Defense Logistics Agency
About this file
This justification and approval document is for a sole source contract awarded by the Defense Logistics Agency to an unknown vendor. The contract provides for continued lease support of 940 multi-functional devices in Germany from April 1, 2023 through August 31, 2023. Services under the contract include full-service maintenance, all consumable supplies excluding paper, key operator training, networking functionality, security accreditation, and technical and network installation support. The estimated total value of the base period plus one-month option period is unspecified. A justification for the sole source award cites the need for uninterrupted support and the short period to transition to a new lease, as no other vendor could service the current lease within the required timeframe.

3. A DESCRIPTION OF THE SUPPLIES AND SERVICES REQUIRED TO MEET
THE AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:
Continued MFD lease support for up to five (5) months to include full-service maintenance, all consumable supplies (excluding paper), key operator training, networking functionality, security accreditation along with technical and network installation support.
Period of Performance:
Base Period: April 1, 2023 –July 31, 2023 Option Period: August 1, 2023 – August 31, 2023 Estimated total value including the one-month option is
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER
THAN FULL AND OPEN COMPETITION:
41 U.S.C. § 1901 as implemented by FAR Subpart 13.5(a)(ii)
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES
USE OF THE CITED AUTHORITY:
Although other vendors are available to supply MFDs with consumables and services, there is a short time period to allow installation. There is no other vendor that would be able to deliver devices in time for an April 1, 2023 start date.
The devices are in place and need to be extended on a sole source contract. Since the devices in place are under a lease, no other vendor can service the lease of another vendor without violating the lease terms. The only way to ensure uninterrupted support to the Warfighter is to issue a contract to the current vendor.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
Market research indicates that an adequate competition pool exists for requirements of this type. The contract will only be in place for up to five months to account for the time needed to install the MFDs on the follow-on contract.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT REPRESENTS THE BEST
VALUE TO THE GOVERNMENT BASED ON RECOMMENDED ACTION:
As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable by comparison of the proposed price to historical pricing for Germany.
