PERFORMANCE WORK STATEMENT

1. INTRODUCTION:

a. The Defense Logistics Agency (DLA) Disposition Services (DS) is a Major Subordinate Command (MSC) of the DLA with the primary responsibility of disposing of and reutilizing Department of Defense (DoD) excess and surplus property generated by the military services. This is accomplished through reutilization to other DoD activities, transfer to other Federal agencies, donation to authorized state and local organizations, sale to the general public, or ultimate disposal through abandonment or destruction. The headquarters for DLA DS is located in Battle Creek, Michigan. DLA DS Anchorage, located at Joint Base Elmendorf-Richardson (JBER), requires snow removal services during the period of October through May and all option periods as specified in this Performance Work Statement (PWS).

b. Contractor personnel and subcontractors shall comply with applicable federal, local and host installation laws, safety regulations and procedures. Personal Protective Equipment (PPE) shall be provided by the Contractor and must be appropriate for the task. Contractor/subcontractors personnel and equipment are subject to safety inspections by government personnel.

c. The term Contractor applies to all subcontractor personnel/equipment/supplies that may be hired/provided by the Contractor.

d. Complete snow removal services at DLA DS Anchorage, 12745 Davis Highway, JBER, AK 99506.

e. DLA DS Anchorage Lot is about 175m X 230m open storage lot. (Blue area in Appendix 1 Photo)

f. Dump Lot 906A is about 90m X 170m. (Yellow area in Appendix 1 Photo)

2. PERIOD OF PERFORMANCE:

This is a Firm-Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) time and materials contract which consists of one (1) 12-month base period and two (2) 12-month options. The total contract length shall not exceed three (3) years. The unit prices from the pricing schedule are fixed, but the contractor will only be paid for actual snow events that occur. The quantities from the pricing schedule are estimates only and form an estimated amount for each year.

3. TASKS TO BE PERFORMED:

All snow removal services shall be completed during DLA DS Anchorage hours of operations. (see section 4)

The Contractor shall:

a. Visit the areas specified within the PWS and designated in the attached snow maps with the Contracting Officer Representative (COR) with-in 10 days of contract award and in September before snow season each year thereafter to validate current conditions and areas to be covered by the Contractor.

b. Maintain frequent contact with the COR during snowplowing, salting, and/or ice removal operations and shall be available by telephone during performance.

c. Remove all snow and ice from DLA DS Anchorage lot identified in section 1.d. anytime snow accumulation exceeds 3 inches.

d. Remove all snow and ice from employee parking lot and sidewalks leading to building entrances. Sidewalk areas shall have adequate deicing material for the conditions so ice cannot form and pedestrians have foot traction.

e. Transport all snow and ice piles from DLA DS Anchorage lot to the dump lot identified in section 1.e. within 48 hours of each snow plowing event.

f. Supplement with hand operations in locations that are inaccessible to the Contractor’s equipment.

g. All snow and ice shall be removed to bare pavement and shall not leave any windrow.

h. Ensure paved areas are safe for both vehicular and pedestrian traffic.

i. Ensure all parking curbs are visible and all catch basins, storm drains or sewer systems that trap debris from entering drainage pipes are exposed.

j. Repair or replace damaged government facilities, government owned property and equipment caused by Contractor personnel.

4. HOURS OF OPERATION AND HOLIDAYS

a. Hours of operations for DLA DS Anchorage is 0700-1530 Monday through Friday.

b. The Contractor is not required to provide services on the 11 federal holidays observed by the DLA unless approved by the Contracting Officer (KO) or DLA DS Authorized POC. The following holidays are observed:

b. When one of the holidays falls on a Sunday, the following Monday will be observed as the legal holiday. When the legal holiday falls on a Saturday, the preceding Friday is observed as the legal holiday.

