Notes to Offerors
1. Offerors shall be responsible for thoroughly familiarizing themselves with these notes, all terms, conditions, solicitation requirements, attachments and documents associated with it, including those incorporated by reference and/or web links.
2. This 100% small business set aside competitive solicitation is for a firm-fixed price, indefinite delivery/indefinite quantity (IDIQ) contract, written as a performance based contract and allows the Contracting Officer (KO) to make monetary deductions and/or negative evaluations on the Contractor’s Past Performance when an Acceptable Performance Level (APL) is not met, See Section 4.
3. This contract is primarily for various military and Government activities in Florida, Georgia, and Puerto Rico. Standard removal timeframe for all sites is 15 calendar days from the date of order issuance for the Jacksonville schedule and 30 calendar days for the Puerto Rico schedule, except as otherwise noted.
4. This contract requires the removal, transportation and disposal of RCRA wastes, non-RCRA wastes, Compressed Gas Cylinders and Polychlorinated Biphenyls (PCBs)
5. Some waste ordered on this contract requires the Contractor to furnish Certificates of Recycling and/or Certificate of Disposal (CD). The Contractor shall fully comply with the contract sections on PCBs - Section 2.2, Compressed Gas Cylinders - Section 2.3, and Demilitarization of Government Property - Section 2.5.
6. Publications and attachments applicable to this contract will be made available upon request. It should be noted that during the solicitation and life of this contract, the Government may make changes, additions or deletions to those listed.
7. The Contractor is cautioned that some requirements for information and plans are required before start of work on this contract, i.e., Section 2.1.4 and 1.1.7 (Rapid Gate Entry)
8. The email address for submission of offers, hazardouscontractseast@dla.mil
9. It is the offeror’s responsibility to review and thoroughly analyze the Business Objects Data provided in attachments in preparing their proposals under this solicitation. Failure to do so shall not be the basis for any future claim(s) against the Government.
10. The Jacksonville/Puerto Rico contract is an active, demanding and logistically complex hazardous waste contract. Offerors are strongly cautioned against undertaking this contract without a thorough understanding of its demands. The following is a brief synopsis of the logistical complexities:
a. Based on historical activity, it is anticipated that the vast majority of Jacksonville pickups will be from Naval Air Station Jacksonville, Naval Submarine Base King’s Bay, and Naval Station Mayport. Each of these locations may have at least one large pickup each, all of which may be scheduled for pickup on the same day. Additionally, NAS Jacksonville regularly has multiple expedites scheduled simultaneously with the other previously referenced pickups. The Contractor shall be required to be fully prepared from the first day on the job to simultaneously and fully meet all of these requirements, without exception.
b. If the Contractor does not have a reliable fulltime employee onsite at Puerto Rico, the Contractor should expect to have one or two of its employees on island for 1 to 2 weeks at a time. The Contractor shall be required to be fully prepared from the first day on the job to simultaneously and fully support all of the Jacksonville and Puerto Rico locations, without exception.
c. Retrogrades have been, and will continue to be, handled under this contract. These retrograde shipments may involve any and all types of materials encountered from Department of Defense (DoD) facilities (including soil). In one instance, the retrograde involved 150,000 pounds of lead acid batteries from Diego
PAGE 3 OF 22 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
SP4500-14-R-0008
Garcia. Due to the space limitations at Blount Island Command, this retrograde required that the entire quantity be removed on the same day that they were offloaded from the transport vessel. The Contractor is required to make all necessary notifications to DoT, EPA, USDA, etc. The Contractor is responsible for the complete removal of the retrograde shipment from the Port of Entry (POEs) within 96 hours of its release from customs. There may be occasions when simultaneous retrograde shipments required removal from different POEs at the same time. The Contractor shall be required to be fully prepared from day one of the contract to handle these removals simultaneously with all other removals from Jacksonville and Puerto Rico, without exception.
d. Support for Guantanamo Bay may include any CLIN on the Jacksonville schedule, including sending personnel to Guantanamo Bay to perform any of the management service CLINs. For example, in two previous instances, personnel were required at Guantanamo Bay to deal with leaking chlorine CGCs. Servicing Guantanamo Bay shall in no way relieve the Contractor from simultaneously fulfilling all of the other requirements previously noted.
