Amendment 0001
1. The following provisions are being replaced in their entirety from Solicitation SPE600-14-R-0414:
L705 INSTRUCTIONS TO OFFERORS (NATURAL GAS) (DLA ENERGY JUL 2014) (REV)
(a) OFFEROR’S PROPOSAL. The offeror shall submit all documents required by the terms and conditions of this RFP.
(1) PROPOSAL SUBMISSION OVERVIEW. The proposal consists of the following sections:
SECTION I. Executed RFP;
SECTION II. Area of Supply Interest and Technical Compliance;
SECTION III. Past Performance – Experience with End Users;
SECTION IV. Small Business Subcontracting Plan (required of Large Businesses);
SECTION V. Supply Commitment Letter (s) (Only for Small Businesses and HUBZones Offering Under the Small Business Set-Aside Program and HUBZone Price Evaluation Preference);
SECTION VI. Price; and Other documents as requested.
(2) SECTION I – EXECUTED RFP. The executed RFP shall consist of the following:
(i) Standard Form 1449 (Solicitation, Contract, Order for Commercial Items) with Blocks 17 and 30A through 30C completed to include a hand-written signature (a clear, scanned version is sufficient). By completing Blocks 30A through 30C the offeror agrees to the terms and conditions of the RFP;
(ii) The Offeror Representations and Certifications.
(3) SECTION II – AREA OF SUPPLY INTEREST AND TECHNICAL COMPLIANCE. Offerors must submit the completed Area of Supply Interest and Technical Compliance form. Each offeror must list at least one (1) local distribution company (LDC)/pipeline contact for each LDC/pipeline.
(4) SECTION III – PAST PERFORMANCE – EXPERIENCE WITH END USERS. Offerors must submit past performance information on the form entitled Past Performance – Experience With End Users. “Recent” past performance is performance within the past three (3) years of the closing date of the solicitation. Offerors are instructed to provide at least three (3) references.
(5) SECTION IV – SUBCONTRACTING PLAN (ONLY FOR LARGE BUSINESSES). Offerors must submit a subcontracting plan in accordance with FAR Part 19.704 by filling out a Small Business Subcontracting Plan. Offerors with a commercial plan should submit the latest version of the plan with their offer. If the offeror thinks that there are no subcontracting possibilities as defined in FAR Part 19, the offeror shall provide written justification as to why no such opportunities exist.
(6) SECTION V – SUPPLY COMMITMENT LETTER(s) (ONLY FOR SMALL BUSINESSES OFFERING UNDER THE SMALL BUSINESS SET-ASIDE PROGRAM OR THE HUBZone PRICE EVALUATION PREFERENCE). Offerors must submit a supply commitment letter that meets the requirements in the SUPPLY COMMITMENTS FOR SMALL BUSINESS CONCERNS (NATURAL GAS) contract provision. Failure to provide the documentation required shall make offeror ineligible for award of those requirements or the HUBZone Price Evaluation Preference.
(7) SECTION VI – PRICE. When providing pricing for an identified requirement(s), an offeror must propose to supply the total line item quantity for the line items identified in the Schedule. Failure to offer the total line item quantity will preclude Government evaluation and award to the offeror for the line items. For tied line items offerors must offer on all items identified in a tied group in order to be eligible for award of that group. Offerors must offer both a winter and a summer adjustment factor for each line item offered upon.
Offerors shall submit their most competitive prices with the proposal as the Government reserves the right to award without final price revisions.
(8) PERIOD FOR ACCEPTANCE OF OFFERS. By submitting an offeror, the offeror agrees to hold the prices in its offer for the time period specified in the Addendum to this Solicitation.
(b) SUBMISSION OF OFFERS.
(1) Offerors interested in obtaining a DLA Energy contract for the direct supply of natural gas must submit the items detailed in the INSTRUCTIONS TO OFFERORS provision of the solicitation.
(2) Offerors shall submit offers via e-mail or by physical delivery. Facsimile proposals will not be accepted. Proposals, modifications and proposal revisions must contain a signature.
(i) Proposals by mail shall be submitted to the following address:
ATTN: DLA ENERGY-A, ROOM 3830
DEFENSE LOGISTICS AGENCY ENERGY
8725 JOHN J. KINGMAN ROAD, SUITE 4950
FORT BELVOIR, VA 22060-6222
(ii) E-mail proposals are subject to the same rules as paper proposals. Proposals shall be sent to the following e-mail address: dlaenergy.ngteam@dla.mil
(3) The Defense Logistics Agency Energy (DLA Energy) accepts attachments in—
(i) Adobe Acrobat;
(ii) Microsoft Excel;
(iii) Microsoft Word; and
(iv) Microsoft PowerPoint.
