Offerors are required to submit the following documents with their offer:
1. Disposal Narrative: A narrative describing the offeror’s intended method of transportation, recycling and/or disposal for tires and other scrap rubber. The narrative must at minimum include demonstrating the offeror’s processes and compliance with applicable regulations.
2. Permits: Copies of all related Federal, State and/or local transportation, recycling and/or disposal facility permits. If the Offeror does not currently possess a specific required permit(s), the offeror must provide documentation to confirm an application for the missing transportation, recycling and/or disposal facility permit(s) has been initiated with expected approval date. If the offeror intends to export the tires and other scrap rubber to other nations, proof of Basel Authorization is required to be submitted with the offeror’s proposal, or proof that said authorization has been initiated with expected approval date.
(End of Provision)
FAR 52.212-02 EVALUATION - COMMERCIAL ITEMS (JAN 1999)
(a) Lowest Price Technically Acceptable: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and has the lowest total contract price that is determined to be Technically Acceptable. Technical acceptability will consist of the following:
(1) Disposal Narrative: A narrative describing the offeror’s intended method of transportation, recycling and/or disposal for tires and other scrap rubber will be reviewed by the Government to determine technical acceptability. An acceptable narrative will include technology currently applied in the commercial sector and approved by local and national regulations.
(2) Permits: Offerors or their subcontractors/partners are required to possess all applicable Federal, State and/or local transportation, recycling and/or disposal facility permits prior to award. An offeror will be considered ineligible for award if the missing permit(s) is not approved by the date of award. Proof of Basel Authorization will be reviewed, if applicable, in this same manner.
A proposal that is determined to be not acceptable in any one of the three areas listed above shall be considered an unacceptable proposal and shall no longer be considered for contract award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of Provision)
