BUY AMERICAN ACT REQUIRMENT
NOTICE OF BUY AMERICAN ACT REQUIREMENT-- CONSTRUCTION
MATERIALS UNDER TRADE AGREEMENTS (JAN 2005)
(a) Definitions. ``Construction material,'' ``designated country construction material,'' ``domestic construction material,'' and ``foreign construction material,'' as used in this provision, are defined in the clause of this solicitation entitled ``Buy American Act--Construction Materials Under Trade Agreements'' (Federal Acquisition Regulation (FAR) clause 52.225-11).
(b) Requests for determination of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American Act should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of FAR clause 52.225-11 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American Act before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American Act, based on claimed unreasonable cost of domestic construction materials, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(4)(i) of FAR clause 52.225-11.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material, other than designated country construction material, that is not listed by the Government in this solicitation in paragraph (b)(3) of FAR clause 52.225-11, the offeror also may submit an alternate offer based on use of equivalent domestic or designated country construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of FAR clause 52.225-11 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of FAR clause 52.225-11 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic or designated country construction material, and the offeror shall be required to furnish such domestic or designated country construction material. WORK SUMMARY and SPECIAL REQUIREMENTS
PART 1 GENERAL
1.1 WORK COVERED BY CONTRACT DOCUMENTS
1.1.1 Project Description
Scope of work:
Replace Transformer
1. Remove Transformer (Mechanical - W/8A) located south of building 100.
2. Existing Transformer specifications: 750 KVA, 12470/480V, 3 phase, ABB style FL5E773VNT, serial number 90J689104. Existing transformer shall be removed off site and disposed as per applicable environmental codes and comply with depot environmental section requirements.
3. Before removing transformer, remove existing 480V, 400A, 3P circuit breaker (Westinghouse Catalog # LA3400F) in the above mentioned existing transformer cabinet. Handover this circuit breaker to depot maintenance department (CGA). Remove cable splice and remove circuit breaker line side 3- 350 KCMIL cables (about 6 ft.). Remove circuit breaker load side 3- 350 KCMIL and 1-350KCMIL cable (about 65 ft.)
feeding panel MDPN located in mechanical room in building 100. After removal of cables and re-splicing existing cables there should be only one circuit going from pull box below existing transformer to panel
NDP.
4. Install 225A, 600V, 3P circuit breaker (Schneider Electric or equal) in panel MDPC and connect the new feed to panel MDPN. Refer to drawing
E 10.5 for panel location.

5. Install new 4-350 KCMIL, 600Vcables (Okonite or equal) and 1-3 inch
RGS conduit from panel MDPC to MDPN located in mechanical room in building 100 (about 25’). Refer drawing E 10.5 for panel location.
6. Remove above ground one 3-inch conduit (about 3 ft.) feeding panel
MDPN. Cap underground conduit and install knockout in panel MDPN.
Refer drawing E 10.5 for panel location.
7. Install GI sheet to cover and bolt the old transformer opening in the transformer junction box with the steel sheet of same thickness as of existing manhole. Remove rust/oil/stain from the entire junction box
(inside- out) and paint it to match the existing color and quality.
8. Install new transformer pad at the location shown in the drawing E
10.4. Transformer pad shall be built as per drawing E 6.1 detail XDE and drawing E 6.2 detail XPAD. Contractor shall verify all conduits stub out details to ensure that they match with the government-supplied transformer.
9. Install government supplied transformer; 750KVA, 12470/480V 3 phase, Howard Industries, serial number 9189490017067.
10. Install one underground conduit 4” PVC schedule 40 enclosed in concrete from pole # W/8 to new transformer pad as shown in drawing E
10.4 detail A. Conduit duct bank details are shown in drawing E 6.3 detail CTE. All trenches shall be backfilled with 95% compaction.
11. Remove existing 3#2 15KV, 1#6 GND cable from existing pull box #
2 to pole W/8 up to 12 KV line as per drawing E 10.2. Cap this conduit at both ends. Use existing pole riser and install new 3#2 15KV, 1#6
GND (Okonite or approved equal) from 12 KV line to new transformer through new 4” conduit in concrete as per drawing E 10.4. Existing pole and riser details are shown in drawing E 5.4 detail RF/E5.4.

