Attachment A Amendment 0002

SPE603-22-R-0500 / Persian Gulf Area This amendment is hereby issued to:

A. Revise the RFP under solicitation SPE603-22-R-0500. The text highlighted within Attachment B of this amendment identifies the changes. Please see Attachment B to SPE603-22-R-0500 Amendment 0002.

B. Answer the following questions received in response to the solicitation as follows:

1. Reference PWS 2.4.1 Tanks, “Each storage tank will be equipped with a fuel/water separation system for collection of all product or water dispensed from its bottom water drain(s).” Because the required storage is being considered as intermediate storage, fast flush systems are not applicable as they are typically only in use at terminals that are an upstream facility with capabilities of loading pipeline or truck, which isn’t required in this solicitation. Would tanks equipped with a water drain facility that accommodates the same requirement be acceptable?

DLA Energy Response: In accordance with (IAW) Performance Work Statement (PWS) paragraph 2.4.1 and DLA Energy Contract Text C19.04 REMOVAL OF WATER BOTTOMS (DLA ENERGY FEB 1998) each storage tank will be equipped with a fuel/water separation system for collection of all product or water dispensed from its bottom water drain(s). Exceptions, if requested must be submitted in accordance with solicitation instructions in the addendum to

FAR 52.212-1.

2. Reference Solicitation F-0005-F45.01 and PWS 1.10, 1.10.1, 1.10.1.1, 1.10.1.2, and 1.10.1.3: Could DLA please clarify the requirements for additive storage and purchasing?

Section 1.10.1 states that additives for injection will be Government-provided, but in the Solicitation document, it states that the Government may require the Contractor to purchase additives. Could DLA please clarify?

DLA Energy Response: IAW PWS paragraph 1.10.1, normally additives will be provided by DLA Energy ME region. The contractor shall coordinate with DLA Energy ME to order required additives. The contractor will be required to store additives in accordance with PWS requirements identified in PWS section 1.10. DLA Energy may require the contractor to purchase additives IAW DLA Energy Contract texts F-0005-F45.01, F-0006-F45.03, and F-0007-F45.04. If notified and requested to purchase, the contractor shall be reimbursed when requirements of F-0005-F45.01, F-0006-F45.03, and F-0007-F45.04 are executed.

3. How much storage of each additive will be required?

DLA Energy Response: IAW PWS section 1.10 additive storage amount is based on the allowed throughput requirement, and contractor shall store and maintain enough additives inventory to meet additive injection requirements for the allowed throughput. Contractor shall review the most current version of MIL-STD-3004-1, DEPARTMENT OF DEFENSE STANDARD PRACTICE:

QUALITY ASSURANCE FOR BULK FUELS, LUBRICANTS AND RELATED PRODUCTS,

and the appropriate additive injection DLA Energy contract texts to determine injection blend ratios to determine storage amounts.

SPE603-22-R-0500 / Persian Gulf Area

4. In Section 1.10.1.1, it states that Contractor shall provide all necessary labor, equipment, and facilities to fill Government-furnished drums, ISO intermodal tank containers, and tank trucks with FSII from the additive storage facility.

Will Contractor be responsible for filling drums and containers at the Additive Storage Facility? Or is the Contractor responsible for providing labor and coordinating transport from an additive storage facility off premises?

DLA Energy Response: Yes, IAW PWS section 1.10 the Contractor shall provide all necessary labor, equipment, and facilities to fill Government-furnished drums, ISO intermodal tank containers, and tank trucks with FSII from the Contractor’s additive storage facility. The contractor is not responsible for providing labor and coordinating transport from an additive storage facility off premises is not a requirement of the solicitation.

5 If the additive storage facility is off premises, contractor would need to know where the location is to project effort and cost.

DLA Energy Response: Labor and coordinating transport from an additive storage facility off premises is not a requirement of the solicitation.

6. Reference PWS 2.4.2 Filtration. Because the required storage falls into the category of intermediate storage and pipeline and/or truck loading is not required as part of the scope, can DLA please verify if filtration can be waived for this requirement? API intermediate or off-airport locations are typically not required to have filtration systems in place.

Intermediate storage locations that meet the full requirements of the PWS may unnecessarily incur large costs on long-lead time filtration items if filtration is required per the PWS.

DLA Energy Response: Please reference PWS paragraph 2.4.2 which provides filtration requirements. Exceptions, if requested must be submitted in accordance with solicitation instructions in the addendum to FAR 52.212-1.

