Questions and Answers from Kuwait Transportation SPE600-17-R-0702

1. What is the minimum notification period to be given by DLA Energy to the Contractor for the delivery of fuel for a particular day (ie; min. time available between DLA's 'Order for Fuel' and time of 'Delivery')?

Performance Work Statement (PWS) paragraph 6.2 states “Daily delivery orders will be placed by the DLA Energy-ME Region’s Ordering Officer (or Sub Area Petroleum Officer (SAPO)) no later than 48 hours prior to delivery date specified in the order.”

2. What is the duration of current contract including options..? and total contract amount including all optional years if any..? and the name of current contractor..?

The current contract SP0600-14-D-0483 was solicited as a base year, March 1, 2014 through February 28, 2015, with two option periods: March 1, 2015 through February 29, 2016 and March 1, 2016 through February 28, 2017. The current contractor is KGL Transportation Company and the estimated total award is $2.7 M.

3. Is it possible if you could give us a breakdown of the daily requirements needed to sustain each base. This would help me and my team assess the total number of trucks and the different types of fuels needed on a daily basis.

The schedule in section B of the Request for Proposal identifies the maximum gallons per product, for each possible origin and destination. Section 6.2 in the PWS identifies the maximum gallons that can be ordered on any given delivery order.

4. Reference 2.5 Performance Objective: Transportation Requirements. We note that Paragraph 2.5.1 states that trucks not loading at Kuwait Aviation Fueling Company (KAFCO) and Kuwait National Petroleum Corporation (KNPC) facilities shall be in good mechanical working order and no older than seven (7) years. The paragraph also states that trucks loading at KAFCO and KNPC facilities must meet all KAFCO and KNPC Technical Specifications respectively for Truck Fuel Road Tankers/Semi Trailer (See Attachments 1 and 2) including KAFCO and KNPC equipment age requirements.

After reviewing the KNPC and KAFCO specifications we note that neither KNPC nor KAFCO state specific ages for tankers.

a. Can the Gov’t please provide the KNPC and KAFCO requirements specific to the age for vehicles?

b. In regards to the Government establishment in 2.5.1 of truck age as 7 years or newer, please confirm the age limit of 7 years applies to both Truck and Tanker on Semi Articulated configurations.

The requirement for trucks to be no older than 7 years has been removed from the PWS.

5. Reference the still-to-be filled in code boxes in lines 15, 16 and 18a on Standard Form 1449. Also, reference page 14 of the solicitation in which the code for Virginia is missing.

Please state the codes which will be used for Line 15 (Deliver To), Line 16 (Administered By) and 18a (Payment Will Be Made By) for this contract.

Regarding the SF1449:

Box 15 – The delivery location is specified per CLIN in SECTION B - SUPPLIES OR

SERVICES AND PRICES OR COSTS.

Box 16 - The contract resulting from this solicitation will be administered by DLA Energy, SPE600.

Box 18a – Payment will be made in accordance with DFARS 252.232-7006 Wide Area WorkFlow Payment Instructions. (MAY 2013)

6. Reference Addendum to SF1449, page 1, number 6. This states “The contractor should be aware that in accordance with FAR 52.229-6, Taxes -- Foreign Fixed-Price Contracts a 2% excise tax will be applied to any contract awarded from this solicitation that meets the criteria established in 26 U.S.C. 5000C.”

Also reference page 3, number 1.6 which states: “Under the Status of Forces Agreement (SOFA), the United States is a tax exempt entity. If any tolls, taxes, fines, etc. are imposed by Kuwait Government, the contractor shall report such to the DLA Energy Middle East (ME) Southwest (SW) Office.”

Please clarify which requirement the Contractor will be required to follow.

Per the solicitation the 2% excise tax referenced in FAR 52.229-6 will only be applicable if the criteria established in 26 U.S.C. 5000C is met. With regard to services, the tax is only in effect for services that are provided in any country which is not a party to an international procurement agreement with the United States. Contractors with a United States Tax Identification Number are exempt from the tax.
