SP3300-17-R-5008
AMENDMENT 0001
1. The solicitation number was inadvertently posted to FBO as SP3300-17-R-0008 in lieu of the correct solicitation number SP3300-17-R-5008. The solicitation number is hereby corrected from SP3300-17-R-0008 to SP3300-17-R-5008.
2. The due date for quote submittals of Friday, 15 September 2017 12:00 PM Eastern Time remains unchanged.
3. The following answers are provided to questions received from vendors, and are hereby incorporated into the solicitation:
Question 1: Could you make a separate group three and possibly a group four, for deliveries outside of the United States? We got some freight estimates on shipping two boxes weighing 35 pounds each to several locations and the freight difference on the shipments going out of the United States is so huge that it would be difficult to come up with a delivered price for item going in the United States and also out of the United States.
Answer 1: No, the solicitation will not be amended to include a separate group three and/or group four for deliveries outside of the U.S. As noted in paragraph 2 on page 1 of the solicitation, F.O.B. Destination prices shall include delivery to all destinations within Zones 1 and 2, including delivery to the continental United States (CONUS) Consolidation and Containerization Points (CCP) within the respective zones if the ultimate destination is OCONUS or overseas. Vendors may not propose alternate zones.
If the ultimate destination is OCONUS or overseas, the vendor shall deliver that shipment to the CONUS CCP within the respective zone.
Question 2: You’ve referenced EPA guidelines for 25% recycled post-consumer material that is in the Schedule of Supplies product descriptions. We understood that the same guideline existed in 2014 when this contract was last bid yet it was not included in that RFQ’s product descriptions.
Based on preliminary sourcing discussions, using the specific type of recycled material you’ve called out will raise the cost of the raw material considerably, possibly in the range of 50-60% or more. In the spirit of keeping your cost for those products reasonable, will you agree to waive this requirement once again?
Answer 2: Yes. Paragraph 4 on page 1, entitled “Manufacture” is hereby removed from the solicitation. Under the CLIN Descriptions, the reference to “RECYCLED CONTENT: 25 PERCENT POST CONSUMER MATERIAL” is hereby removed.
Question 3: Is the last contract for these two items that you awarded in 2014 still being completely fulfilled? If not, what is the magnitude of accumulated back orders now or expected to occur prior to award that the successful bidder will inherit? This information may have a material affect on the cost and ability to meet service goals you are requiring.
Answer 3: Yes, the predecessor contract, SP330-14-D-0015, is scheduled to expire 7
September 2017. In accordance with DFARS Clause 252.216-7006, Ordering, included in SP3300-14-D-0015, supplies to be furnished under this contract are being ordered via delivery orders issued through 7 September 2017. Being that this follow-on contract is anticipated to be awarded for performance beginning 25 September 2017, there is no accumulation of back orders anticipated that the successful offeror is expected to inherit.
Question 4: In consideration of your very large projected volume (average of 900,000 PLE’s per month), what’s your time frame after award for the vendor to be able to fulfill all arriving orders considering that inventory will need to be manufactured to support this contract?
Answer 4: As noted in FAR Clause 52.216-21, Requirements, of the solicitation, under paragraph (a), “The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated'' or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. In addition, per paragraph (b) of this clause, “Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause.” Delivery timeframes will be specified in individual delivery orders. See FAR Clause 52.216-19, Order Limitations, regarding minimum/maximum orders the contractor is obligated/not obligated to honor.
Question 5: These products meet the definition of COTS items, the RFQ shows application of FAR 52.223-9, yet the description in that section clearly says it does not apply to acquisition of COTS items. If these are not COTS items, please explain why not and why 52.223-9 should apply.
Answer 5: FAR Clause 52.223-9, Estimate of Percentage of Recovered Material Content for EPA-Designated Items (May 2008) has been removed from the solicitation, as it is concurred that this clause is not applicable to this acquisition.
Question 6: Why does Buy American 52.225-1 not apply to this contract?
Answer 6: Buy American does apply to this acquisition. The solicitation originally included DFARS Clause 252.225-7036, Buy American Act – Free Trade Agreement – Balance of Payments Program; however, the solicitation is hereby revised to delete DFARS Clause 252.225-7036, Buy American Act – Free Trade Agreement – Balance of Payments Program, and replace this clause with DFARS Clause 252.225-7001, Buy American and Balance of Payments program (DEC 2016).
Question 7: Is the pricing I submit for options years 1 and 2 going to automatically be reflected in those years’ award documents?
Answer 7: If awarded the contract, the pricing quoted for all performance periods will be reflected in the contract award document.
Question 8: What are the guidelines for any required economic price adjustments?
Answer 8: Based on market research, this solicitation does not include any Economic Price Adjustment terms and conditions.
Question 9: Is this activity considered a DOD acquisition or a general agency acquisition?
Answer 9: DLA Distribution is a Primary Level Field Activity (PLFA) of the Defense Logistics Agency. This is considered a DoD acquisition.
Question 10: What is the required material and associated material gauge for each item?
Answer 10: There is no Government required specification for these packing list envelopes in regards to required material or associated material gauge. Detailed descriptions of the required packing list envelopes are provided in the solicitation under the Schedule of Supplies and Services.
Question 11: Would you be able to confirm what the current price is on both sizes?
Answer 11: No, unit pricing will not be provided as this cannot be released/disclosed.
Question 12: Would it be possible to get a couple samples of both sizes to ensure we are quoting you exactly the same product you are currently using and to ensure it matches the description of what is listed on the bid? We will test them and ensure they match the spec in the bid and let you know if we feel they are slightly different then what is listed.
Answer 12: No, samples will not be provided. Detailed descriptions of the packing list envelopes required are provided in the solicitation under the Schedule of Supplies/Services.
4. All other terms and conditions of the solicitation remain unchanged.
