2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.

Pursuant to Federal Acquisition Regulation (FAR) 6.302-1(c), this Justification and Approval authorizes and approves the use of other than full and open competition for the procurement of software maintenance and support services that are peculiar to one manufacturer – Electronics for Imaging, Inc. (EFI). The Government has a requirement to procure brand-name specific EFI Digital StoreFront (DSF) software maintenance and approximately 200 hours of support services. The required software maintenance agreement and support services are necessary to support DLA’s existing EFI DSF software that is currently deployed to support the DLA J62BH Enterprise Capabilities Document Services Online (DSO) application.

The Period of Performance (PoP) for this requirement will consist of one 12-month base year only, from December 21, 2019 to December 20, 2020. An award of a firm fixed-price contract is contemplated.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE).

DLA has a requirement to procure brand-name EFI DSF software maintenance and support services for previously purchased EFI DSF software currently in use by the Agency. As mentioned above, this procurement will support DLA’s DSO application.

mailto:theresa.hollis@dla.mil

DLA’s DSO application supports the DLA J67D Data Services Operations’ (DLA Data Services) role of being the single source of print broker services to the Armed Forces and Federal Agencies. The DSO application offers web-to-print services and provides a portal for order fulfillment, outsourcing interface, and billing for any and all print service offerings.

At the foundation of the DSO application is EFI’s commercial software product, Digital StoreFront. By obtaining the required maintenance agreement and support services for this DSF software, DLA will ensure its DSF software licenses remain in active status. Currently, DLA holds a DSF software maintenance agreement with support services that ensures the Government receives EFI software updates as they are released, that updates are installed properly, and that the configuration is optimal. Under this agreement, DLA is provided with expert technical support from a DSF Application Specialist/Analyst.

The total estimated contract value is $329,679.96. The estimated cost breakout by task is presented in the table below:

Base Period: 21 Dec 2019 to 20 Dec 2020

TASK Description QTY UNIT PRICE EXTENDED PRICE

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION.

The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304 (c)(1), as implemented by FAR 6.302-1(c). The acquisition of Digital StoreFront software maintenance and support services are brand-name products peculiar to one manufacturer – Electronics for Imaging, Inc.

5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF

THE AUTHORITY CITED.

In accordance with FAR 6.302-1, full and open competition need not be provided for this acquisition because brand-name Electronics for Imaging Digital StoreFront software maintenance and support services are essential to the Government’s requirement and no other type of software maintenance or support services will satisfy the Agency’s needs.

The brand-name software maintenance and support services required by the Government are only available from one responsible source – Electronics for Imaging, Inc. and authorized resellers/dealers of EFI products and services. Notably, a brand-name item, whether available on one or more contracts, is an item or service peculiar to one manufacturer and may be procured by the Government if essential to the Government’s requirements. As discussed in detail below, because the Electronics for Imaging Digital StoreFront brand-name specification is essential to the Government’s requirements, the Government is precluded from consideration of products or services provided by an alternative source.

DLA requires the renewal of EFI DSF software maintenance and support services to ensure the success of DLA Data Services’ mission and role of being the single source of print broker services to the Armed Forces and Federal Agencies. The brand-name software maintenance and support services are essential to ensuring DLA’s DSO application continues to operate as a web tool for order fulfillment, outsourcing interface, and billing for any and all print service offerings.

DSF software is EFI’s web-to-print software solution. For DLA’s DSO application, DSF is the software that provides all order submission and print queue management functionality. Without this DSF software maintenance, there would be no virtual order fulfillment capability available to support DLA Data Services. All the military departments – the Army, Air Force, Navy, and Marines – use the DSO application tool for print order submission. Without the DSF application tool, DLA Data Services would be unable to fulfill orders in over 200 locations, where brick and mortar print facilities are not present. Consequently, the software maintenance and support services comprising this requirement are vital to the Government’s requirement because these virtual print shops rely solely on the DSO application web-to-print tool to complete order fulfillment. Moreover, EFI’s authorized resellers/dealers are the only service professionals that are capable of providing, and in fact, authorized to provide, the services necessary to perform DSF software updates, configuration and customization changes, software troubleshooting, and software patching. Failure to obtain EFI DSF software maintenance and support services at this juncture would put DLA Data Services at significant risk for mission failure.

