Item Question Installation /DLA-E Reply

Appendix AF (Lakenheath & Mildenhall) (2) Hours of operations list several functions but only “Bulk Storage” has hours listed, however it also states “Contractor must be capable of providing 24 hours x 7 days per week. This could be assumed all other functions are to be manned 24x 7. Please clarify which functions and what hours of operations

The Contractor is only responsible for bulk storage operations and facilities identified in the PWS and Appendix AF, and normal hours of operation for bulk storage are provided. The Contractor may be required to provide extended coverage if necessary.

PWS first part seems to be general in nature and exceeds the requirements;

however, Appendix AF seems to be geared to the installation. Please clarify that this effort is for Bulk Storage only?

IAW Appendix AF, this is a bulk storage requirement with applicable PWS paragraphs.

Given SOFA will not be extended will UK citizens be allowed to perform? It is the offeror's responsibility to determine whether their personnel employed will be UK citizens, US retirees living abroad, third country nationals, etc.

4 Will operations come under JIG or US Standards, ATA103 or A4A? Specific, relevant operational and quality technical standards are provided in Appendix C

Is an asset inventory available for fixed and mobile equipment and what is the method of valuation if ultimately used by Contractor??

Government furnished equipment, if any, is listed in Appendix

AF.

6 What is the number of personnel currently employed? DLA Energy will not provide detailed information regarding to current contractor.

7 What are the current shift patterns? DLA Energy will not provide detailed information regarding to current contractor.

The Contractor believes that this contract is subject to European TUPE legislation, this requires that all employees will be transferred to the new contractor with their current employment rights and salary. This information will have to be made available to bidders in order to accurately estimate these works and understand our obligations.

When will this information be made avaialble to bidders?

DLA Energy will not provide detailed information regarding the current contractor.

9 What legislation is used (UK law, HSE jurisdiction/COMAH etc)? Offerors are responsible for determing which laws apply and for compliance with those laws.

Are you able to clarify what maintenance of buildings is undertaken by Contractor and BCE.

The Contractor is responsible for general cleanliness and for calling in work orders to BCE for building maintenance and repair.

The Contractor shall provide, at Contractor expense without additional government funding, all personnel, supplies, materials, fuel, equipment, vehicles, services (routine or emergency), training and other items necessary for performance of the requirements of this contract not otherwise identified in the basic PWS or Appendix AF.

This clause states that the Contractor is required to carry out any duties not listed at no extra cost. The boundaries to such obligation need to be clarified.

IAW PWS C-3.1 General Scope of Work, "The Contractor will be responsible for providing the necessary personnel and resources to accomplish all tasks specified herein at Contractor expense unless otherwise specifically stated otherwise." The statement in Appendix F merely reiterates the earlier reference and is intended to stress the non-reimburseable, firm fixed price nature of the contract which is a change from previous contracts. Tasks to be performed are provided in the PWS.

The Contractor is responsible for determining and providing all necessary resources to accomplish these tasks.

Is Contractor supplying operator vehicles for this contract? If yes, what specification would these need to be?

The Contractor is not providing special purpose vehicles for this contract. It is the Contractor's responsibility to determine the requirement for general purpose vehicles and propose accordingly.

We understand the contract is being let by the DLA but please can you confirm the contracting entity for this contract, is it US/UK entity to ensure we as contractors can ensure all relevant taxes are understood and applied? As an example the Contractor wants to understand whether British Value Added Tax (VAT) is chargeable on invoices?

The contracting entity is the Defense Logistics Agency Energy.

Refer to FAR 52.229-6(c) regarding applicable taxes and duties. As a reminder, offerors need to disclose the taxes included in their price under K-0003 K86.

Contractor kindly request a native version of “Attachment_III_- _Contractor_Performance_Assessment _Qs”

A copy of Attachment III - Contractor Performance Assessment Questionnaire is provided in Word for your convenience.

Lakenheath/Milldenhall, UK Responses

The Contractor will be working to UK health and safety legislation, can we assume this will be universal for all bidders and we wont be penalised on cost.

Offerors are responsible for determing which laws apply and for compliance with those laws.

Please provide the following information for all current employees working at Lakenheath and Mildenhall. Individual names are not required, but all detailed information for each employee to include, as a minimum:

- his or her official role/position

- annual salary

- any associated benefits package (including, for example, where appropriate, any bonus payments, pension and private health)

- age and length of service

- notice period

- any collective bargaining agreement or labour contract that is in force

- any other specific and pertinent individual data related to the personal circumstances of each individual's employment package.

DLA Energy will not provide detailed information regarding the current contractor.

We are unclear about the page requirements of the Technical proposal as the instructions are slightly different between Section L and the OSP as follows:

* Section L indicates the volume is limited to 70 pages, including Appendices and Attachments * OSP indicates the volume is 70 pages total and "the first 50 pages will address the PWS and the 20 additional pages will address the RAF Lakenheath/Mildenhall AB, UK PWS Base Appendix that details the site specific requirements...."

Is it your intention that the OSP instructions prevail? Any clarity you can provide is much appreciated!
