RFP NO. SP4530-13-R-0001, Removal, Transportation and Disposal of Industrial Waste for DLA Disposition Services Korea

Question 1: In terms of permits, Intermediate Treatment Business Permits, Incineration Permits as mandated by Korean Environmental Laws, Recycling Permits and Transportation Permits, if the sub consultants have the required permits and licenses, can they satisfy this requirement or is this requirement only for the prime?

Response to Question 1:

Although it is preferred the offeror be the firm performing the recycling/disposal the government understands not all firms are designed to perform all the tasks requested in this solicitation/contract and will either form Joint Ventures or will sub-contract elements of the contract. The recycling/disposal permit requirements pertains to those liable under Korean law for the actual recycling/disposal.

In accordance with the Addendum to FAR 52.212-2 Evaluation – Commercial Items, Evaluation Factors – Full and Open Competition, paragraph a, “The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Paragraph ii states “Technical demonstration that the permits meet the Government requirements”. Technical includes the Intermediate Treatment Business Permits, Incineration Permits as mandated by Korean Environmental Laws, Recycling Permits and Transportation Permits. The requirement is not limited to the prime contractor.

Question 2: How much volume amount will be at each waste disposal treatment pick up per task order?

Response to Question 2: The projected waste and quantities presented in Attachment 3 are based on past history. The generation rate at the sites is not regular so the actual task order volumes will not be known until the time of request/pickup

Question 3: Is there any minimum guaranteed amount per trip to pick up the waste from Gimcheon?

Response to Question 3: The contract is administered from the Disposition Services office in Gimcheon.

Gimcheon is not a pickup location.

Question 4: Solicitation page 4, paragraph 2.1 General: The Contractor shall pick-up industrial waste from Gimcheon. Please confirm the “all waste will be generated and picked up at Gimcheon and transported to three locations, Camp Castle, Camp Market, Camp Humphreys to scale the weight and to dispose in accordance with ROK environmental laws and regulations. Because it is unusual if the waste is pick up at Gimcheon, it is disposed at local Gimcheon area.

Response to Question 4: Camp Castle, Camp Market and Camp Humphreys are Furnishing Branches of the Housing Division. There is no pick up site at Gimcheon.

Paragraph 2.1 is revised to state:

“The Contractor shall pick-up industrial wastes for DLA Disposition Services Gimcheon at Furnishing Branch of Housing Division in Camp Castle (Dongduchon), Furnishing Branch of Housing Division in Camp Market (Yongsan), and Furnishing Branch of Housing Division in Camp Humphreys (Pyontaek) and dispose of those industrial wastes in accordance with all Republic of Korea Environmental Office Laws and Regulations.”

Question 5: In this solicitation, the Contractor shall have capability of removing at least one hundred

(100) tons per day. We are permitted to dispose of 84 tons per day as indicated in the Intermediate Treatment Business Permits, but we are able to dispose of additional 30% of the permitted capacity, which is allowed by the ROK Enforcement Rule of the Waste Control Act Article 29 Clause 1-2-MA. Therefore, we are able to dispose of the waste up to 109 tons per day by the above ROK regulation. Are we qualified for this solicitation and is our qualification technically acceptable to this solicitation?

Response to Question 5: The 100 ton stipulation in the solicitation is a projected average based on past history, the quantity may be more. We will determine your firm’s overall eligibility after we review your formal proposal.

Question 6: We should submit recycling permits for a technical proposal. A) However, recycling items, work and procedure are not set forth in the solicitation. B) We would like to know that what kind of waste has to be recycled and how many recycling portions are taken. In the attachment 2, estimated quantities are 4,000 tons. C) When we insert prices in the schedule of price, what kind of prices should be inserted, incineration or recycling? D) And we don’t have recycling permits, but we plan to subcontract for the recycling work. Is subcontracting acceptable to this solicitation?

Response to Question 6:

A) The structure of this solicitation/contract is not specific in how to perform the recycling, work or other procedures so that offerors are not constrained by any stated method. It is meant to enable offerors to propose methods that are in the best interest of Korea and the United States.

B) The waste types listed in paragraph 1.0, General Requirements, they and the quantity presented a projection based on past history. Actual pickup quantities will vary from pickup to pickup, date to date depending on the generation rate of the location.

