DEFENSE LOGISTICS AGENCY

HEADQUARTERS

8725 JOHN J. KINGMAN ROAD

FORT BELVOIR, VIRGINIA 22060-6221

JUSTIFICATION FOR SOLE SOURCE ACQUISTION (FAR 6.302-1)

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

AGENCY:

Defense Logistics Agency (DLA) DLA Installation Support at Ft. Belvoir 8725 John J. Kingman Road Fort Belvoir, VA 22020-6220

CONTRACTING ACTIVITY:

Defense Logistics Agency Support Services DLA Contracting Services Office, DCSO-H 8725 John J. Kingman Road, Stop: 6220 Fort Belvoir, VA 22060-6220

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED

The action for which approval is sought is a sole source contract with Virginia Department of Transportation (VDOT) to provide E-ZPass access transponders, a total of eighty-two (82) for vehicles utilized by the Defense Logistics Agency (DLA). These access transponders are sold exclusively by the VDOT. The transponder use provides several advantages over cash toll collection such as improved safety, less traffic congestion, and reduced petroleum consumption by allowing drivers to continue moving through specially marked toll lanes without having to come to a complete stop.

This solicitation will be a single contract that will cover EZ-Pass interoperability among 15 states and since DLA Headquarters is in the state of Virginia, a sole source justification is being sought through the Virginia Department of Transportation. This will allow DLA to simplify the acquisition process and maintain control and auditability concerns in regard to payments.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS/ESTIMATED DOLLAR AMOUNT

DLA requires one hundred and 3 (103) E-ZPass transponders at an estimated annual operating costs of XXX for first year base (12 calendar months from the date of contract signing) for a total of XXX and four (4) option years.

The Virginia Department of Transportation (VDOT) E-ZPass Customer Service Center will allow DLA to establish an E-ZPass contract under a Business account. This will allow DLA to travel on VA toll roads and express lanes without paying a toll. Invoices must be paid within 30 days to avoid interest charges and will include a monthly service fee.

4. IDENTIFICATION OF: THE STATUORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITON

This is a sole source award recommendation in accordance with the authority of FAR 6.302-1, due to proprietary rights, only one responsible source and no other supplies or services will satisfy agency requirements. Due to the transponders being managed at the HQ Complex in Virginia, DVOT is the only source available.

5. DEMONSTRATION THAT NATURE OF ACQUISITION REQUIRES USE OF CITED AUTHORITY

E-ZPass is an Electronic Toll Collection (ETC) method that makes traveling more convenient and quicker as you travel through participating toll facilities, and helps reduce traffic congestion for everyone. Conventional toll collection methods require you to deposit coins, tickets, and tokens at toll plazas. This hurts highway capacity because the number of vehicles that can be processed at toll plazas is limited.

E-ZPass is an easy way to use toll roads in 15 states, reaching from Maine to North Carolina, and west to Illinois. It's an electronic toll collection system that allows automatic toll payment from your prepaid account. E-ZPass customers travel thru toll plazas in specially designated lanes where the toll is paid electronically from a pre-paid account, most times without having to stop, and in many cases at near highway speeds. This allows the avoidance of congestion, while at the same time promoting safer travel and helping to reduce carbon footprint with much less stop-and-go driving.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.

Market research was conducted by reviewing the GSA library. There are no other vendors that are authorized to sell the E-ZPass with a Government Agency Agreement within the state of Virginia.

7. DETERMINATION BY YHE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE

The Contracting Officer will determine and ensure that the cost to the Government for this procurement action will be fair and reasonable.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED

VDOT is the only vendor that operates in Virginia, which is the only vendor that operates in Virginia, which is the stat DLA is located and acquiring services to be used in this state as well as other.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION

There are no other facts.

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THIS ACQUISITION

This statement is not applicable, Market research established that there were no other viable sources found.

11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY REQUIREMENTS CERTIFICATION- N/A

An internet search was conducted to determine if there were any vendors in the market place that could provide Electronic Toll Collection (ETC) services. Although there are 24 toll agencies that are interoperable within the 15 states, many of those vendors do not offer payment options that meet DLA accounting compliance.
