The Government intends to use the “Federal Opportunities” area on the SAM.gov website to obtain the required Gurobi Optimizer SW Maintenance for J62BG. Consequently, this RFQ is issued in accordance with the regulatory authority of the Federal Acquisition Regulation (FAR) Part 12, FAR Part 13, in addition to FAR Part 15.
Contract Type:
The Government intends to award a single firm-fixed price order.
Award without Discussion:
The Government intends to evaluate offers and award a task order without discussions with offerors.
Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.
No Award:
The Government reserves the right not to make an award as a result of this RFQ if such award is determined contrary to the best interest of the Government.
Award to One Vendor:
To maintain continuity and compliance within the DLA Information Operations, the Government intends to award to one vendor.
Award Decision:
Award shall be made to a responsible business offeror whose proposal is lowest priced and technically acceptable based on the total price of all line items identified in the Bill of Materials (BoM) attached to this solicitation. For this acquisition, offers that take no exception to the terms and conditions of the solicitation, including the requiring items, will be considered technically acceptable.
Submission of Questions:
Should the vendors have any questions with respect to this RFQ, they should submit them, via email, to the Contract Specialist and Contracting Officer referenced above.
Any technical questions, requests for clarification or requests for data in connection with this RFQ must be submitted in writing on or before November 18, at 12:00 PM (Noon, Eastern Time) to allow DLA adequate time to provide correct answers to the questions submitted and to prevent any delays in the closing date of the RFQ.
Vendors are strongly urged to follow-up the submission of any questions with a phone call to the Contract Specialist to ensure that questions have been received.

This RFQ will be posted to the “Federal Opportunities” area on the SAM.gov website. Vendors should submit their quotations electronically via the “Federal Opportunities” web page. If there is a failure in the SAM.gov website and vendors are unable to post their quotes electronically, with the approval of the Contracting Officer, quotes may also be submitted to the email address listed below:

FAR Part 3.1002(a) requires all government contractors to conduct themselves with the highest degree of integrity and honesty. Contractors should have a written code of business ethics and conduct within thirty days of award. To promote compliance with such code of business ethics and conduct, contractors should have an employee business ethics and compliance training program that facilitates timely discovery and disclosure of improper conduct in connection with government contracts and ensures corrective measures are promptly instituted and carried out. A contractor may be suspended and/or debarred for knowing failure by a principal to timely disclose to the government, in connection with the award, performance, or closeout of a government contract performed by the contractor or a subcontract awarded there under, credible evidence of a violation of federal criminal law involving fraud, conflict of interest, bribery, or gratuity violations found in title 18 of the United States Code or a violation of the False Claims Act. (31 U.S.C.3729-3733)
If this solicitation or contract includes FAR clause 52.203-13 - CONTRACTOR CODE OF BUSINESS ETHICS AND CONDUCT; the contractor shall comply with the terms of the clause and have a written code of business ethics and conduct; exercise due diligence to prevent and detect criminal conduct; promote ethical conduct and a commitment to compliance with the law within their organization; and timely report any violations of federal criminal law involving fraud, conflict of interest, bribery or gratuity violations found in title 18 of the United States Code or any violations of the False Claims Act. (d) Comptroller General Examination of Record. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8 G of the Inspector General Act of 1978 ( 5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial products or commercial services, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
