Responses to Contractor Questions Pertaining to DLA Regional HW Incineration Contracts v.11/28/2022
1. The following ‘C7” suffixed CLINs FL01C7, FL04C7, FL99C7, RX01C7, RX98C7, TX98C7, TX99C7, have the U/M as per “LB”. This offeror is requesting that these line item be priced by the container size, i.e., CLIN suffixes C1, C2, C3, C4, C5, C6 similar to the other hazardous CLINs.
DLA Response: While DLA appreciates the convenience in formulating competitive pricing for container sizes (CLIN Suffixes C1-C6) over container weights in pounds (C7), waste streams covered under the referenced CLINs remain as C7 under most of our contracts for a couple reasons. (1) Aerosols, we have learned, are more commonly priced and managed by industry on a per-pound basis in the private sector. (2) Demil-required property has been retained as per-pound pricing from the old CLIN structure mostly at Generators’ requests for continuity of tracking, although some contracts have transitioned to C1-C6 where Generators were agreeable. This may have been a missed opportunity for DLA to “force” the transition, but in the interest of time, we defaulted to C7 for Demil-required property.
Given the urgent customer demands for these contracts, DLA will not convert the seven subject CLINs to container-size pricing, as this would require the addition of up to 35 CLINs and substantially delay the solicitation process. Offerors may refer to the “18-Mo Turn-In Hx” tab/attachment in each solicitation to determine average weights per TO and container for each CLIN.
2. CLIN FL03xx should change to NEW Description in Master CLIN Catalog, Date of Publication: May 13, 2022, stating… "No isocyanates (See FL16). Use LP03 for loose packs.”; Add CLIN FL16xx to Price Schedule.
DLA Response: DLA will change the description for Base CLIN FL03 in the NE, SE, and Western regional Price Schedules to match the CLIN description for FL03 used in the Mid-America Price Schedule as follows: “Flammable Liquids/Solids/Sludges/Debris, e.g., tank sludge, lubricants, adhesives, miscellaneous debris, primarily consists of incinerable, non-fuels-blendable materials. Use LP03 for loose packs. For non-reactive paints with isocyanates, see FL16 and LP16.” Further, we will add CLIN FL16 to the NE and Western contracts. Since this CLIN has not been previously used under contracts in these regions, we will move 10% of the estimated quantities under CLINs FL03C1-C6 to CLINs FL16C1-C6, respectively.
3. Please explain the 18-Month Turn-In Hx information. Is this historical data that we may likely see, OR is this actual material that is currently in back-log storage that will be removed on this contract?
DLA Response: The “18-Month Turn-In Hx” spreadsheet reflects the actual turn-in history over the most recent 18 months for current pickup locations in the region. Some of these items have been removed, some have not, and other items have been added since the report was queried. Incineration backlog inventories for the various locations are fluid and not plausible for DLA to provide at the time of solicitation.
4. Will the Lab Packs / Loose Pack CLINs already be prepackaged? If so, we will require a complete container inventory report to be provided at time of TO. How will this be accomplished?
DLA Response: Lab Pack and Loose Pack containers will be packaged prior to turn-in and issuance of a written TO. Lab packing services are performed by the local DLA HW Contractor and require provision of a detailed inventory of containerized item(s). This inventory will be provided to the regional incineration Contractor. There are some DoD Generators who utilize their own base Contractor or are themselves authorized to perform lab packing services. They too must provide a detailed inventory IAW RCRA. Loose packs do not require a detailed inventory of containerized items, but only compatible, like items shall be packaged together. Packaging/Repackaging CLINs 6311AA-6311EE are available to Generators for use as described in PWS Section 1.2.13.
5. Will the government be REQUIRED to use this contract for disposal of ALL the future HW turned in requiring incineration?
DLA Response: No, DLA will not dictate to Generators which contract they must use for turn-in of their incinerable wastes.
6. If not a requirements contract, please explain who and, or what will decide when this Incineration Contract will be used vs the existing HW contract in place.
DLA Response: Generators will decide which contract they will use to best meet their regulatory compliance, storage space, and other requirements.
7. We have concerns that this HW Incineration contract will be used by Contractors to rid itself of the difficult / high-cost incineration items issued on its TO’s. How will a Contractor on an existing HW contract with DLA be held accountable so that this does not happen?
DLA Response: DLA has no practical means to determine whether certain waste items are manageable or unmanageable by the local DLA HW Contractor under the current nationwide incineration backlog conditions. Generators will decide which contract they will use. Use of the regional HW incineration contract does not require that the local HW Contractor first reject or decline to remove the subject items.
8. Will this be a single or multiple award contract?
DLA Response: Each of the four (4) standalone Regional HW Incineration contracts will be separately evaluated and awarded as single-award IDIQ contracts.
9. How will the DLA schedule out the volume of material once the contract is awarded to ensure that the winning bidder has the available capacity? With the high volume of waste present at the locations, we’re concerned that task orders will be cut in large volumes that will exceed the available capacity to receive the material.
DLA Response: DLA intends to initially issue Task Orders with priority given to those Generators having the most urgent needs, i.e., those facing regulatory penalties based on current accumulation times and permitted storage capacities.
