2. The acquisition of helium by Federal Agencies is governed by Federal Acquisition Regulation (FAR) Subpart 8.5, which implements the Helium Act (50 U.S.C. 167, et seq). Only Federal helium suppliers as designated by the Bureau of Land Management (BLM) will be eligible for a contract award REQUIRED SOURCES FOR HELIUM AND HELIUM USAGE DATA (Apr 2002) applies for award of BLM helium for CLINs identified as BLM product ITEMs and are subject to the Helium Act and as such, FAR Clause 52.208-8.

If BLM helium is not available, the Government may evaluate and award to a non-BLM helium supplier IAW FAR Part 5. The list below breaks down further BLM and Non-BLM requirement by Grade A and Grade E7.

4. The resultant contract(s) will contain an Economic Price Adjustment (EPA) clause. For ALL Helium requirements, the EPA escalator is mandated by the BLM pursuant to the Helium Privatization Act. All BLM Gaseous Helium product will be adjusted using the BLM index (In-Kind rate). For Non-BLM helium the BLM “Open Market” rate will be utilized. The EPA mechanism will not be applicable to any CLINs for services. Except for the annual BLM adjustments, the awarded prices for product will remain firm for the length of the contract for two years. Any recovery costs associated with moving crude helium to the refining plant and moving the refined helium to the transfill location for filling or any other production costs must be included in the unit price.

All prices proposed for BLM product CLINs shall be based on the Bureau of Land Management FY2016 (Oct 2015 – Sept 2016) Crude Helium Price of $84.40 (in kind). The Non-BLM product CLINs shall be based on the BLM FY2014 (Oct 2014 – Sep 2015) crude helium price of $106.00 (Conservation Helium). Both the crude helium in-kind price and the Conservation Helium price are considered base reference prices for this procurement.