e. In addition to the other expedites in the Jacksonville and Puerto Rico schedules, the Puerto Rico schedule also contains CLIN 6334RH, 3 Calendar day Removal in the event of Hurricane or other Natural Disaster(s). The use of any combination of expedited performance(s)/removal(s), including 6334RH, under the Jacksonville schedule, Puerto Rico schedule, or both, shall in no way relieve the Contractor from the simultaneous performance of all of the other drops/pickups previously noted. From day one of the contract, the Contractor shall be fully prepared, in terms of both personnel and equipment, to simultaneously support all drops and/or pickups, regardless of what combination(s) of the above may occur.
f. These are potential examples based on historical activity. They in no way obligate the Government to order all of the services noted, however, the potential Contractor must be aware that the scenarios noted represent a realistic overview of the logistical complexities involved, and that they must be fully prepared to simultaneously support all of these requirements, without exception.
g. Additionally, as stated in Note 2, the current solicitation is for a performance based contract.
The Acceptable Performance Levels (APLs) are set forth in Section 4. These APLs are the minimum acceptable levels of performance. It is imperative that offerors fully understand that these APLs will be strictly enforced. The offeror's successful performance under these APLs may lead to DLA Disposition Services’ decision to exercise options and receive performance evaluations that may give the Contractor a competitive advantage on future “buy best value” procurements by DLA Disposition Services, and other Governmental and non-Governmental entities that may access CPARS past performance evaluations. Failure to achieve successful performance levels will produce the opposite result.
11. There is a possibility that from time to time large retrograde shipments of batteries (particularly lithium batteries) may be received. Neither DLA Disposition Services nor the generator can determine this requirement in advance. Offerors are therefore strongly encouraged to review their pricing of the various battery CLINs very carefully, taking this possibility into consideration.
12. The cut-off date for the receipt of offeror questions is August 20, 2014 in order for DLA Disposition Services to provide relevant answers to those questions prior to the closing date of this solicitation. While every reasonable attempt will be made to answer any relevant offeror questions that may be received after the cut-off date, DLA Disposition Services cannot guarantee that all such questions will be answered. Offerors are therefore strongly encouraged to submit all questions regarding this solicitation prior to the cut-off date.

0. PERFORMANCE WORK STATEMENT
a. The Contractor shall provide all services necessary for the final treatment/disposal of DoD waste listed in the schedule in accordance with (IAW) all local, state, international, and Federal laws and regulations in addition to all the terms and conditions of this contract. These services shall include all necessary personnel, including applicable subcontractors, labor, analysis, transportation, packaging, equipment, and the compilation and submission of all documentation required by this contract. All Contract Line Item Numbers (CLINs), regardless of their condition, are being discarded by the Government and are considered to be waste.
b. The Government agrees that all waste placed on Task Order (TO) on this contract will be accompanied by documentation and markings that comply with all applicable local, state, and Federal laws and regulations relating to the generation and storage of hazardous property.
1. REMOVAL
1.1 PRE-REMOVAL
1.1.1 PERMIT/SPECIAL REQUIREMENTS
a. The Contractor shall, without additional expense to the Government, be responsible for paying all fees, preparing or obtaining all necessary licenses, permits, notifications, waste profiles, or reports, which result from a Contractor’s transportation, recycling or disposal decisions. This shall include acquiring all permits or registrations necessary to operate on any installation listed in this contract, and completing the Notification of Regulated Waste Activity form for the generators of hazardous waste to sign and file with the applicable state regulators for waste disposal. This shall include signing (on behalf of the Government) waste profiles requested by Treatment Storage Disposal Facilities (TSDFs). All Contractor signed waste profile sheets shall be written for the actual wastestream, using the generator’s profile for backup documentation. All generator forms or other means of notifications, including correspondence with Federal or state agencies on behalf of a generator, shall be coordinated with and concurred with by the affected generator prior to submission to any Federal or state agencies.
b. The Contractor may be required to attend training, seminars, instructions, classes, etc., to perform work on, or gain access to, the installation. Examples: pass and ID requirements, antiterrorist training, EMS policies, forklift training, etc.
c. Any shipments outside the United States shall comply with all international agreements and all applicable foreign laws. If the Contractor will be exporting directly from the DoD activity, the Contractor shall be required to provide a current copy of the Acknowledgment(s) of Consent to the Contracting Officer Representative (COR) with the shipping documentation, IAW Section 1.1.2. The Contractor shall not ship waste outside of the United States to circumvent Environmental Protection Agency (EPA) land disposal restrictions.
