Attachment D: Evaluation Criteria

GERMANIUM INGOT

SP8000-17-R-0004 Page 1 of 3

The Government requires 640 kilograms (kg) of zone-refined Germanium (Ge) ingots having a purity of ≥99.999% germanium by weight (“5N Ge”).

The Defense Logistics Agency (DLA) Strategic Materials has collected Ge scrap and removed all of the radioactive substances, such as thorium coatings, from the scrap. DLA Strategic Materials will supply 640 kg of Ge scrap to the Contractor as Government Furnished Material (“GFM”). The Contractor shall produce and deliver a total of 640 kg of 5N Ge in the form of zone-refined ingots. The Contractor shall use the GFM as feedstock for producing the 5N Ge and shall provide its own additional material as required to produce the 640 kg. The Contractor is required to return 640 kg of 5N Ge to the Government in return for the 640 kg of Ge scrap.

The scrap is derived from end-of-life or excess-to-need items and will be provided to the Contractor as Government Furnished Material. The period of performance is one year from the date of contract award. The Government intends to award one firm fixed-price contract as a result of this requirement.

In accordance with FAR 15.101-2(b)(1): All offers will first be evaluated to determine if they meet the Government’s minimum qualifications as specified in the Statement of Work (SOW).

Award will be made on the lowest evaluated price of proposals meeting the acceptability standards for the non-cost factors of Technical Requirements and Past Performance.

In accordance with FAR 52.212-2(a), the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1: Technical Requirements

Factor 2: Past Performance

Factor 3: Price

Factors 1 and Factor 2 shall be evaluated on an Acceptable/Unacceptable basis:

A proposal is considered acceptable if:

(1) It addresses all technical requirements listed in the SOW.

(2) If it shows the Contractor understands all essential requirements of the solicitation and SOW, and has demonstrated a full capability to perform the prospective requirements.

(3) The Contractor provides all submittals required as stated in the Combined Synopsis/Solicitation document.

(4) Although some discussion of the proposal may be desirable, the proposal is complete to the extent that an award could be made on its present terms.

Evaluation Criteria

SP8000-17-R-0004

A proposal will be considered unacceptable if award cannot be made on the present terms of the proposal, and corrective action would require essentially rewriting the proposal or require the submission of an approach, which would be new or almost entirely different from that previously proposed. The proposal will also be considered unacceptable if it does not include the required submittals.

An “Unacceptable” rating on Factor 1 (Technical Requirements) shall render the proposal ineligible for award, or if discussions are held, a proposal found to be “unacceptable for award” (as defined above) will be excluded. Communications may be held with the Contractor where past performance information is a factor preventing their proposal from being acceptable.

FACTOR 1—Technical Requirements

Factor 1 shall be evaluated on an Acceptable/Unacceptable basis.

The Offeror’s proposal will be evaluated for technical acceptability. To be determined acceptable, the Offeror shall demonstrate an ability to produce 640 kg of the material meeting the requirements of the Statement of Work (SOW) in one (1) year.

The Offeror shall demonstrate the capability of meeting the requirements for the material in Section 4.1 of the SOW. The Contractor shall include in their proposal a Certificate of Analysis (COA) for 5N Ge previously produced by their facility which meets the requirements specified in 4.1 of the SOW.

The Offeror shall demonstrate the capability of meeting the requirements for Sampling and Testing in Section 4.2 of the SOW. The Contractor shall contract for independent Third Party testing on each production lot of Ge ingots. Detailed requirements for testing and testing company selection are found in Attachment 1 to the Solicitation. The Offeror shall submit a Quality Control Plan from the testing company (Sampler/Laboratory) as part of its offer. The Quality Control Plan shall detail procedures to ensure efficient and accurate sampling and analysis.

The Offeror shall demonstrate the capability for packaging and marking in Section 4.3.

The Offeror shall demonstrate the ability to ship and deliver the material in accordance with Section 5 of the SOW including ability to deliver material, completely tested, analyzed, verified, and acceptable to the Government within one (1) year from the date of contract award.

FACTOR 2—Past Performance

Factor 2 shall be evaluated on an Acceptable/Unacceptable basis.

In the case of a Contractor without a record of relevant past performance, or for whom information on past performance is not available, or is so sparse that no meaningful past performance rating can be reasonably assigned, the Contractor may not be evaluated favorably or unfavorably on past performance. Therefore, the Contractor shall be determined to have

unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

The Government will evaluate past performance using information provided with the proposal and information obtained from other sources, including past and present customers, subcontractors, etc. This assessment is based on the Contractor’s record of relevant and recent (within the last 3 years) past performance information that pertains to the services under a similar contract as outlined in the solicitation requirements. Documentation of recent and relevant past performance will be evaluated to determine a pattern of meeting material standards and timely delivery.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the Contractor.

Should the Government discover adverse past performance information to which a Contractor did not have a prior opportunity to respond, the Contracting Officer may conduct communications if deemed appropriate.

FACTOR 3—Price

If a proposal has been determined acceptable under each of the abovementioned non-price factors, the Government will evaluate the Contractor’s unit price(s) to determine if they are reasonable and in the best interest of the Government. The Contractor is required to provide as clear and understandable as possible the costs associated and appropriate to each item listed in the Solicitation. The proposal will be evaluated for price, such that it is reasonable and competitive for the service. FAR 52.215-20 - Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data, with Alternate IV, has been included in the Solicitation. Submission of certified cost or pricing data is not required. The offeror shall submit, at a minimum, information on prices at which the same item or service, or similar items or services, have previously been sold in the commercial market that is adequate for evaluating the reasonableness of the price for this acquisition. Such information may include sales data and any information reasonably required to explain the offeror’s estimating process including but not limited to (a) the judgmental factors applied and the mathematical or other methods used in the estimate, including those used in projecting from known data; and (b) the nature and amount of any contingencies included in the proposed price. The contractor’s format for submitting the data should be used.
