PERFORMANCE WORK STATEMENT

Administrative Investigations Training

For

DLA Human Resources Labor and Employee Relations Specialists

1. Introduction: The Defense Logistics Agency (DLA) is the nation’s combat logistics support agency, that manages the global supply chain. The DLA HR Operations provides Human Resources support for approximately 26,000 DLA employees and supervisors. HR Operations advises and assists in all aspects of Employee and Labor Relation (LER). Approximately 40 employees assist DLA leadership in their administrative duties in accordance with 5 USC Chapter 75, 5 CFR Part 752, DOD Policies, DLA Policies and applicable collective bargaining agreements.

2. Objective: To increase the effectiveness of the HR Operations LER program, and to support the professional growth of the DLA Human Resources Specialists (Labor and Employee Relations) this request procures a contract to provide formal training on conducting administrative inquiries and employment investigations. The requested training will provide the HR Specialists with the investigative skills to conduct investigations into misconduct allegations.

3. Scope: The scope of the contract is to obtain formal training on conducting an administrative investigation for up to 40 employees for DLA HQ, Fort Belvoir, VA, New Cumberland, PA, or Columbus, OH, as determined by DLA management.

This course shall be taught by personnel with experience in the field of federal Administrative Investigations and provide proof of experience prior to the training.

4. General Information:

4.1 Contract Type: Firm Fixed Price: See the specifics in Section B’s Contract Line-Item Numbers (“CLINs”) for the applicable Unit of Measure.

4.2 Period of Performance: One (1) base year plus one (1) option year.

Vendor shall provide initial training in August or September of 2024 unless otherwise scheduled by management.

4.3 Class Size: Each session shall accommodate a class size up to 40 participants per training session. The Awardee shall develop and establish a class roster and track attendance for each training session.

This class roster shall be provided to the COR at the end of the first day of instruction, the end of the first week of instruction, and within three business days of the end of the course.

4.4 Funding: Subject to availability of funds.

5. Requirements: The government requires vendor provides instruction on skills and knowledge-sets to utilize during the highly sensitive, multi-faceted processes of conducting a federal sector administrative investigation. These skills include the development of a uniform approach to complaint intake procedures through structured investigations and complaint resolutions. The vendor must provide instruction on improved investigation techniques which develop employees as effective investigators and advisors.

Specifically, the training must provide 16 to 24 hours of detailed instruction and experiential exercises on:

• Substantive Basis: Why investigate; discipline law and elements;

understanding charges of misconduct; collecting penalty evidence;

the law behind other types of administrative investigations; reprisal investigations.

• Conducting the Investigation: Evidentiary principles; witness rights;

union representation; purpose of investigation; preparing for the investigation; role of the investigator; planning the investigation;

beginning the interview; conducting the interview; handling difficult witnesses; assessing evidence; assessing credibility/lies; body language; gathering other evidence; technology and investigations;

high-profile case considerations.

• Writing and Presenting the Investigative Report: Organizing for the report; establishing the chronology; writing for your audience; report writing style; report writing conventions; report organization;

collecting and analyzing feedback; diagnosing gaps in investigation techniques; managing resistance; advising management with an authoritative voice; minimizing legal liability; testifying at hearings

6. Contractor Requirements: Contractors must have the ability to provide a comprehensive course for HR Specialists that will provide individual certification of completion. The certification of completion will validate successful fulfillment of the training plan. The contractor will be able to provide a prospect of the training course that provides the agency the ability to modify or augment course material. The contractor must offer both in-person and video conference formats (if required by COVID restrictions) and offer student training manuals. Further, the Contractor will accommodate up to 40 employees with the possibility of successive training for additional personnel meeting the same objectives.

Contractors must exhibit and submit proof of previous experience with performing similar services for other Federal, State, or Local Government agencies, or other similar requirements for other organizations.

• Any contractor submitting a quote for this requirement must have an active registration in the SAM system and must be able to invoice through the Wide Area Work Flow application.

• Any contractor submitting a quote must provide trainer(s) with 10 years or more experience in the field of federal Administrative Investigations and provide proof of experience prior to the training.

