4. The applicable statutory authority permitting other than full and open competition is
10 U.S.C. 2304(c)(1), as implemented by FAR Part 6.302-1, Only One Responsible
Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. The use of this authority is necessary because Bell Helicopter and Duncan Industries are the only known approved sources for the required clamp bolt assembly, which is a repair part designed and used , a military-unique aircraft developed jointly by Bell Helicopter and Boeing. Bell Helicopter is the Design
Control Authority (DCA) for the clamp bolt assembly. Bell Helicopter has authorized
Duncan Industries to manufacture the required item and has added them as a source on their drawing.
This clamp bolt assembly is comprised of a bushing and a bolt and attaches three swashplate actuators to the support assembly of the rotor blades. As part of the flight control system, the swashplate actuator controls the pitch of the rotor blades.
Failure of the clamp bolt assembly would leave the three swashplate actuators unattached from the rotor blade support assembly, rendering the unable to change direction and leaving the aircraft non-functional. Its failure in flight would have major catastrophic consequences; hence the Navy’s Engineering Support Activity (ESA) has determined that this part is a Critical Safety Item (CSI). Alternate items must qualify in accordance with
DCA procedures, as approved by the Navy’s ESA. Public Law 108-136, Section 802 established the requirement that the head of the contracting activity for an aviation CSI enter into a contract for the procurement, modification, repair, or overhaul of such an item only with a source approved by the DCA in accordance with 10 U.S.C. §2319.