7. Reference PWS 1.8.1 Tanker/Barge. The pumping rates required in the PWS are quite low compared to the commercial capability in the region and may result in additional fees from local Port Authorities. Should Contractor price in these fees based on the current PWS, or can a higher minimum pumping rate be negotiated?

DLA Energy Response: No, PWS paragraph 1.8.1 provides minimum pumping rates required for the mode of transportation for this requirement (minimum 8,000 BPH for tanker and 2,000 BPH for barge). It is left to the offeror’s discretion and business judgement to best decide how to structure its offer to meet the requirements of the solicitation. Additionally, see FAR 52.212-2(b).

8. Reference PWS 1.8 Product Receiving Requirements. Is there an estimate of how many vessel transfers will occur to meet the throughput identified per year? This will help Contractor determine the estimated port fee charges associated with the vessel calls.

SPE603-22-R-0500 / Persian Gulf Area DLA Energy Response: No, the planning factors for shipping requirements are included in PWS paragraph 1.9 and planning factors for receiving requirements are included in PWS paragraph 1.8.

9. Reference PWS 2.6 that require contractors and subcontractors to be “registered in the

Joint Contingency Contracting System (JCCS) to be considered for contract awards in the U.S. Central Command (CENTCOM) Area of Operation (AOR). Instructions for account registration and training can be found at www.jccs.gov.” Please advise if this is the correct link, as the website appears to be down.

DLA Energy Response: The JCCS link (http://www.jccs.gov/) from PWS section 2.6 is active.

Contractors may also try the following: https://www.jccs.gov/jccscoe/. Offerors are encouraged to copy the link location and paste into their browser.

10. In PWS, Section 1, subsection 1.1, page 3, the RFP states "the requirement for contract services and ancillary facilities for receiving, storing, protecting, and shipping U.S.

Government-owned aviation turbine fuel". However, will the Government at anytime require the contractor to provide procurement of fuel or fuel transport?

DLA Energy Response: No.

11. In PWS, Section 1, subsection 1.2, page 3, The area of consideration is defined as the

Persian Gulf area. Should contractors be asked to provide transport, what locations would be serviced from the facility in the AOC?

DLA Energy Response: Not applicable as transport of fuel is not a requirement of the solicitation.

12. In PWS Section 2.3, page 6, the PWS states "No petroleum products will be received or shipped without first determining and confirming conformance with product quality requirements" How often will the contractor be required to perform a fuel standard tests while product is within storage tanks after receiving or before shipment?

DLA Energy Response: IAW PWS 2.3, Contractor shall review the most current version of MIL-

STD-3004-1, DEPARTMENT OF DEFENSE STANDARD PRACTICE: QUALITY

ASSURANCE FOR BULK FUELS, LUBRICANTS AND RELATED PRODUCTS, Table IX Minimum Sampling and Testing Requirements for Petroleum Products for testing frequencies.

13. In PWS, Section 3, 'Training Requirements', the government does not list any fuel personnel minimum requirements, Does the Government have any minimum fuel personnel requirements to run the site 24/7?

DLA Energy Response: No, it is a contractor’s responsibility to make sure fuel operations personnel are properly trained to operate the contractor-owned, contractor-operated facility.

14. In PWS, Section 1, subsection 1.2, page 3, The area of consideration is defined as the

Persian Gulf area. To provide the most centrally located storage area, specifically what

SPE603-22-R-0500 / Persian Gulf Area sites/locations within the Persian Gulf are expected to be serviced from this storage site?

DLA Energy Response: Please reference PWS paragraph 1.2 and FAR 52.212-2 Technical/Management subfactor 1, Area of Consideration. The offered facility must be within the area of consideration. The serviced locations are not applicable to this location.

15. In RFP Section F, "F-0001-F1.04 General Receiving and Storing Conditions (DLA

Energy Dec 2017)", subsection K.1.i, pg 23, Will the government provide additional lay time for tanks/barges with notice less than '48 hours in advance of the scheduled arrival date'?

DLA Energy Response: Please reference the RFP, FAR F1.04(k)(1)(v)(B) the vendor/supplier has 36 hours to load the vessel from the schedule delivery date. If weather permits or delay arrival time, they will be notified and get more time load. No additional time is awarded to load if port is congested or crowded. The vendor is aware on when vessel will be loading. The vendor can request to receive vessel position updates and notification of when vessel will arrive at location to load.