Attachments that are not in .pdf file format must be sent in “read only” format to ensure the integrity of the data submitted. Proposals submitted electronically through a single e-mail must be no more than 15 MB. DLA Energy’s mail server will reject messages larger than 15 MB. The DLA Energy e-mail filter will scan the incoming e-mail and attachments for viruses and key words. Abbreviations for terms such as “Analysts” or using “3Xs” as placeholders in a document are found in the filter’s adult content library and may result in the e-mail delivery being delayed. Offerors are encouraged to verify receipt of e-mail offers by contacting the Contracting Officer prior to the solicitation closing time. If any portion of an e-mail proposal received by the Contracting Officer is unreadable, the Contracting Officer will immediately notify the offeror and permit the offeror to resubmit the proposal. The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror and the resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the offeror complied with the e-mail submissions instructions provided in this paragraph and with the time and format requirements for resubmission prescribed by the Contracting Officer. The Government reserves the right to make award solely on the e-mail proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete signed original proposal.
(4) Offerors shall submit final revisions via email only.
(5) Final price revisions must contain a signature.
M2.16 EVALUATION – COMMERCIAL ITEMS (NATURAL GAS) (DLA ENERGY JUL 2014)
(a) BASIS FOR AWARD – NON-PRICE FACTORS. The Government will award each line item or tied group of line items to the responsible offeror with the lowest price whose proposal is rated acceptable in the following categories:
(1) TECHNICAL COMPLIANCE EVALUATION.
(i) For customers served behind the local distribution company (LDC) an offeror must possess a minimum of 12 months of experience (within the past two years) providing supply and transportation (firm and/or interruptible) of natural gas to retail customers served by a LDC within the state for which it is interested in proposing and shall provide evidence that it is authorized to conduct business on proposed LDCs;
Or;
(ii) For customers served directly off a pipeline an offeror must possess a minimum of 12 months of experience on the applicable pipeline (within the past two years) providing supply and transportation (firm and/or interruptible) of natural gas to retail customers served directly off the pipeline and shall provide evidence that it is authorized to conduct business on the proposed pipeline.
Such experience and authorization must be obtained by noon local Ft. Belvoir time on the business day prior to award or the offeror will not be considered for award.
(2) PAST PERFORMANCE EVALUATION
Past performance shall be evaluated in accordance with the guidelines set forth in FAR 15.305. An offeror’s past performance will not be compared to past performance of other offerors. Offerors will have the opportunity to address adverse past performance reports and the Government will consider this information, as well as information gleaned from other sources, in its evaluation of past performance. Past performance will be evaluated on an “acceptable” or “unacceptable” basis. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” In order to achieve a rating of “acceptable,” the Government must have a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
(b) PRICE. The lowest price is calculated through the use of a weighted average involving summer and winter adjustment factors and their associated quantities. In the case of tied line items, the lowest price will be that price which represents the lowest weighted average of the entire tied group.
(c) Offerors should submit proposals that are acceptable without additional explanation or information.
(d) The Government will perform a price analysis to determine the reasonableness of proposed prices in accordance with FAR 15.404. The Government intends to evaluate price based on the total cost of the solicitation schedule elements associated with the line item(s), except the indexed supply price. Additionally, the Government will consider the reasonableness of the possible extension period based upon use of the weighted average price in paragraph (b).
(e) After the price evaluation, DLA Energy will provide a notice of award for each line item to the responsible offeror with the lowest price whose proposal is rated acceptable on the non-price evaluation factors.
(f) A written notice of award or acceptance of an offer e-mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer shall result in a binding contract without further action by either party. The Government reserves the right to not award a requirement if it is determined that such action is not in its best interest.
(g) This process will repeat until all requirements are awarded. Upon completion of the price evaluation for all requirements, DLA Energy will issue each successful offeror a contract containing the line items for which it received a Contracting Officer’s notice of award.
(h) Before the offer’s specified expiration time, the Government may accept an offer or part of an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
2. The following provisions are being deleted in their entirety from Solicitation SPE600-14-R-0414:
DLAD 52.215-9004 AbilityOne Entity Proposal (Dec 2012)
DLAD 52.215-9005 AbilityOne Entity Support Evaluation (Dec 2012)