12. Intercept two 6” conduits and install new concrete pull box 3 ft.
x 3 ft. at the location shown in the drawing E 10.4 detail A, Christy or approved equal. Pull box shall be heavy-duty traffic rated. Pull box location shown in the drawing is approximate. Contractor shall provide professional underground utility identification services to verify location of existing conduits and get government approval before installing pull box.
13. Identify conduit carrying cable feeding power from old transformer pull box to ATS#2. Intercept this conduit and remove these cables from old transformer pull box to ATS#2. Do not intercept conduit feeding power from ATS#2 to old transformer pull box.
14. Install one 6 inch PVC schedule 40 underground conduit from new transformer pad to new pull box as per details shown in drawing E 10.4 detail A and E 6.3 detail CT. All trenches shall be backfilled with
95% compaction.
15. Install 6-750KCMIL, 2-500KCMIL, 600V THHN (Okonite or approved equal) and 1- 2/0 GND from new transformer to ATS#2 through new pull box.
16. Remove and dispose old transformer from government premises as per all applicable environmental regulations. Coordinate with depot environmental section and get approval prior to shipping the old transformer from Tracy Defense Depot.
General Requirements
17. Provide one portable 750 KVA, 480V, 3PH backup generator and required wires during all power interruptions to building 100.
Portable generator must be certified by San Joaquin Valley Air
Pollution Control District.

18. All high voltage work shall be done by a certified high voltage electrician with a minimum of five years of similar work.
19. All extra dirt from trenching and foundation excavation shall be hauled away and disposed as per applicable local and federal regulations.
20. Proper PPE must be used to open or access any live distribution panels/cabinets. Coordinate with facility electrical engineer to select appropriate PPE arc flash rating.
21. All cables, hardware or any other material removed in the project shall be disposed as per local and federal environmental codes without any obligation to the government.
22. All crane/forklift operators and operations shall be as USACE standards.
23. Provide four sets of full size and four sets of 11 x 17 as built drawings. Provide three sets of latest version of CAD and PDF as built drawings on CD. No existing CAD drawings are available.
24. Contractor to field verify all details shown in the attached drawings.
25. Contractor shall submit shop drawings/product catalogs for approval prior to any construction.
26. Any power outage to building 100 shall require a minimum notice of 30 days.
27. All work requiring power outage will be done on Sunday only.
28. All new supplied material shall be UL listed.
29. All work shall be performed as per latest NFPA and other applicable codes.

The work shall be located at the Defense Logistics Agency, Tracy, California. The exact warehouse location will be shown by the Contracting Officer.
1.2 SUBMITTALS – Section not used.
Government approval is required for the submittals with a "G" designation;
submittals without a "G" designation are for information only. The following shall be submitted in accordance with Section 013300 SUBMITTAL
PROCEDURES:
1.3 EXISTING WORK
In addition to FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements:
1.3.1 Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.
1.3.2 Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.
1.5 PROJECT PHASING PLAN
1.5.1 Electrical Outages – Potential electrical outages must occur on weekends and in accordance with specifications. Coordination with Contracting Office’s Representative (COR) must be approved in advance. Contractor to submit requests as soon as possible and provide alternate dates to accommodate critical base functions.
1.6 ENVIRONMENTAL PROTECTION
1.6.2 Disposal of Refuse
Refuse shall be disposed of off-site and in accordance with local, state and federal regulations.
1.7 CONSTRUCTION SITE MAINTENANCE
All supplies and equipment on the project site shall be stored so as to preclude mechanical and climatic damage. The project site shall be maintained in a neat and orderly manner.
1.8 NOISE CONTROL
The Contractor shall comply with all applicable state and local laws, ordinances and regulations relative to noise control.
1.9 SECURITY
The Contractor shall provide adequate protection for all parts of the building wherever work under this contract is performed.