1.1.2 SHIPPING DOCUMENTATION
a. All references to manifests in this provision relate to the “appropriate shipping paper”. The Contractor shall obtain and prepare all manifests, Hazardous Waste Profile Sheets required for acceptance of waste into a DLA Disposition Services Qualified Facility, land disposal restriction notifications and any other shipping documents. The Contractor shall provide the COR with a copy of the completed form(s) for review by the appropriate Government official at least five (5) business days prior to removal, except documentation submitted for expedited orders, which shall be IAW notification timeframes as listed elsewhere in this contract. Prior to removal from a site identified as a pickup point in this contract, completed copies of all manifests, or bill of lading, whichever is applicable, shall be furnished to the DLA Disposition Services site coordinating the waste disposal. Each pickup manifest and bills of lading (i.e., with a Government activity identified as a generator), as well as all other documentation required herein, shall be clearly and distinctly marked with the name of the servicing DLA Disposition Services site in addition to the generators, the contract number, and TO number, as applicable. Emergency response information and twenty-four hour emergency phone numbers shall be listed on the manifest, or bill of lading. If blocks are not provided, this information shall be placed in the upper, right hand corner of each document.
b. The DLA Disposition Services created dummy EPA number for non-RCRA facilities shall be entered on all applicable shipping documentation such the manifest or bill of lading. Also, DLA Disposition Services created dummy EPA numbers shall be included on the HQ DLA Disposition Services Form 1683 Manifest Tracking Log.
c. The Contractor shall perform all dry weight computations for those wastes destined for land disposal in Texas, and shall provide all such computations to the COR for record keeping purposes.
This computation shall be furnished along with the copy of the generator manifest.
1.1.3 NOTIFICATIONS
a. Except as may otherwise be specified herein, the Contractor shall notify the COR for each location, at least five (5) business days BEFORE attempting site visits, analysis or pickups.
b. In addition to the notification above for pickups, the Contractor shall provide the name of the driver and the driver’s Commercial Driver’s License (CDL) number with its expiration date to the COR or other Government representative at least 24-hours prior to removal. The Contractor may also opt to provide a list of approved, multiple drivers designated for pickups under this specific contract to the COR or other Government representative prior to any attempted removals. If this option is elected and the list is approved by the Government and maintained by the Contractor, the 24-hour notification requirement is mute for the remainder of the contract unless otherwise modified.
c. If a driver, other than the one specified 24 hours in advance for the specific TO; or, one whose name does not appear on the optional list of approved multiple drivers, arrive for pickup, the COR or other designated Government representative will verify the personnel switch with the prime Contractor before the pickup commences. This may require a written notice or fax from the prime Contractor.
d. For TOs containing expedited removals, services, or performance CLINs, the Contractor shall notify the COR or other Government representative for each location within the following timeframes BEFORE attempting site visits, analysis or pickups: 15-10 day expedites – at least 3 calendar days; 9-5 day expedites – at least 2 calendar days; 3 day expedites – at least 1 calendar day; and 1 day expedites – at least 4 hours prior to removal. In addition, the Contractor is still required to provide the information identified in paragraph (1) above at least 24-hours prior to removal. If applicable, any removals ordered under a 24-hour or one business day expedited CLIN requires the Contractor to provide the information identified in paragraph (1) at least 4 hours prior to pickups if the Contractor elects to provide the identity of the driver for each specific TO. If the Contractor elects to provide the list of approved multiple drivers designated for use under this contract, this expedited notification is not required. All other terms and conditions stated elsewhere within this clause apply to any of the aforementioned expedited removals, services or performance CLINs.