5. BASE ACCESS AND SECURITY:

a. The Contractor shall coordinate base installation access for all their employees. The Contractor shall be familiar with and comply with all Base Command policies regarding security considerations for all Contractor employees.

b. Unscheduled gate closures by the installation security personnel may occur at any time causing all personnel entering or exiting a closed installation to experience a delay; this cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by Contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the Contractor employee’s installation driving privileges.

c. Contractor employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety, and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All Contractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The Contractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The United States Government (USG) reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of Contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.

d. The Contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The Contractor and all associated employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation security personnel. The Contractor shall ensure compliance with all personal identity verification requirements as directed by DoD and/or local policy. Should the Force Protection Condition (FPCON) change, the USG may require changes in Contractor security matters or processes.

6. U.S. GOVERNMENT FURNISHED PROPERTY, MATERIAL, EQUIPMENT, AND SERVICES (GFP/M/E/S):

a. Property: The USG will furnish the necessary workspace for the Contractor to perform services as outlined in this PWS.

b. Material: The USG will not provide any materials.

c. Equipment: The USG will not provide any equipment.

d. Services: The USG will provide utilities, if available at the lots identified in sections 1.d and 1.e, such as electricity and water to the Contractor for use in the performance of this contract. The Contract shall instruct employees in utilities conservation practices. The Contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

7. CONTRACTOR FURNISHED PROPERTY, MATERIAL, EQUIPMENT, AND SERVICES (CFP/M/E/S):

a. Property: The Contractor shall not provide any property.

b. Material: The Contractor shall provide all equipment and materials to remove snow and ice from all designated areas for use during the performance of this contract.

c. Equipment: The Contractor shall provide all personal protective equipment, tools, and any other equipment required to perform under the provisions of this contract.

d. Services: The Contractor shall provide all supervision, quality control, trained and certified employees, and a primary and alternate point of contact (POC) with phone number.

8. SNOW REMOVAL EQUIPMENT:

a. The use of snow removal equipment at DLA DS Anchorage location shall comply with all Federal, state, local, and DoD requirements. Contractor shall be required to use their own personnel to operate the MHE. The Contractor is required to provide documentation to the COR that personnel are trained in accordance with 29 CFR 1910.178 to operate the equipment and shall ensure that all personnel possess the required licenses to operate the equipment. The Contractor shall ensure all work is performed in full compliance with all Federal, state, local, and DoD occupational safety and health regulations. All incidents, including near miss incidents, involving operation of snow removal equipment shall be reported in accordance with DLA and location regulations. DLA DS Anchorage staff will provide awareness training for specific, known hazards in and around the worksite areas of operations.

b. The Contractor is required to provide snow removal equipment necessary to meet requirements under this contract. Contractor shall not allow DLA personnel to use Contractor owned equipment, and DLA employees shall not allow the Contractor’s employees to utilize DLA equipment. All equipment used for contract performance at DLA DS Anchorage location is subject to the approval of the DLA and host installation.

c. DLA DS Anchorage will provide an outside uncovered staging area inside DLA DS Anchorage fence line for the staging of the Contractor’s snow removal equipment. Staging area shall be large enough to accommodate three (3) pieces of snow removal equipment.

d. The Contractor may store up to three (3) pieces of snow removal equipment at DLA DS Anchorage location during the yearly snow removal season of October 1 thru May 31. Equipment may be staged 30 days prior to the snow removal season and shall be removed within 30 days after the snow removal season or last snow removal for the year. Staging area will be outside and uncovered. Equipment will be exposed to the weather elements.

e. The USG will have no liability to the Contractor and the Contractor will hold DLA harmless and indemnify DLA for any claim, loss, or damage caused or alleged to be caused directly, indirectly, incidentally or consequentially by the Contractors equipment to real or personal property, bodily injury or death, by any inadequacy thereof or deficiency or defect therein, by any incident whatsoever in connection therewith, arising in strict liability, negligence or otherwise, or in any way related to or arising out of the Contractors use of their own equipment under this contract.

