1) FAR 52.212-2 EVALUATION – COMMERICAL ITEMS (OCT 2014) has been updated to the following. Changes have been highlighted:

FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

FACTOR 1: TECHNICAL ACCEPTABILITY

The follow subfactors are equal in importance:

1. Operational Capability Plan

2. Quality Control Plan

3. Safety and Environmental Plan

Subfactor 1, Operational Capability Plan- Offerors must submit an Operational Capability Plan that provides Technical, managerial and operational details for providing barge transportation, refueling and defueling services to ensure all orders are fulfilled in a timely manner. For each barge included in the proposal, the Operational Capability Plan must address barge specification information; personnel assigned (identified by position); licensing and insurance. The Operational Capability Plan must contain a certification that the offeror has, or will acquire before contract award, all licenses, permits and insurance required to operate and manage a fuel transportation business within the Tokyo Harbor region, Japan, and that all such licenses, permits and insurance will remain current during contract performance.

Subfactor 2, Quality Control Plan- Offerors must submit a Quality Control Plan that demonstrates how it will provide cargo free of contamination or degradation; must show how the offeror will monitor quality performance, and must explain how the offeror will identify and correct problems, including potential barge tank cleaning.

Subfactor 3, Safety and Environmental Plan- Offerors must submit a Safety and Environmental Plan that details the offeror’s strategy for compliance with applicable environmental laws and regulations, including the handling of oil spills.

Subfactors will be rated either "Acceptable" or "Unacceptable." These ratings are defined as follows:

ACCEPTABLE: Proposal meets the requirements of the solicitation UNACCEPTABLE: Proposal does not meet the requirements of the solicitation.

Each offer proposal must receive an "Acceptable" rating for every subfactor in order to be rated technically acceptable. If an offer proposal receives a rating of "Unacceptable" for one subfactor it will be rated technically unacceptable.

An offeror that proposes an exception to any of the requirements of the solicitation will be reviewed to determine whether the proposal with the exception will meet the Government's requirements. If so, an offer containing the exception may be found acceptable. Likewise, a rating may be made "Acceptable" if an offeror corrects, or the Government accepts by reason of exception, any subfactors previously rated "Unacceptable".

FACTOR 2: PAST PERFORMANCE

Past Performance will be evaluated. An overall integrated assessment rating will be assigned for Past Performance. The Government will review the offeror’s recent and relevant past performance. Recent past performance is defined as having occurred within three (3) years prior to the solicitation issuance date. Relevant past performance is defined as past performance that is similar in scope, complexity, and dollar value to the subject procurement. Past performance information submitted may include that for performance still in progress; however, it should have a minimum of one year’s performance history.

The assessment of the offeror’s past performance will be used as a means of evaluating the offeror’s ability to meet the solicitation requirements. A record of poor performance may be considered an indication that the offeror has failed to conform to contract requirements and/or to standards of good workmanship, adhere to contract schedules, including the administrative aspects of performance; provide reasonable and cooperative behavior and commitment to customer satisfaction; and/or display a business-like concern for the interests of the customer. Offerors shall be afforded an opportunity to address adverse reports of past performance, and the offeror’s response, or lack thereof, will be taken into consideration. Recent contracts may be examined to ensure that corrective action measures have been put in place to prevent the recurrence of past performance problems. Prompt actions taken to correct performance problems may be considered a reflection of management concern for customer satisfaction; however, such action may not mitigate all negative performance trends.

The Government reserves the right to consider any information available to it in evaluating an offeror’s past performance. This includes information obtained from the offeror’s references, past and present customers, subcontractors, and any other sources that may have useful information. However, the Government reserves the right not to contact all of the references listed by the offeror. The Government also reserves the right to assess the offeror’s past performance based solely on the offeror’s performance under an existing DLA Energy contract, or a previous DLA Energy contract for work similar to that required by the solicitation.

The Government requests a minimum of three past performance references to be submitted on the Offeror Past Performance Experience Form (found in Section J, Attachments).

Past performance will be rated as “Acceptable” or “Unacceptable.” In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “Unknown” shall be considered “Acceptable.”

FACTOR 3: PRICE

The Contracting Officer will award on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. The Government reserves the right to conduct a price realism analysis to determine whether the offeror understands the contract requirements. In the event of a price realism evaluation, the Government will conduct this evaluation on the offeror in line for award.

If a price realism analysis is performed and an offeror’s price is determined to be unrealistic, the offeror’s proposal shall be ineligible for award. Therefore, the offeror found to have an acceptable technical rating and past performance rating with the lowest evaluated (and, if price realism is analyzed, realistic) price to the Government may be eligible for award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

2) Offerors are reminded that in accordance with L2.11-4 E-MAIL PROPOSALS (DLA ENERGY OCT 2010)(b)(1) and SF1449, Solicitation Notes, Number 4., BulkFuelsBidCustodian@dla.mil is the appropriate method to submit offers and changes to offers.

3) All other solicitation terms and conditions remain unchanged.
