Questions and Answers for Solicitation SPE60422R0408

22 NOV 22

1. Question: Will DLA consider changing from Delivery Option 2 to

Delivery Option 3 for North Carolina and South Carolina locations?

Answer: The delivery options are determined by the customers analysis with the assistance of DLA. Currently, DLA does not intend to change the delivery options. This issue may be addressed during discussions if opened. Any change to the delivery options will be issued via an amendment to the solicitation.

2. Question: Will DLA use reverse auction for final price revisions, and must the supplier submit final offers with their packets?

Answer: In accordance with provision L705 paragraph (7), offerors must offer both a winter and summer adjustment factor for each line item offered upon. The Government reserves the right to award without final price revisions. Offers that do not include a proposed price may not be considered for award. Suppliers are advised to offer accordingly. The usage of reverse auction is addressed in DLAD L09 Reverse Auction (OCT 2016). If discussions are opened, offerors will be given an opportunity to revise their initially offered prices. An online reverse auction platform may be used for this.

3. Question: Will DLA consider changing the SIP for Line Items 0010 (Federal Bureau of Prisons, Miami), 0035 (Patrick AFB, Kennedy Space Center, and Cape Canaveral Air Station), and 0036 (NAS Jackson Jacksonville and Naval Station Mayport) from FL Gas Zn2 to FL Gas Zn3?

4. Question: Will DLA allow a supplier to adjust its AF after the award of the contract if there are changes in tariff and/or the transportation program during the period of performance?

Answer: See clause C700(f) concerning material changes. If a material change occurs as defined in the clause, the Contractor and Government shall agree on an equitable adjustment in accordance with DFARS 252.243-7002. Changes in volumes not identified as a material change would be supplied by the Contractor at the contract price.

Also see clause 52.212-4(k) which states that the contract price includes all applicable Federal, State, or local tax and duties in effect at contract signing. This clause addresses after imposed or relieved taxes.

Changes to the adjustment factor based on changes to tariff terms or other terms of the contract will be considered on a case by case basis. Any change to the adjustment factor for these reasons must be made via bilateral agreement documented by a contract modification.

5. Question: Are the suppliers able to contract using the North American Energy Standards Board (NAESB) contract?

Answer: Terms and conditions in DLA solicitations and subsequent contract awards must be in accordance with Federal Acquisition Regulations, the Defense Federal Acquisition Regulations Supplement, and agency regulations and guidance. This solicitation contains clauses and provisions mandated by those regulations.

While this precludes use of the standard NAESB contract, DLA seeks to utilize language reflecting commercial practice where possible.

DLA intends to award the contracts utilizing the terms and conditions as set forth by the solicitation as published.

6. Question: Line Item 0003 (Little Rock AFB): Are suppliers supposed to incorporate the transport costs into the adjustment factors if the supplier does not know the price of gas being transported?

See provision M2.16 on page 67 of the solicitation for factors considered in evaluation of offers for award.

30. Question: Would DLA consider excess capacity value as defined in Section 3(I) to be included in the adjustment factor rates rather than a separate credit line item?
