Guam Q&A
QuestionAnswer
1. How much bulk waste is anticipated to be received? Will the contractor be responsible for containerizing the bulk waste? Please refer to Estimated Quanities for both the Base and Option Periods on Attachment 02.0. As stated in the PWS in section 1.2.8.1 BULK WASTE -The term Bulk Waste refers to waste that is typically removed via roll-off boxes, vacuum or sludge boxes, dump trucks, tank trucks, vacuum trucks, pump trucks, and trucks with vacuum-loaded or pump-loaded tanker trailers. Bulk waste does not refer to containerized wastes including waste contained in drums, totes, cubic yard boxes, military tri-wall boxes, cubic yard bags or “super sacks”, lamp boxes, cylinders, or palletized waste.

2. Who will be responsible for manifesting the waste? 1.1.2.1: Permits/Special Requirements states: b. The Contractor shall prepare and provide a Summary Manifest Report, including the completed manifest documents, to the Generator via the COR for filing with the State regulatory office(s). This Summary Manifest Report will be provided in sufficient time to allow the Generators to file the reports within the time frames allotted by each state. The required time frame will be established and documented when the Notification of Regulated Waste Activities form is submitted to the Generator via the COR, per Section 1.1.2. Additionally, section 4.1 APLs speaks to shipping documentation

3. For Saipan and American Samoa CLINS 6610 and 6610AS, what is the contractor’s responsibility for containerizing the waste? Will the waste be provided in 20’ cargo containers for transport? The Contractor is responsible for ensuring that all hazardous property leaving a USG facility is accompanied by a manifest to ensure a complete audit trail from point of origin to ultimate disposal.

The Contractor shall comply with the IMDG Code, OBGED, RID, Host nation and all other applicable regulations for all shipments. Wastes will not be provided in a 20' cargo container for transport; they will be located at the pick up locations.

4. For CLINS 6610 and 6610AS, the quantity of 2-20’ cargo containers, is it two separate transports of an individual 20’ cargo container or one shipment of 2- 20’ cargo containers? It would be two separate transports of an individual 20' cargo container. CLINs 6610 and 6610AS are "01 EA" will be based on the equivalent volume of up to a 20-foot Sea Land Van. One shipment of 2-20' cargo containers would require 02 EA.

5. Approximately how many disposal activities will be required a year to meet the quantity requirements? American Samoa and Saipan are estimated to have one removal per year

6. Will the contractor be responsible for any sampling activities? There are no Special Services CLINs for sampling

7. For CLIN RE11, it states to leave empty drums with generator. Approximately how many different customers or locations will the contractor be responsible for collecting from? Per the Army Guard, RE11 makes reference to RE11ME which is a "Bulk Onsite" or contract order which liquids will be extracted from containers and consolidated for removal. Guam and Saipan Army Reserve Centers do not require this service, However if a special service of providing empty drums for accumulation is available we would like to include that. For Naval Base, historcally, no empty container is left on site, unless labpacking/consolidating like waste streams. And those containers are left with the customer.

8. Will any customers be off-base requiring an additional manifest to transport across public assessways? Wastes will be need to utilize public accessway regardless to get the wastes to the Port of Debarkation

9. Are there any specific additional requirements for manifesting the federal waste? For example, will there be NAVFAC specific training needed in order to manifest the waste? Section 1.1.2 (b) The Contractor may be required to attend special training, seminars, instructions, classes, safety orientations, etc., provided by the Government or to provide information to perform work or gain access to the installation. Example: pass and ID requirements, antiterrorist training, Environmental Management System (EMS) policies, and/or forklift training. Knowing and understaind how to apply DOT and IDMG regulations.

10. For CLIN LP06, please identify what special packaging may be required. Per the Army Guard, CLIN LP06 does not pertain to Guam or Saipan. For Naval Base, historcally, this has been on spical requirments.

11. If the anticipated period is from January 2022 and the bids are due February 02, what are the anticipated turnaround times for the bid results? The Solicitation date has been extended to close on February 22, 2022 at 3PM EST. Anticipated contract award timeframe is May 2022.

12. Do American Flag Vessel requirements apply to this solicitation? Please refer to DFARS 252.247-7023 -Transportation of Supplies by Sea--Basic

13. Are there any specific requirements for the disposal facilities? Section 1.1.2 c: The Contractor and any Subcontractor(s) shall use only the facilities and transporters currently (at the time) listed in the Defense Logistics Agency Disposition Services (DLADS) Qualified Facilities List (QFL) and Qualified Transporters List (QTL), per Section 5.0.All disposal facilities must be on Disposition Service's Qualified Facilities List. It is possible to add facilities if they are not listed

14. Can any international disposal facilities be utilized for disposal? Section 1.1.2 d and e: d. Any import or export shipment outside the United States must comply with all international agreements and all applicable foreign laws. If the Contractor will be exporting directly from the DOD activity, the Contractor is required to provide a current copy of the Acknowledgment(s) of Consent to the COR with the shipping documentation.

e. The Contractor may not ship waste outside of the United States to circumvent Environmental Protection Agency (EPA) Land Disposal Restrictions (LDR) unless domestic treatment capability does not exist or domestic facilities are unable to meet EPA LDR requirements within the United States (e.g., Lithium batteries). Waste containing high level mercury (>260 mg/kg) will not be exported outside the United States.