16. In RFP Section F, "F-0001-F1.04 General Receiving and Storing Conditions (DLA Energy Dec 2017)", subsection K.1.ii, pg 23, If facility is unable to provide berth and mooring for 'barges, within 3 hours after issue of notice of readiness to unload, and, for tankers, within 6 hours' due to forces out of contractor control or crowding of the facilities. Will the contractor be awarded additional lay time?

DLA Energy Response: No, once the load date is agreed upon and confirmed, the contractor has 36 hours to load the vessel after it berths. If for whatever reason it take longer to load the vessel, demurrage charges will be applied. Unless there is a weather related delay, more time will not be awarded.

17. In RFP Section F, "F-0002-F1.05 GENERAL SHIPPING CONDITIONS (DLA ENERGY OCT 1997)", subsection (a), page 24, the RFP alludes to the possibility of receiving fuel via pipeline or truck'. Will the contractor need to provide the ability to receive fuel from trucks or a pipeline in addition to the tankers/barges?

DLA Energy Response: No, please review PWS section 1.8 for all receiving requirements.

18. What is the expected number of vessels visiting the storage terminal on a monthly basis?

DLA Energy Response: Please review PWS section 1.6 for allowed throughput Planning factors for shipping requirements are included in PWS paragraph 1.9 and planning factors for receiving requirements are included in PWS paragraph 1.8

19. What type of vessel sizes do you expect to bring in?

SPE603-22-R-0500 / Persian Gulf Area DLA Energy Response: DLA Energy charters commercial oil products tankers in the Middle East up to approximately 300,000 BBLS capacity. DLA Energy may also charter smaller vessels with smaller BBLS capacity and parcels. Refer to PWS section 1.9.2 for the vessel not to exceed size specifications.

20. Would the storage capacity be used for active operations or for strategic storage purposes?

DLA Energy Response: The Contractor shall provide storage services in accordance with the PWS meeting the requirements under FAR 52.212-2, Factor 1 Technical/Management.

21. What is the expected volume that you will be moving In and Out of the terminal on a monthly basis?

DLA Energy Response: The volume will vary. Please review PWS section 1.6 for allowed throughput. Planning factors for shipping requirements are included in PWS paragraph 1.9 and planning factors for receiving requirements are included in PWS paragraph 1.8.

22. Under Clause 2.4.2 : Attachment PWS: Filtration: Is Filtration required for every movement/ operation or it will be advised case to case basis.

DLA Energy Response: Please reference PWS paragraph 2.4.2 which provides filtration requirements. Exceptions, if requested must be submitted in accordance with solicitation instructions in the addendum to FAR 52.212-1.

23. We note Section 843(d) of the National Defense Authorization Act for Fiscal Year

2022 (Public Law 117-81) which requires that “if the Secretary of Defense awards a contract for fuel procurement for an overseas contingency operation, the contracting officer for such contract shall consider tradeoff processes (as described in subpart 15 of the Federal Acquisition Regulation, or any successor regulation), including consideration of past performance evaluation, cost, anticorruption training, and compliance.” Does this law apply to this solicitation?

DLA Energy Response: No, this solicitation is for fuel storage services and not a fuel procurement. As stated in B0001-B34.01, FAR 52.212-2 and FAR 52.216-1 the solicitation will be awarded as a Firm-fixed Price contract utilizing Lowest Price Technically Acceptable source selection process IAW FAR 15.101-2.

24. In RFP Section B, page 15, 'Local Clearances/National Notification Requirements' the RFP states 'the contractor shall provide a detailed chart of all notifications, clearances, fees, and filings'. Will the contractor be responsible for licensing, customs, and port approvals?

DLA Energy Response: Yes, this is the responsibility of the contractor.

25. In RFP Section B, page 15, 'Local Clearances/National Notification Requirements' the

RFP states 'the contractor shall provide a detailed chart of all notifications, clearances, SPE603-22-R-0500 / Persian Gulf Area fees, and filings'. Will the contractor or the government be responsible for any import/export taxes or fees related to the fuel within country, if applicable?

DLA Energy Response: In accordance with the instructions in B34.01. Prices under CLIN 0001 shall include pricing for all services and requirements included in the PWS, Attachment I of the solicitation. This solicitation is for fuel storage services and not a fuel procurement.