C) The prices offerors enter into the schedule of prices should be based on the offerors’ proposed recycling or disposal method(s). If there is not an economical method of recycling an item on the schedule the offerors should indicate their proposed method of disposal (i.e., landfill, incineration, fixation, etc.) and the associated fee for that item. If there is one or more method of recycling an item the offeror should indicate the method they wish to employ and its associated cost.

D) Although it is preferred the offeror be the firm performing the recycling/disposal the government understands not all firms are designed to perform all the tasks requested in this solicitation/contract and will either form Joint Ventures or will sub-contract elements of the contract.

Question 7: Reference PWS 2.1 General: The Contractor shall pick-up industrial wastes from DLA Disposition Services Gimcheon at Furnishing Branch of Housing Division in Camp Catle (Dongduchon), Furnishing Branch of Housing Division in Camp Market (Yongsan), and Furnishing Branch of Housing Division in Camp Humphreys (Pyongtaek) and dispose of those industrial wastes in accordance with all Republic of Korea Environmental Office Laws and Regulations.

According to the work statement, the contractor shall pick-up Industrial waste from DLA Disposition Services Gimcheon at ~. It means don’t we need to pick up Industrial wastes from DLA Disposition Services Gimcheon?

The only three places (the Camp Market, Camp Humphreys and Camp Castle) where we have to pick-up industrial wastes?

Response to Question 7:

In Paragraph 2.1 “Contractor shall pick up industrial waste from DLA Disposition Services Gimcheon” is meant to indicate DLA Disposition Services Gimcheon is the requesting authority for this contract. DLA Disposition Services Gimcheon is not a pickup location.

Paragraph 2.1 has been revised to read: “Contractor shall pick-up industrial wastes for DLA Disposition Services Gimcheon at Furnishing Branch of Housing Division in Camp Castle (Dongduchon), Furnishing Branch of Housing Division in Camp Market (Yongsan), and Furnishing Branch of Housing Division in Camp Humphreys (Pyontaek) and dispose of those industrial wastes in accordance with all Republic of Korea Environmental Office Laws and Regulations.”

Question 8: Reference 2.2 – Scale: The Contractor shall pick up industrial wastes weighed by Camp Market (Yongsan) office and dispose of those wastes. For other areas, the Contractor shall collect the given wastes and transfer those wastes to the nearest weight-station. What is the difference between Pick up industrial wastes weighed and collect the given wastes. Do we need to collect the wastes from different location on base at Camp Market, and the other areas (Camp Castle, Camp Humphreys)? We should collect waste from several location on each base?

Response to Question 8: “Pick up industrial waste weighed” refers to waste at locations where the generator has weighed the material prior to requesting the task order. Pick up industrial waste has been removed from paragraph 2.3. “Collect the given wastes and transfer those wastes to the nearest weight-station” refers to locations where the generator does not have scales or other weighing capability. To determine the weight of these waste they need to be transported to the nearest weighing location. The primary pick up locations are at the Furnishing Branch of Housing Division in Camp Castle (Dongduchon), Furnishing Branch of Housing Division in Camp Market (Yongsan), and Furnishing Branch of Housing Division in Camp Humphreys (Pyontaek).

Depending on activities within the commands additional locations may requested in the future.

Paragraph 2.3 Scale, the first sentence is removed and the 2nd sentence and following sentences are revised as follows:

“The contractor shall collect the given wastes and transfer those waste to the nearest weight-station that has been Registration of Weighing Proof approved and shall obtain weigh-tickets issued by that weigh-station.

The weigh-tickets generated by the commercial weigh-station’s scale shall be presented to the Camp Market (Yonsan) office through facsimile/FAX (032-520-6593) or scanned and electronically e-mailed no later than one

(1) calendar day after weighing is accomplished.”

The following paragraphs have been revised or added:

Replace DLAD 52.215-9023 Reverse Auction (Jul 2012) with DLAD 52.215-9023 Reverse Auction (Nov 2012) which is provided in full text as follows:

REVERSE AUCTION (NOV 2012)

The Contracting Officer may utilize on-line reverse auctioning as a means of conducting price discussions under this solicitation. If the Contracting Officer does not conduct a reverse auction, award may be made on the basis of initial offers or following discussions not using reverse auctioning as a pricing technique. If the Contracting Officer decides to use on-line reverse auctioning to conduct price negotiations, the Contracting Officer will notify offerors of this decision and the following provisions will apply.

