About this file
This is a Justification for Other than Full and Open Competition (J&A) for contract SPE602-26-P-0468 issued by the Defense Logistics Agency (DLA) Energy for an urgent spot purchase of Aviation Turbine Fuel (JA1) with static dissipator additive (SDA) delivered via FOB Origin pipeline to Defense Fuel Support Point Central European Pipeline System (DFSP CEPS).
The contract, awarded to BP Oil International Limited on an unusual and compelling urgency basis, is valued at approximately $49,835,910.60 for commercial jet fuel delivery to BP Rotterdam Refinery. The requirement involved an urgent one-time spot buy of JA1 fuel for DFSP CEPS, determined by multiplying the awarded price by the fuel quantity. The contracting officer determined the anticipated cost to the Government was fair and reasonable based on consideration of general market conditions and commodity index prices in the applicable geographical area. DLA Energy justified the use of other than full and open competition under 10 U.S.C. §3204(a)(2), citing that unusual and compelling urgency precluded full and open competition and that delayed award would result in serious injury to the Government. The J&A was publicized after award in accordance with FAR 6.103-2(d) due to the urgent nature of the requirement. No synopsis was posted prior to award per FAR 5.101(b), and no further market research was conducted regarding this one-time purchase. Future fuel requirements for DFSP CEPS will utilize annual contracts awarded using full and open competition through the Atlantic/Europe/Mediterranean (AEM) bulk program.
