About this file
This is a Questions and Answers document clarifying requirements for solicitation SP8000-26-R-0011, an Indefinite Delivery Indefinite Quantity (IDIQ) contract for 4N (99.99%) purity indium metal ingots issued by the Defense Logistics Agency (DLA). The document addresses 11 key clarifications covering packaging, labeling, palletization, past performance evaluation, sampling requirements, testing procedures, and domestic sourcing requirements. Packaging must be damage and moisture resistant per SOW Section II.F, with detailed descriptions required in proposals addressing Subfactor 1.5; pictures are preferred but not required. Labeling and palletization standards are specified in SOW Section II.G and II.F.5-6 respectively. Past performance submissions must follow FAR clause 52.212-2, with commercial refined metals contracts deemed unacceptable; however, offerors without relevant past performance records receive a neutral rating considered acceptable for evaluation purposes.
The Q&A further clarifies that samples are not required with proposals, and inspections occur at every delivery lot but not at DLA Strategic Materials facilities—the contractor must employ an independent third-party analytical chemistry lab meeting SOW II.C.3 requirements and allow government witness of sampling operations. Proposed delivery schedules are submitted within 30 days of contract award rather than with the technical approach. Critical to domestic sourcing, production facilities must be CONUS-based for all material supplied; while unrefined or raw materials may be imported and refined domestically, a partnered supply model involving foreign-sourced indium is only acceptable if the domestic partner refines the product at its own CONUS facilities to meet specifications. Technical documents including Safety Data Sheets (SDS) and Certificates of Analysis (COAs) must accompany the technical approach section during evaluation.

| Q/A # | Description | * Answers(A) are below each Question (Q) |
| 1Q | What are the specific packaging standards required by the Government? The tender states “all indium ingots shall have a form and packaging conducive to long-term storage in an enclosed Government warehouse”. | |
| 1A | References to packaging requirements can be found in SOW Section II.A.1.b-c. and SOW Section II.F. Material must be packaged into damage and moisture resistant containers as stated in the SOW Section II.F. There are no specific requirements for container materials or dimensions, but this information should be provided in the technical approach when addressing Subfactor 1.5 and SOW II.F. | |
| 2Q | Are there any specific labeling or palletization requirements? | |
| 2A | Yes. Please see SOW Section II.G. for labelling requirements and SOW Section II.F.5-6 for Palletization requirements. | |
| 3Q | Do offerors need to submit pictures of how the Indium is/will be stored? | |
| 3A | Pictures are preferred, but not required. Offerors must submit detailed description of the intended packaging method that meets all requirements in SOW.II.F. | |
| 4Q | What is the government looking for regarding recent and relevant past performance? Please elaborate on what needs to be submitted. | |
| 4A | Attachement 3 - Clauses and Provisions_Indium includes FAR clasue 52.212-2 EVALUATION - COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021) section (a)(ii) which outlines the required submission details for past performance. Please review. | |
| 5Q | Will commercial contracts for refined metals be considered acceptable past performance? | |
| 5A | No. However, in the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). In this situation, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.” | |
| 6Q | Do any samples need to be submitted prior to deliveries or as part of the proposal evaluation? | |
| 6A | Samples do not need to be submitted as part of the proposal. | |
| 7Q | Would all tests/inspections take place at the DLA Strategic Materials Scotia Consolidated Station Property and is this done for each delivery order? | |
| 7A | Inspections take place for every lot of material delivered to SM. Testing, sampling, and inspections will not take place at DLA Strategic Materials facilities. As stated in SOW Section II.B, the government will witness the Contractors' sampling operations for each lot. As stated in SOW Section II.C, the contractor must employ an independent third-party analytical chemistry lab that meets the requirements in SOW II.C.3. Each lot must be sampled and tested in a way that meets the requirements in the SOW. A delivery order will consist of multiple lots. | |
| 8Q | Regarding the technical considerations referenced in FAR 52.212-2 Evaluation-Commercial Products and Commercial Services, do these documents (SDS,COAs) get submitted with the technical approach section? Does this go along with a completed copy of FAR 52.212-3? | |
| 8A | Yes, the requested documents (SDS, COAs) must be sumbitted with the technical approach section. These documents will be used as part of the evaluation. | |
| 9Q | Does the proposed delivery schedule get submitted with the technical approach section? | |
| 9A | No, the proposed delivery schedule does not get submitted with the technical approach section. The proposed devlivery schedule shall be submitted with 30 days of contract award. Please find additional information in SOW Section II.I. | |
| 10Q | Just clarifying that the material can not be imported from China as the country of origin? | |
| 10A | As stated in SOW Section II.B.3, "The contractor’s production facilities must be within the CONUS for all lots of material the contractor intends to supply the government." Material must be produced from CONUS-based facilities. However, it is acceptable if unrefined or raw materials are imported from another country and later refined in the contractor's CONUS-based facility to meet the required specification. | |
| 11Q | Would DLA consider a partnered supply model whereby a US based manufacturer or integrator serves as the prime contractor, while a second company provides indium previously procured from a foreign source into that domestic production or finishing stream? | |
| 11A | As per SOW.II.B.3, the production facilities that the contractor intends to use must be within CONUS. To further clarify, if the prime utilizes a second company that imports the Indium from a foreign source into the domestic supply chain, this would not be accceptable UNLESS the second company refines the product at its own CONUS-facilities to meet the required specification. |