(a) The award decision will be made in accordance with the evaluation factors as set forth in the solicitation. The reverse on-line auction will be used as a pricing technique during discussions to establish the final offered prices from each offeror. These prices will be used in conjunction with the evaluation factors stated elsewhere in the solicitation in order to make the award decision in accordance with the basis for award stated in the solicitation.

(b) Following the decision to conduct discussions using on-line reverse auctioning as a pricing technique, the Contracting Officer or his/her representative will provide offerors determined to be in the competitive range with information concerning the on-line auction process. The Government intends to use a commercial web-based product to conduct the reverse auction.

(c) Prior to or simultaneously with conducting the on-line reverse auction, the Contracting Officer may hold discussions with the offerors concerning matters appropriate for discussion, such as issues involving technical proposals or unbalanced pricing.

(d) The lowest offeror’s price(s) for each round of the reverse auction will be disclosed to other offerors and anyone else having authorized access to the on-line auction. This disclosure is anonymous, meaning that each offeror’s identity will be concealed from other offerors (although it will be known to the Government;

only a generic identifier will be used for each offeror’s proposed pricing, such as “Offeror A” or “lowest-priced offeror”). By submitting a proposal in response to the solicitation, offerors agree to participate in the reverse auction and that their prices may be disclosed, including to other offerors, during the reverse auction.

(e) The reverse auction system currently in use designates offers as "Lead," meaning the current low price in that auction, or "Not Lead," meaning not the current low price in that auction. In the event of a tie offer, the reverse auction provider's system designates the first offer of that price as "Lead" and the second or subsequent offer of that price as "Not Lead." Offerors shall not submit a tie offer, since this is inconsistent with the purpose of the reverse auction. If a tie offer is submitted, the "Not Lead" offeror that submitted the tie offer must offer a changed price; it will be ineligible for award if the final price in the auction is the tie offer price.

(f) An offeror's final auction price at the close of the reverse auction will be considered its final proposal revision. No price revisions will be accepted after the close of the reverse auction, unless the Contracting Officer decides that further discussions are needed and final proposal revisions are again requested in accordance with Federal Acquisition Regulation (FAR) 15.307, or the Contracting Officer determines that it would be in the best interest of the Government to re-open the auction.

(g) The following information is provided regarding the procedures to be followed if a reverse auction is conducted.

(1) Each offeror identified by the Contracting Officer as a participant in the reverse auction will be contacted by Defense Logistic Agency’s commercial reverse auction service provider to advise the offeror of the event and to provide an explanation of the process.

(2) In order for an Offeror to participate in the reverse auction, such offeror must agree with terms and conditions of the entire solicitation, including this provision, and agree to the commercial reverse auction service provider’s terms and conditions for using its service. Information concerning the reverse auction process and the commercial service provider’s terms and conditions is embedded within the email notification sent by the on-line reverse auction pricing tool system administrator.

(3) Offerors shall secure the passwords and other confidential materials provided by the commercial reverse auction service provider or the Government and ensure they are used only for purposes of participation in the reverse auction. Offerors shall keep their own and other offerors’ pricing in confidence until after contract award.

(4) Any offeror unable to enter pricing through the commercial reverse auction service provider’s system during a reverse auction must notify the Contracting Officer or designated representative immediately. The Contracting Officer may, at his/her sole discretion, extend or re-open the reverse auction if the reason for the offeror’s inability to enter pricing is determined to be without fault on the part of the offeror and outside the offeror’s control.

(5) The reverse auction will be conducted using the commercial reverse auction service provider’s website as embedded in the email notification. Offerors shall be responsible for providing their own computer and internet connection.

(6) Training:

(i) The commercial reverse auction service provider and/or a Government representative will provide familiarization training to offerors’ employees; this training may be provided through written material, the commercial reverse auction service provider’s website, and/or other means.

(ii) An employee of an offeror who successfully completes the training shall be designated as a 'trained offeror.' Only trained offerors may participate in a reverse auction. The Contracting Officer reserves the right to request that offerors provide an alternate offeror employee to become a 'trained offeror.' The Contracting Officer also reserves the right to take away the 'trained offeror' designation from any trained offeror who fails to abide by the solicitation’s or commercial reverse auction service provider’s terms and conditions.

(End of Provision)

The proposal date and time of 30 November 2012 at 4:00 p.m. (Hawaii Standard Time) remains unchanged.