15. What will the data entry requirements be? Will the contractor be expected to maintain a data within DODACC? No contractor does any data entry in DLA Disposition Services's program, nor is one needed for base access.

16. Will a CAC card be necessary for data entry or access? No contractor does any data entry in DLA Disposition Services's program, nor is one needed for base access.

17. What are the security requirements and for what positions will it apply? Section 1.1.4 (d): Defense Biometric Identification System (DBIDS) may be mandatory for access to some DOD facilities. See Section 1.1.8 for further information. Where DBIDS is utilized, the 24-hour advance notification is not required. At some military installations, the Contractor and/or Subcontractors may be required to be escorted to and from the place of work. This requirement is for both safety and physical security purposes. Contractors, their employees, agents, and/or any Subcontractors are required to remain at the designated work area until released or escorted by the COR or other Government representative. DEBIDS is all the contractor will need for ALL base access.

18. What is the percentage of completion is acceptable for past performance? Please refer to Addendum 212-1 and Addendum 212-2 labeled "Instructions to Offerors -Guam" & "Evaluation -Guam HW" for past performance.

19. On Page 31 the RFP states: “3.34 b. Transportation CLIN will be chargeable for transportation from locations requiring shipment by sea. CLIN 6600 shall be charged on a “01 EACH” basis. CLIN 6600 will be based on the equivalent volume of up to a 20-foot Sea Land Van. If the equivalent in volume of a 40-foot Sea Land Van is to be removed, there will be two fees or “02 EACH “(i.e. the Unit Bid for CLIN 6600/6610AS charged at 01 EA).” However, there is no CLIN 6600 on the Pricing Worksheet. The cost of shipping from Guam to the US Mainland is very expensive. Are these costs to be bid as CLIN 6600 (and if so, does that CLIN need to be added to the worksheet) or should ocean shipping costs be incorporated into the per unit bid prices for the CLINs? 3.34 should have refered to CLINs 6610/6610AS, which are transportation charges SPECIFICALLY for Saipan and American Samoa; CLINs 6610/6610AS are the CLINs that should be bid on. There will be no CLIN 6610. Ocean shipping costs for Guam should be incorporated into the per unit bid prices.

20. Related to the above: if ocean shipping costs are incorporated into the per unit bid prices for the CLINs on the worksheet, can the Contractor refuse small volumes that would not be compensatory given the high per container shipping cost from Guam to the US Mainland, or is the contractor at risk for such shipments? Is there any other solution for the potential problem of low container utilization? The contractor will be required to remove items regardless of volume. Generators are encouraged to maximize using the entire container volume when offering wastes for disposal.

21. Further related to the above: trans-Pacific shipping rates have skyrocketed in the last two years and fuel adjustment charges increase with the cost of oil. If we bid based on current rates, is there any provision for contract adjustment for future ocean carrier rate increases, or should we build that risk into our pricing? Offerors will need to build their pricing for the entire period of the contract as well as the option period.

22. Finally, also related to the above, CLIN 6610 and 6610AS are the transportation charges for Saipan and American Samoa, respectively. Will the other CLINS also apply there with 6610 and 6610AS as additional charges? If so, which CLINS are anticipated there? How will shipments be packaged? Removal from the island of Guam doesn't have a separate transportation CLIN. Estimated quanities for both the Base and Option Periods are identified on the Bid Schedule (Attachment 02.0).

23. Regarding CLIN FL05C7: is this provided containerized or is the Contractor expected to pump into Contractor’s ISO container from a bulk source? Per the Army Guard; CLIN FL05C7 does not pertain to Guam or Saipan Location. For Naval Base, historcally, 55 GAL drums and ISO tanks.

24. Regarding CLIN RE11C7: The description in the worksheet implies that it will be provided in drums but we have to pump out of the drums into Contractor’s container (“bulked on-site”). Is this correct? Per the Army Guard; CLIN RE11C7 (USED OIL) is stored and accumulated in 55-GAL Drums which the contractors may pick up and remove as a whole without having to pump the liquid out of the drums. We do not meet the minimum requirement for "Bulked on-site" of 30 ea CLIN RE11ME. So the total weight of CLIN RE11C7 will be per drum per pallet. For Naval Base, historcally, no containers have been pump.

