Modification of Award.