Electronics for Imaging, Inc. and its authorized dealers/resellers are the only providers of the required software maintenance and support services for DLA’s EFI DSF software; therefore, they are the only sources capable of meeting current requirements. No other company’s software maintenance and support services can meet, or be modified to meet, the Agency’s requirement.

6. DESCRIPTION OF THE EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WILL BE PUBLICIZED AS REQUIRED BY

SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES.

Based upon market research, it has been determined that only brand-name EFI DSF software maintenance and support services can fully meet the Government’s instant requirement. The market research conducted included a search of the GSA and NASA SEWP schedules, an informal internet search, and requests sent via email to open market providers to determine if any third-party products would be comparable to the Government’s existing EFI DSF software maintenance and support services. The results yielded from these market research efforts established that there are no other products that meet the Government’s needs.

This requirement will be competed among Electronics for Imaging, Inc. and its authorized resellers/dealers on FEDBIZOPPS, through Beta.SAM.gov.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable. Prices will be determined fair and reasonable prior to award using the price analysis techniques described under FAR 15.404-1. The Government will use various pricing techniques including, but not limited to: (1) comparison of proposed pricing to that of similar software products, and (2) comparison of proposed pricing to the Independent Government Cost Estimate. Pricing comparison information can also be found in the market research documentation. The Contracting Officer will evaluate and determine that the apparent awardee’s proposed price is fair and reasonable prior to award.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS

OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED.

The DSO Program Manager conducted market research and found that, other than Electronics for Imaging, Inc., there are at least three authorized resellers/dealers of EFI products and support services capable of satisfying the instant requirement. All three authorized resellers are classified as Other Than Small Businesses (OTSBs). Therefore, the Request for Quotation (RFQ) will be posted as a combined synopsis/solicitation under FEDBIZOPS through Beta.SAM.gov. Adequate competition is expected which will assist in the determination of fair and reasonable pricing.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

All supported facts are provided herein.

10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST

IN THE ACQUISITION

The Government has made inquiries using past sources and references provided by the manufacturer of brand-name EFI DSF products, Electronics for Imaging, Inc. In response to these inquires, four sources responded expressing an interest in making offers on the EFI DSF software maintenance and support services requirement. Below is a list of the four vendors.

Electronics for Imaging, Inc.

Xerox, Inc.

Canon, Inc.

The Ricoh Company, Ltd.

11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

EFI DSF software is so embedded within DLA’s DSO application that eliminating this brand-name requirement to remove a barrier to competition would require an overhaul of the EFI DSF software currently in use at DLA. In accordance with DLA policy and DLA’s IT Solutions document, whenever substantial improvement over presently identified solutions is demonstrated, the existing IT Solutions document will be updated to ensure DLA continues to use the best products and services for its mission requirements. At this time, EFI DSF software maintenance and support services are the best products and services to meet DLA mission requirements and are the only products and services that will satisfy the Government’s needs. DLA has exercised, and continues to exercise, competition as often as possible and is required to conduct ongoing reviews

Digitally signed by of IT solutions in order to keep abreast of new technology within the Government and private sectors. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.

The business case analysis supporting the need and acquisition of a commercial product to support the DSO application was based on a 10-year life cycle to start at applications Full Operating Capability (FOC). The FOC date for the DSO application was June 2011, making the end of the 10-year lifecycle June 2021. A market analysis and business case will be commencing Q1 FY20 to determine the feasibility of a replacement of the present EFI DSF software in order to meet the June 2021 objective. The DSO Program Manager will develop an RFI and follow-on acquisition strategy over the course of this contract to incorporate the functional sponsor’s new mission and the J62 technology application roadmap. The future acquisition will focus on replacing the commercial software, requiring the solution to be offered as Software as a Service (SaaS) and support the DLA Data Services’ “broker of print services” mission.

12. CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS

ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING

OFFICER’S KNOWLEDGE AND BELIEF.

Technical or Requirements Certification:

I hereby certify that the supporting data provided for which I’m responsible and which form a basis for this justification is complete and accurate.

Contracting Officer’s Certification and Approval:

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. I approve this justification.