• The following are contract assumptions in short:

o The Contractor will supply all tools, supplies, and labor necessary to instruct students.

o Upon determination by DLA, the contractor will provide training in a classroom setting on site at a DLA designated location for up to 40 class participants.

• The Contractor will train at DLA HQ, Fort Belvoir, VA, New Cumberland, PA, or Columbus, OH, as determined by DLA management on the designated and agreed date. Due to adverse circumstances, DLA management may have to cancel (or reschedule) the training. Cancellation may occur up to 3 days prior to training without incurring a cancellation fee.

• Once on site, a designated DLA employee will escort the contractor(s) around the building as necessary to ensure Instructors are familiar with the classroom setting, bathroom locations, and breakrooms.

• The Contractor will provide all students with a reference package (workbook or associated URLs) that augments training material. All reference materials will be submitted for review 30 calendar days prior to training. Reference materials must be 508 compliant and DLA will verify 508 compliance before the training start date. Once approved, the Contractor will provide all reference materials and virtual connection access (if required due to COVID restrictions) to the students within 48 hours of the start of training.

• The Contractor will provide a certification of completion that will be forwarded and saved by the DLA Learning Management System (LMS) for each participant within 14 calendar days of course completion.

9. Other Administrative Information:

• In the interest of protecting Government systems from computer viruses, the Contractor shall not use public domain software nor shall Contractor personnel download software from public bulletin boards. Should the introduction of a computer virus or malicious destruction of computer software, stored information, or hardware result from the use of public domain software or from software taken from a public bulletin board, be introduced into the government network by the contractor or subcontractor personnel, the Contractor shall repair the damage at no expense to the Government and without impact on delivery schedules or daily operation.

10. Data Use, Disclosure of Information, and Handling of Sensitive Information (including Personally Identifiable Information—PII)

• The contractor will maintain, transmit, retain in strictest confidence, and prevent the unauthorized duplication, use, and disclosure of information.

The contractor will provide information only to employees, Contractors, and Subcontractors having a need to know such information in the performance of their duties for this project.

• Information made available to the contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer. Contractor personnel may be required to sign a non-disclosure statement.

• Proprietary information provided to the contractor for use in performance or administration of this effort, may not be used for any other purpose except with the written permission of the Contracting Officer. If the contractor is uncertain about the availability or proposed use of information provided for the performance or administration, then the contractor will consult with the Contracting Officer regarding use of that information for other purposes.

• The contractor agrees to assume responsibility for protecting the confidentiality of Government records which are not public information.

Each employee of the contractor to whom information may be made available or disclosed shall be notified in writing by the contractor that such information may be disclosed only for a purpose and to the extent authorized herein.

• Performance of this effort may require the contractor to access and use data and information proprietary to a Government Agency or Government Contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the Government and/or others.

• Contractor and contractor personnel shall not divulge, or release data or information developed or obtained in performance of this effort, until made public by the Government, except to authorize Government personnel or upon written approval of the Contracting Officer. The contractor will not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort. Nothing herein shall preclude the use of any data independently acquired by the contractor without such limitations or prohibit an agreement at no cost to the Government between the contractor and the data owner that provides for greater rights to the contractor.

• The Government shall have Unlimited Rights for the course curriculum design produced and delivered in the performance of the contract. This includes all rights to reading materials and any and all documentation created in support thereof. The Government reserves the right to own, use, and distribute all products developed for the course curriculum under the contract, including the ability to share content.

11. Common Access Card: The awardee shall not need access to Common Access Card (CAC) in order to perform. DLAM 1000.13 does not apply to this requirement.

12. Invoicing: All invoicing for the resulting contract shall be accomplished in the Wide Area Work Flow (WAWF) system. Vendors are encouraged to become familiar with this system if they have not yet used it. See 252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (DEC 2018) DFARS for further information. There will only be one invoice for this contract, which will occur after the vendor has completed all work and the work has been accepted by the customer.

13. Service Contract Reporting Requirements:

This requirement is subject to Service Contract Reporting Requirements. The Awardee shall follow the requirements established by FAR clause 52.204-14.
