SPE60123R0307 - 0002

The purpose of amendment 0002 is to:

1. Provide revised Standard Form 1449, to include a check mark in Box 13a., which states “This contract is a rated order under DPAS (15 CFR 700). To clarify DLA Aerospace shall apply DPAS ratings at the delivery order level, as necessary based on mission requirement.

2. Correct FAR Clause 52.211-14 Notice of Priority Rating for National Defense, Emergency Preparedness, and Energy Program (Apr 2002) to uncheck DX rated order box, as only DO rated orders are applicable under this requirement.

3. Provide following Government responses to industry questions:

Question 1: Do all locations have a DPAS rating?

Government Response 1: Yes, all locations have a DPAS rating, see question 3 for further explanation.

Question 2: Which locations have a DX rating?

Government Response 2: No, locations have a DX rating.

Question 3: Which locations have a DO rating?

Government Response 3: All DLA customer locations except for Customs and Border Protection (CBP) shall use DO-C9 rating, as necessary based on mission requirement. Customs and Border Protection (CBP) customers shall use DO-N4 rating, as necessary based on mission requirement.

Question 4: Which locations, if any, have no DPAS rating?

Government Response 4: All locations have a DPAS rating, see question 3 for further explanation.

Question 5: What “covered defense information” will DLA provide to supplier for the performance of this contract?

Government Response 5: In accordance with DFARS 204-7304 Solicitation provision and contract clauses, the Contracting Officer shall Use the clause at 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting, in all solicitations and contracts, including solicitations and contracts using FAR part 12 procedures for the acquisition of commercial products and commercial services, except for solicitations and contracts solely for the acquisition of COTS items.

“Covered defense information” means unclassified controlled technical information or other information, as described in the Controlled Unclassified Information (CUI) Registry at http://www.archives.gov/cui/registry/category-list.html, that requires safeguarding or dissemination controls pursuant to and consistent with law, regulations, and Government wide policies, and is—

(1) Marked or otherwise identified in the contract, task order, or delivery order and provided to the contractor by or on behalf of DoD in support of the performance of the contract; or

(2) Collected, developed, received, transmitted, used, or stored by or on behalf of the contractor in support of the performance of the contract.

In this scenario DLA Aerospace issued delivery orders may be considered “Covered defense information”, customer delivery orders may contain Operationally Critical Information, such expedited delivery dates and include DPAS rating.

Question 6: In order to perform the assessment, supplier needs to know what, if any, covered defense information the DLA will provide or disclose to supplier in the performance of the contract. We reviewed the Controlled Unclassified Information (CUI) Registry at http://www.archives.gov/cui/registry/category-list.html, and none of the categories appear to be applicable to helium supply where the Government is picking up the product from supplier.

Government Response 6: See response to question 5.

Question 7: Lastly, the RFQ cover page (Standard Form 1449) needs to have Box 13a. checked. Box 13a states: “This contract is a rated order under DPAS (15 CFR 700).” However, the Box is unchecked.

Government Response 7: Correction made, see revised SF1449, issued with solicitation amendment 0002.

Question 8: Additionally, many of the FARs and DFARs are not applicable.

Government Response 8: FAR and DFARS clauses are included in the solicitation as prescribed by various parts of FAR/ DFARS. Potential offerors may submit exceptions to FAR and DFARS clauses they deem as “not applicable”, however, failure to agree to the terms and conditions of the solicitation may result in the offeror being removed from consideration for award.

Question 9: Is there a way we can obtain an extension of time for submission?

Government Response 9: The Contracting Officer will not consider extend the solicitation closing date, in accordance with FAR 5.203, a 30-day response time for receipt of proposals from the date of issuance of a commercial solicitation is the standard DLA Aerospace Energy business practice. In addition, to provide ample Industry notice of pending CONUS Helium contracting opportunity, a Pre-Solicitation notice was posted on SAM.gov on 18 April 2023 through 11 May 2023 (a 24 additional days) before issuance of the solicitation.

Question 10: Will the DLA seriously consider our proposal if based on well-resourced subcontractors, and not our direct past experience?

Government Response 10: Technical Proposal shall be submitted in response to Solicitation Attachment B – Aerospace Contract Text, Section L - Instructions, Conditions and Notices to Offerors (pages 8 through 11) and proposals shall

be evaluated in accordance with Section M – Evaluation Factors for Award (pages 11 through 12).

Question 11: Regarding the subject solicitation, does Contracting Officer have any time today to take a call to discuss questions?

Government Response 11: No, the Contracting Officer will not have “direct exchanges with potential offerors”. In accordance with FAR 15.201 (f) Exchanges with Industry Before Receipt of proposals - General information about agency mission needs and future requirements may be disclosed at any time. After release of the solicitation, the contracting officer must be the focal point of any exchange with potential offerors. When specific information about a proposed acquisition that would be necessary for the preparation of proposals is disclosed to one or more potential offerors, that information must be made available to the public as soon as practicable, but no later than the next general release of information, in order to avoid creating an unfair competitive advantage. Information provided to a potential offeror in response to its request must not be disclosed if doing so would reveal the potential offeror’s confidential business strategy, and is protected under 3.104 or subpart 24.2. When conducting a pre-solicitation or pre-proposal conference, materials distributed at the conference should be made available to all potential offerors, upon request.

4. Notify offerors the closing date remains unchanged at 12 JUNE 2023 at 4:00 PM, Central Time (CT).