1.1.4 TRAILER SECURITY, PADLOCKS
a. All Contractor trailers and tankers capable of being padlocked shall be padlocked upon arrival at the pickup location. Failure to meet this requirement may result in the Governments halting of the pickup. All trailers and tankers capable of being padlocked shall also be padlocked again prior to departure from the pickup location(s). The driver shall provide the padlock and lock the trailer or tanker without assistance from the COR or other Government representative.
b. The COR or other Government representative shall have the right to request any identification and/or occupational endorsements from the driver beyond what is identified in additional specific sections in this contract and refuse commencement and/or completion of pickups if any unusual or suspicious actions occur. Any potential demurrage associated with the driver verification process and/or the unexpected halt or commencement of pickups shall not be grounds for any claims against the Government.
1.1.5 HOURS OF OPERATION
The Contractor agrees that, for those portions of the services provided on a Government installation, the services will be provided during the normal hours of operations for the installation. The normal hours of operations for installations on this contract are available, upon request, from the COR.
1.1.6 PUBLIC AFFAIRS COORDINATION
The Contractor shall refer all inquiries concerning this contract to the KO. Under no circumstances shall any statement be released to the news media directly by the Contractor or any agents of the Contractor.
1.1.7 RAPID GATE SECURITY
Navy installations require Navy Commercial Access Control System (NCAC) badges to gain access.
Contractors and Contractor personnel must be enrolled in NCAC in order to access installations. It takes approximately one month for initial company background investigations to be completed and enrollments to be processed. Costs of enrolling in the program are outlined below.
a. Company Enrollment for one year is $199 for a single installation (base) OR $249 for two or more installations.
b. Employee Enrollment for one year is $159 for a single installation OR $199 for two or more installations.
c. There is a 90-day subscription option for $59. This is for one employee for a single installation.
Each additional installation is an additional $59.
d. Additional information can be found at: http://www.rapidgate.com/index.php.
1.1.8 ENVIRONMENTAL MANAGEMENT SYSTEM (EMS)
a. The DLA Disposition Services implemented EMS IAW ISO 14001:2004(E), DoD, and DLA requirements at all DLA Disposition Services appropriate facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA Disposition Services Mission. The DLA Disposition Services EMS program is explained in DLA Disposition Services Manual 6050.02, Environmental Management System. The manual is available online at the DLA publications website (http://www.dla.mil/issuances/Pages/default.aspx). An electronic version of the instruction may be provided to the Contractor upon request to the DLA Disposition Services Environmental Management Representative (EMR) through the KO.
b. Site supplements to the DLA Disposition Services Instruction 6050.02 describe information required by EMS at a local level such as local, state, and host environmental regulations as well as local emergency procedures and operating systems unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant appropriate facility and the DoD/DLA host facility EMS program. Copies of site supplements may be obtained from the EMR appointed at each site with an EMS.
c. Contractors and their personnel are required to be aware that each DLA Disposition Services appropriate facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLA Disposition Services appropriate facility maintains EMS awareness posters that identify the DLA Disposition Services EMR and Host facility EMR for specific guidance concerning an individual facilities' EMS program.
d. The Disposition Services EMR maintains a list of sites that have a site EMS. Contractors may request a copy of the list from the DLA Disposition Services EMR through the KO.
1.2 REMOVAL
The requirements for removal of wastes under this contract are divided into three main phases – Pre- Removal (Section 1.1), Removal (Section 1.2), and Post-Removal (Section 1.3). The Contractor, and its subcontractors, shall perform at all times in a prudent, conscientious, safe and professional manner. The Contractor shall ensure that its agents, employees and subcontractors involved in handling and packaging the hazardous waste are trained for the level of expertise required for the proper performance of the task and, in particular, in the areas of chemical incompatibility, general first aid procedures and spills. Handling and Personnel Protective Equipment (PPE) shall be provided by the Contractor and shall be appropriate to ensure safe handling of the hazardous waste. When operating within an EPA or state permitted DoD Hazardous Waste (HW) storage facility, the Contractor shall be required to use forklifts with specifications that meet the applicable permit requirements. The Contractor personnel and equipment shall be subject to safety inspections by Government personnel while on Federal property.
1.2.1 SPILL RESPONSIBILITY
a. The Contractor shall be solely responsible for cleanup of any and all spills or leaks during the performance of this contract that occur as a result of, or are contributed to by, the actions of its agents, employees, or subcontractors, to the satisfaction of the and at no cost to the Government.
b. The Contractor shall report all such spills or leaks, regardless of their quantity, to the KO immediately upon discovery. A written follow-up report shall be submitted to the KO not later than 24 hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:
(1) Description of item spilled (including identity, quantity, manifest no., etc).