f. If the Contractor decides to stage Contractor owned equipment under this contract at DLA DS Anchorage field site, then the Contractor will not be able to access the staged equipment outside of DLA DS Anchorage normal working business hours (section 4a). By Contractor deciding to stage Contractor owned equipment under this contract at DLA DS Anchorage field site, the Contractor does so at its own risk and without any liability to the USG for any loss, damage, destruction, or theft (LDDT) to Contractor owned property and equipment staged at DLA DS Anchorage field site. Contractors’ failure to remove Contractor owned property and equipment within 14 calendar days of email notification from DLA DS Anchorage field site shall be deemed abandoned by the Contractor and allow DLA to dispose of said abandoned property in accordance with applicable laws and regulations. The date and time stamp in the Government’s email to the Contractor for notifying the Contractor to remove property and equipment of the Contractor will be the sole documentation utilized to determine adherence with notification requirements within this contract. Abandonment shall allow DLA to remove all property and equipment of the Contractor for disposal. Contractor hereby waives and releases any claims or actions against DLA for disposal of personal property resulting from the Contractors abandonment.

9. ACCEPTABLE PERFORMANCE LEVELS (APLs):

a. APLs are the minimum performance levels of specific requirements which the Contractor achieve or risk having the USG consider performance unsatisfactory, which may result in monetary or other consideration from the Contractor.

b. If performance falls below the specified performance level, consideration may be taken at the USG’s discretion. Decisions will consider the impact on the USG because of the failure to meet the performance requirement and the number of times the failure has occurred throughout the contract period.

c. Performance incentives for the Contractor will include, but are not necessarily limited to, favorable impact on option exercise decisions, future awards of the same requirement, and future awards of similar requirements by DLA DS as well as other government and non-government entities that may review performance of this contract.

10. SPILL RESPONSIBILITY:

a. The Contractor is solely responsible for all spills or leaks during the performance of this contract, which occurs because of, or is contributed to by the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks to the satisfaction of the USG in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the USG. The Contractor shall report all such spills or leaks, regardless of their quantity, to the COR and KO immediately upon discovery. A written follow-up report shall be submitted to the COR and KO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

1. Description of item spilled (including identity, quantity).

2. Whether amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

3. Containment procedures initiated.

4. Summary of any communications Contractor has with press or USG officials other than the KO.

5. Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

6. Description of item spilled (including identity, quantity).

11. DLA DS ENVIRONMENTAL MANAGEMENT SYSTEM (EMS):

DLA DS implemented an Environmental Management System (EMS) in accordance with ISO 14001:2015(E), DOD, and DLA requirements at all appropriate DLA DS facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLA DS EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA DS mission. The DLA DS EMS program is explained in the agency EMS Core Instruction. Site supplements may detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the appropriate DLA DS tenant facility and the DOD/DLA host facility EMS program. Contractors and their personnel are required to be aware that each appropriate DLA DS facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLA DS facility maintains EMS awareness posters that identify the DLA DS Environmental Management Representative (EMR) and host facility EMR for specific guidance concerning an individual facility’s EMS program. Contractors may request current copies of EMS information identified in this Section by contacting the local COR.

13. INVOICING:

a. The Contractor will invoice on a monthly basis through the Department of Defense Wide Area Workflow (WAWF) system. Invoices must be submitted through WAWF in accordance with Defense Federal Acquisition Regulations Supplement (DFARS) 252.232-7003. Refer to https://wawf.eb.mil for additional information.

b. The COR will verify contractor hours reported in WAWF compared to recorded hours during performance prior to approving the invoice.

14. CONTRACT MINIMUM/MAXIMUM:

This is a Firm-Fixed Price (FFP) Indefinite Delivery Indefinite Quantity (IDIQ) time and materials contract. The contract minimum shall be $1500.00. The maximum shall be 150% of the estimated value of the contract. There is no contract minimum for any option period included in the contract.