25. The PWS states: "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”" but makes no mention of how the batteries will be packaged. How will the batteries for Base CLINS BA01 through BA14 be packaged or containerized? As per 6.2: The Contractor shall package, mark, label and placard all containers in such a manner to meet all applicable United States Department of Transportation (DOT), Environmental Protection Agency (EPA), and applicable International and State regulations are met. The Contractor shall provide and affix the appropriate placards to each conveyance vehicle prior to leaving Government premises.; Per the Army Guard, CLIN's BA01, BA04, BA05, BA06, BA10 will be "PALETIZED" and secured. So, total weight will be accumulated per Pallet. (Above Mentioned CLIN's for BA are the only ones pertaining to Guam and Saipan). For Naval Base, historcally, various container sizes and triwalls.

26. The PWS states, "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”" and makes no mention of Corrosives being ordered through CLIN Suffix C7. Will the Corrosives for Base CLINS CS01 through CS14 be packaged or containerized and if so, in what size containers? Corosives (Base CLIN CS) all have the CLIN suffix of "C7" and will be ordered in pounds "LB".

27. The PWS states, "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”" and makes no mention of flammable liquids and flammable corrosive liquids being ordered through CLIN Suffix C7. Will the flammable liquids and flammable corrosive liquids for Base CLINS FL01 through FL07 be packaged or containerized and if so, in what size containers? Flammable (Base CLIN FL) all have the CLIN suffix of "C7" and will be ordered in pounds "LB".

28. “Lab Packs” and "Loose Packs" refers predominantly to the overpacking of multiple containers into a single outer container. The PWS states, "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”". What will be the size of container for the "Lab Packs"and "Loose Packs" ordered through CLIN Suffix C7? Guam and Saipan Army Reserve Sites do not require handling of "Lab Packs" or "Loose Packs". For Naval Base, historcally, various container sizes from 1 to 30 GAL drums.

29. The PWS states, "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”" and makes no mention of Non-RCRA Solids/Debris liquids being ordered through CLIN Suffix C7. Will Base CLINS NR01 through NR99 be packaged or containerized and if so, in what size containers? Non RCRA, Non-State and State Regulated (Base CLIN NR) all have the CLIN suffix of "C7" and will be ordered in pounds "LB".

30.The PWS states, "CLINs for containerized aerosols, batteries, lamps, PCBs, and some military items are designated with CLIN Suffix C7 and are ordered in pounds “LB”" and makes no mention of PCB Mineral Oil being ordered through CLIN Suffix C7. Will Base CLINS PC02 through PC12 be packaged or containerized and if so, in what size containers? PCB (Base CLIN PC) all have the CLIN suffix of "C8" and will be ordered in kilograms "KG".

31. Will Base CLINS RE02 through RX15 be packaged or containerized and if so, in what size containers? Per the Army Guard, These will be stored and accumulated in "Open Top" 55-GAL Drums. For Naval Base, historcally, 55 Gal drums.

32. The text for Base CLIN RE11 makes reference to RE11ME requiring bulking onsite. Will CLIN RE11C7 require onsite consolidation or bulking? If it is containerized, what size containers will it be in? Per the Army Guard, As mentioned above regarding RE11C7 and RE11ME, We do not meet the minimum requirement for RE11ME for "Bulked Onsite". For Guam and Saipan RE11C7 is stored in 55 GAL Drums and will require REMOVAL as a whole (as in with the containers they are stored in). For for Naval Base, historically, 55 GAL drums and ISO tanks.

33. Will Base CLINS RX97 through RX98 be packaged or containerized and if so, in what size containers? CLINS RX97 through RX98 do not apply to the Army Guard or Saipan. For Naval Base, historically, various drum sizses and triwalls.

34. Will Base CLINS TX06 through TX99 be packaged or containerized and if so, in what size containers? Per the Army Guard, CLIN TX16C7 will be stored preferably in Metal Containers i.e. Open Top 55 GAL Drums or palletized and banded. For Naval Base; historically 55 GAL drum, Overpack drums, and/or triwalls.

35. The "Transportation Charges" text for Base CLINS FL05, FL07, NR03, NR04, and NR93 all make reference to the waste being pumpable; however CLIN Suffix seems to indicate these wastes are already containerized. Please confirm that these wastes do not need to be pumped by the Contractor into a container and are already packaged or containerized. Per the Army Guard, These wastes DO NOT need to be pumped by contractor. For Naval Base, historally does not require contractors pump any containers.

36. Given that there was a two-week extension of the deadline for bid submission, would it be possible to extend the deadline for questions two-weeks as well? The new Solicitation closing date is February 22, 2022 at 3PM EST.