(2) Whether amount spilled is EPA/state reportable, and if so, whether it was reported.
(3) Exact time and location of spill, including a description of the area involved.
(4) Containment procedures initiated.
(5) Summary of any communications Contractor has with press or Government officials other than the KO.
(6) Description of clean-up procedures employed or to be employed at the site, including disposal location of spill residue.
1.2.2 SEGREGATION OF HAZARDOUS WASTE
All waste collected on this contract shall be segregated and kept physically separate from any waste items until the initial TSDF is reached. The items shall be so marked that they are readily identified to this contract throughout this period.
1.2.3 STATEMENT ON CONTAINERS
a. The Government is required to containerize their waste. The Government is not required to use DoT shippable containers to store their waste unless individual permits for storage facilities or accumulation sites require DoT shippable containers for storage. Because some Government locations require DoT shippable containers for storage and others do not, this contract does not warrant that the Government drums or containers are suitable for transportation IAW DoT regulations for removal from the pickup site. The Contractor shall be responsible to make non-DoT shippable containers DoT shippable. The Contractor shall not be reimbursed separately for these repackaging expenses and the Contractor shall include these charges in their disposal pricing. The offeror is cautioned to ascertain and assess the need for overpacking or recontainerizing based on the site visit.
b. When overpacking of containers is required the Contractor shall use appropriate equipment to place the container into the outside/overpack container. The inner container shall be kept in an upright position. Overpack containers used for liquids shall be marked with directional arrows indicating the upright position of the inner container.
1.2.4 GOVERNMENT EQUIPMENT AND PERSONNEL
The Contractor understands that the Government will not furnish any equipment or personnel to assist in the performance of this contract. Any such offers of assistance are unauthorized and the Contractor shall not accept any such offers. The only exception is the use of Government owned loading equipment (Section 1.2.6), and Government owned scales (Section 1.2.7), and where applicable, management services.
1.2.5 TREATMENT OF HAZARDOUS WASTE ON GOVERNMENT FACILITY
a. Treatment of hazardous waste (including solidification) on Government facilities shall not be permitted. Treatment is defined as any process which meets the definition of treatment as set forth in applicable local, state, and Federal (including 40 CFR 260.10) laws and regulations.
b. The Contractor shall not drain and/or flush PCB items at Government installations. Draining shall be allowed only to prevent leaking and to meet DoT regulations.
c. Treatment, disposal, or release of gas (other than inert) to the atmosphere on Government premises shall not be permitted by this contract. The Contractor may perform gas extraction for other than inert gas cylinders at the pickup location using self-contained apparatus. This apparatus shall emit no gas into the atmosphere, and purge the entire cylinder contents into a closed receiver for transport to a recycling or disposal site.
1.2.6 LOADING - CLINs 6360AA, 6360AB & 6360AC
a. The Contractor shall be responsible for loading, including furnishing all the equipment necessary for loading. Unless otherwise specified, the Government will not load at any location, nor shall loading be performed on Saturdays, Sundays, Federal holidays or any day that the installation where the items are located is closed. Where it is provided that the Government will load, the Government will make the initial placement of the item on conveyance(s) furnished by the Contractor and the initial placement on the Contractor’s conveyance shall be as determined by the Government. Unless otherwise provided in the contract, the Government will not block, chock, brace, lash, band or in any other manner secure the cargo on such conveyance(s) furnished by the Contractor.
b. It is the Government’s responsibility to assure that the waste to be picked up is readily accessible for loading by the Contractor at time of removal. Accessible is defined as not being necessary to move other waste not scheduled for removal on the instant TO, in order to gain access to the waste that is scheduled for removal. NOTE: For retrograde shipments from Guantanamo Bay and other off-shore locations at Blount Island or other POEs, other than the normal shipments from Puerto Rico (all arrangements for which are solely the Contractor’s responsibility), the waste will normally be inside sealed containers. In these instances, it shall be the Contractor’s responsibility to remove the waste from the sealed containers for placement onto the Contractor’s conveyance.
