About this file
This document is a Justification for Other Than Full and Open Competition (OTFAO) for the Defense Logistics Agency (DLA). The procurement is for Gurobi Optimization LLC's mathematical programming software licenses and maintenance for a 12-month base period with two 12-month option periods, spanning from December 12, 2025 to December 11, 2028. The contract is specifically for Carroll Nelson & Associates to assist DLA Information Operations in maintaining their Bid Evaluation Model (BEM) and Offer Entry Tool (OET) automated information systems.
The justification emphasizes Gurobi's unique qualifications, citing it as the fastest mathematical programming solver on the market with advanced algorithms and an easy-to-use Java API. The document argues that Gurobi is essential to DLA's requirements and no other product can meet their needs. Limited market research was conducted using NASA SEWP, with three estimates obtained. The total contract is for software maintenance and periodic upgrades, with potential sources of interest including Gurobi Optimization LLC, OCG Telecom, and METGreen. The contract is being pursued under Title 10, U.S.C. 2304 (c) (1), which allows for non-competitive procurement when only one responsible source exists.

Carroll Nelson & Associates requires the use of Gurobi Software in order to assist the Defense Logistics Agency (DLA), Information Operations (J62), in providing application maintenance and technical support to the Defense Logistics Agency Energy for their automated information systems Bid Evaluation Model (BEM). The estimated price for the base year is . An average of is what this requirement would cost over three years.
4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304 (c) (1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source as referenced by the name brand citation, “Gurobi”. Gurobi is the fastest mathematical programming solver on the market, as has been consistently demonstrated through benchmarks against competing solvers.
The algorithms used by Gurobi are more advanced than the competition. Gurobi also provides a Java API that is easy to learn and use. Gurobi reduces the time required to solve BEM models.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE OF THE ACQUISITION REQUIRES
USE OF CITED AUTHORITY
This acquisition is restricted to one brand name or product, Gurobi Optimizer licenses and maintenance support. Gurobi support is essential to the Government’s requirements, and other companies’ products do not meet and cannot be modified to meet the Government’s needs. A brand name item, whether available on one or more contracts, is an item particular to one manufacturer and may be procured by brand name specification if essential to the Government’s requirements. The Brand Name Description, Gurobi Optimizer licenses and maintenance support for this acquisition effort is essential for DLA Information Operations (J6). No other item can meet the Government’s needs.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE:
N/A
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The use of Gurobi Mathematical Programming System software is essential to the Government’s requirement. EPST is a critical application used to manage and program in the Bid Evaluation Model (BEM) and Offer Entry Tool (OET), which are used by DLA Energy and maintained by J62BG. The Defense Logistics Agency is the Department of Defense’s (DoD) largest combat support agency, providing worldwide logistics support in both peacetime and wartime to the military services as well as to several civilian agencies and foreign countries. In order to help to accomplish its mission, DLA has a need to provide and maintain automated data processing capabilities.
Although a lapse of maintenance does not prohibit use of the software, without a support agreement, DLA Energy does not have access to software patches, updates and upgrades as well as 24-hour a day, seven days a week software support. A software failure or issue would pose an unacceptable risk to the analysis of bulk fuel bids.

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS:
This requirement is limited to resellers of Gurobi Optimization LLC because Gurobi owns the intellectual property rights to the Gurobi software for which DLA Energy has restricted user rights and requires continued software maintenance and periodic software upgrades. Because Gurobi Optimization LLC is not the sole provider for software upgrades and maintenance for Gurobi software, limited market research was conducted using NASA SEWP and three (3) estimates were obtained.
9. ANY OTHER SUPPORTING FACTS SUPPORTING THE USE OF OTHER THAN
FULL AND OPEN COMPETITION:
The Government will attempt to obtain offers from as many vendors as practicable. Proposals will be analyzed in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not necessarily limited to: 1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404-1(b)(2)(i); 2) comparison with competitive published price lists (reference FAR 15.404-1(a)(2)(iv); and 3) comparison of proposed prices with prices obtained through market research for the same or similar items (reference FAR 15.404-1(b)(2)(vi)) in order to obtain a fair and reasonable price.
10. A LISTING OF THE SOURCES, IF ANY, WHICH HAVE EXPRESSED INTEREST
IN WRITING, CONCERNING THIS ACQUISITION:
Gurobi Optimization LLC OCG Telecom METGreen
11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE
OR OVERCOME BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
ACQUISITION FOR SUPPLIES OR SERVICES:
DLA has and continues to exercise competition because Gurobi Optimization LLC is not the sole provider for software upgrades and maintenance for Gurobi software, limited market research was conducted using NASA SEWP and three (3) estimates were obtained.