26. In RFP Section B, page 15, 'Local Clearances/National Notification Requirements' the

RFP states 'the contractor shall provide a detailed chart of all notifications, clearances, fees, and filings'. Will the contractor or the government be responsible for any harbor or docking fees?

DLA Energy Response: Port tariffs, including harbor fees, and docking fees are the responsibility of the ship’s owners. The ship’s local agent who usually works with the municipalities and local authorities pay the fees on behalf of the owner, who reimburses them.

27. Would the government accept multiple quotations for single-facility offerings within a single proposal?

DLA Energy Response: Any proposal submitted must be submitted in accordance with the terms and conditions of the solicitation.

28. Would the government accept multiple options for different sites in different countries to provide a comprehensive offering as separately priced line items?

DLA Energy Response: No, PWS paragraph 1.3 requires 2,000,000 barrels storage (fill) capacity which must be available and operational upon award at a single facility.

29. Attachment V PPQ: Contract Performance Assessment Form: Who should be filling this?

DLA Energy Response: The contractors reference should complete the PPQ and submit to the Government prior to the closing date for the solicitation. Please see the addendum to FAR 52.212-1. Additional instructions for PPQ completion are included on the PPQ under General Guidance for Completing Questionnaire.

30. Upon submission of the Offer: please advise tentatively when will be the Successful Bidder notified.

DLA Energy Response: The Successful and Unsuccessful Offeror will be notified by DLA Energy upon the completion of the evaluation of all offers.

31. In the solicitation document it is not clear whether the Contractor needs to be fully liable to damages of the product or whether there is a liability cap. This can have a huge impact on the insurance premiums and almost increase the storage price by 50%. Therefore some clarification on liabilities would be very helpful. Normally we

SPE603-22-R-0500 / Persian Gulf Area have a liability cap in our contracts with the customers but in your terms & conditions there seems to be no limitation.

DLA Energy Response: In regard to Contractor’s liabilities for product loss and damages while in their possession, the Contractor shall refer to PWS sections 2.1 and 2.3.1 which outlines custody and contaminated product liability requirements. The Contractor should also refer to the RFP Contract Text I-0003-I116 which outlines the Contractor’s responsibility for Government-owned product in their custody.

32. Is Fujairah considered part of the Persian Gulf in this solicitation?

DLA Energy Response: Yes, refer to PWS section 1.2 for area of consideration requirements.

33. We are seeking clarification on the following question in respect of 1.10 Additive Injection Requirement of the PWS:

The requirement states that the Contractor’s facility shall be capable of injecting additives to Jet A-1, and to regrade to JAA (Jet A-1 with additives) during shipping/issuing of product. Please clarify the grade/specification of JAA. It is very important to know exactly which fuel is being requested as there are some minor specification differences.

DLA Energy Response: Per PWS 1.10 Additive Injection Requirement, fuel grade JAA is commercial Jet A-1 with additives specifically for military jet aviation turbine engines. The required additive package for JAA consists of fuel systems icing inhibitor (FSII), conductivity additive (CA), and corrosion inhibitor/lubricity improver (CI/LI).

34. The Consent Letter states that DLA-Energy requests the joint venture partners/major subcontractor/teaming partner to provide written consent for the Government to disclose their past/present information to the prime contractor. If an entity is submitting a proposal individually as the sole/single offeror but utilizes another entity to perform certain services/requirements of the PWS, is this considered a teaming arrangement and is a consent letter still required? In this case should the past performance of the sole offeror not be enough for past performance evaluation?

It further states that purpose of the Consent Letter is to authorize the Government to discuss the performance of the subcontractor with the prime contractor. How is this applicable in the case a above? What is the type of information about a joint venture partner/major subcontractor/ teaming partner that the Government would disclose with the prime contractor? Why would DLA Energy need to disclose past/present performance of a subcontractor to the prime contractor, if the prime contractor is the single offeror?

DLA Energy Response: If offeror is planning to use a subcontractor to perform the services, then the teaming arrangement should be identified in its proposal, and the subcontractor should complete the Consent form. As stated in the RFP in Section M, FAR 52.212-2 DLA Energy will evaluate the Past Performance of all team members. During DLA Energy’s evaluation of the subcontractor’s or team member’s Past Performance, DLA Energy will have to identify and

SPE603-22-R-0500 / Persian Gulf Area advise the offeror/prime contractor of any issues with the subcontractor’s or team member’s Past Performance that results in an overall Unacceptable Past Performance rating for the offeror or the offeror’s team.