c. In the event that the Contractor must move other waste in order to access the waste scheduled to be removed, the appropriate CLIN 6360AA and/or 6360AB shall be ordered by the Government. The Contractor should be aware that the requirement for them to move waste not scheduled for removal could arise during a scheduled pickup, when such a contingency had not been identified prior to the time of the pickup. In the event that the above CLIN(s) were not identified prior to the scheduled removal, but are determined to be necessary after the Contractor arrives for the pickup, the COR will notify the KO to obtain approval for the additional work required before the Contractor proceeds with that additional work. Upon completion of loading, the COR will annotate the Collection Summary Report to indicate the quantity for each CLIN category that was required to access the waste prior to being able to load the truck, and will request a TO modification prior to the total quantity indicated on the TO being exceeded.
d. The unit of measure for CLIN 6360AA and 6360AB is EA where one (1) EA equals all labor, equipment, and tools necessary to perform the identified services for a time period not to exceed one (1) hour. The unit of measure for CLIN 6360AC is EA where one (1) EA equals all of the Contractor’s demurrage costs associated with a time period not to exceed one (1) hour. CLIN 6360AC shall only be ordered if demurrage exceeds the industry standard of two hours and the quantity ordered shall only be for the time periods that exceed the two hour industry standard.
e. In the event that a spill, injury to Government personnel, or damage to Government property occurs as a result of the Contractor moving other waste not scheduled for removal under CLIN 6360AA and/or 6360AB, the Government shall be indemnified from all liability. If any such spills, injury or damage occurs, the COR will immediately notify the KO or other required Government representative.
f. The Contractor shall be solely responsible for any delays in the time required to complete the scheduled removal that are not directly attributable to a delay caused by the Government (i.e., late arrival of the Contractor/subcontractor, defective or unsafe equipment, etc.).
g. The Government may load at the following locations but the Contractor is cautioned that this may not always be the case. The Contractor should be prepared to load:
Drums at USAF, c/o ITT Systems Division – Lajas TARS, Road 303, KM 6.0, Lajas, PR
ROTHR Transmitter Facility, US Navy. Forces Surveillance Support Center
Vieques Road 200, Navy Bldg 2037, Vieques Island, PR
1.2.7 WEIGHING OF PROPERTY
The Contractor shall weigh all property before removal unless the Generator and COR deem it unnecessary. When scheduling pickups, the Government and Contractor shall coordinate where weighing is not required so the Contractor can make appropriate arrangements for pickups. An authorized Government representative shall witness all weighing that occurs onsite. The weight, agreed upon by both the Contractor and the Government representative at the time of removal, shall be the basis for payment to the Contractor. Unsubstantiated charges for subsequent increases in weight, after removal from Government custody, shall be the responsibility of the Contractor.
a. Bulk Items
(1) Bulk items shall be measured by one of the following methods. The method used shall be whichever is most accurate and agreed upon by the Contractor and the Government representative:
(i) Actual weight using Government scales.
(ii) Actual weight using commercial scales.
(iii) Calculated weight. As an alternative to actual weighing, the weight of bulk shipments may be computed, provided that the specific gravity of the material is known and the volume actually picked up is determined. For example, 2,000 gallons of liquid with a specific gravity of 1.4 = calculated weight of 23,344 pounds (2,000 x 1.4 x 8.337, where one gallon of water weighs 8.337 pounds). Specific gravity shall be obtained from a waste profile sheet.
(2) For either “actual weight” method, the vehicle shall be weighed both before and after loading. For bulk shipments, where Government scales are not available or operable, the use of commercial scales is authorized. The Contractor shall arrange for and incur all expenses of weighing property at the nearest certified public scale.
b. Non-bulk Items
(1) For non-bulk items, the Contractor shall provide portable scales for outweighing of property. Portable scales shall have a minimum capacity of 1,500 pounds. For the purpose of this contract, scales permanently affixed or built into a vehicle are considered portable scales.
(2) Prior to the use of portable scales at each pickup site, the Contractor shall demonstrate reasonable weight accuracy to the Government representative. Only materials to be removed by the Contractor shall be weighed. Pallets, boxes, strapping, etc., which are not integral parts of the packaging and are not being removed by the Contractor shall not be included in the weight.
(3) Government scales may be used, in lieu of scales provided by the Contractor, only where they are available, operable and authorized by the Government representative. The Contractor shall be responsible for determining the availability of Government scales.