1.9.1 Cameras
Possession or use of cameras on Government property is forbidden without prior written approval by the Security Officer or his designated representative. Requests for possession and/or use of cameras on Government property shall be in writing to the Security Office via the Contracting Officer and contain sufficient information to provide requirements for the use of photographic equipment. The use of cell phones equipped with cameras is also forbidden. The government will review daily and delete any pictures taken on a personal camera of government property of any kind taken while on-site at the DDSP.
1.10 EQUIPMENT ON THE PROJECT SITE
The Contractor shall cover equipment that is to remain in place within the area of contract operations and protect it against damage or loss. The Contractor shall store equipment that is removed in performance of work where directed or reuse in work as required by drawings and specifications.
Equipment temporarily removed shall be protected, cleaned and replaced equal to its condition prior to starting work. Security for equipment or material that is to be reused and is removed for temporary storage shall be the sole responsibility of the Contractor.
1.11 TRUCKING
The Contractor shall load all trucks leaving the site with loose debris in a manner that will prevent dropping of materials on streets. The Contractor shall fasten suitable tarpaulins over the load before they enter surrounding streets.
1.12 TOILET FACILITIES
Unless otherwise stated in the Request for Proposal, Contractor's personnel will be permitted to use toilet facilities on the premises subject to regulation and control of the Contracting Officer or his designated representative.
1.14 SAFETY AND HEALTH
1.14.1 General
1.14.1.1 Applicable Publications: The publications listed below form a part of this specification to the extent referenced. The publications are referred to in the text by basic designation only.
1.14.1.2 Code of Federal Regulations (CFR)
OSHA General Industry Safety and Health Standards (29 CFR 1910), Publication V2206; OSHA Construction Industry Standards (29 CFR 1926).
One source of these regulations is OSHA Publication 2207, which includes a combination of both Parts 1910 and 1926 as they relate to construction safety and health. It is for sale by the Superintendent of Documents, U.S. Government Printing Office, Washington, DC 20402.
National Emission Standards for Hazardous Air Pollutants (40 CFR, Part 61).

1.14.2 Work Covered by This Section
This section is applicable to all work covered by this contract.
1.14.3 Definition of Hazardous Materials
Refer to hazardous and toxic materials/substances included in Subparts H and Z of 29 CFR 1910; and to others as additionally defined in Fed Std
313. Those most commonly encountered include asbestos, polychlorinated biphenyls (PCBs), explosives, and radioactive material, but may include others. The most likely products to contain asbestos are sprayed-on fireproofing, insulation, boiler lagging, and pipe covering.
1.14.5 Safety Assurance
1.14.5.1 Preconstruction Safety Meeting: Representatives of the Contractor shall meet with the Contracting Officer and his representative(s) prior to the start of repair, alteration or construction activities for the purpose of reviewing the Contractor's safety and health programs and discussing implementation of all safety and health provisions pertinent to the work to be performed under the contract. The Contractor shall be prepared to discuss, in detail, the measures he intends to take in order to control any unsafe or unhealthy conditions associated with the work to be performed under the contract.
This meeting may be held in conjunction with the preconstruction conference if so directed by the Contracting Officer. The conduct of the meeting is not contingent upon a general preconstruction meeting.
The level of detail for the safety meeting is dependent upon the nature of the work and the potential inherent hazards. The Contractor's principal on-site representative(s), the general superintendent and his safety representative(s) shall attend this meeting.
1.14.5.2 Compliance With Regulations: All work, including the handling of hazardous materials or the disturbance or dismantling of structures containing hazardous materials shall comply with the applicable requirements of 29 CFR 1926/1910. Work involving the disturbance or dismantling of asbestos or asbestos containing materials; the demolition of structures containing asbestos; and/or the disposal and removal of asbestos, shall also comply with the requirements of 40 CFR, Part 61, Subparts A and B, ETL 1110-1-118 and DA Circular 40-83-4. All work shall comply with applicable state and municipal safety and health requirements. Where there is a conflict between applicable regulations, the most stringent shall apply.
1.14.5.3 Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with all applicable regulations pertaining to the health and safety of personnel during the execution of work, and shall hold the Government harmless for any action on his part or that of his employees or subcontractors, which results in illness, injury or death.
1.14.5.4 Inspections, Tests and Reports: The required inspections, tests and reports made by the Contractor, subcontractors, specially trained

technicians, equipment manufacturers, and others as required, shall be at the Contractor's expense for line items used during the contract.
1.14.5.4.1 Materials and Equipment: Special features, devices, equipment, clothing and similar items used by the Contractor in the execution of work shall comply with the applicable regulations.
1.14.5.4.2 Hazardous Materials: The Contractor shall bring to the attention of the
Contracting Officer any material suspected of being hazardous which he encounters during execution of the work. A determination will be made by the Contracting Officer as to whether the Contractor shall perform tests to determine if the material is hazardous. If the Contracting Officer directs the Contractor to perform tests, and/or if the material is found hazardous and additional protective measures are needed, a contract change may be required subject to equitable adjustment under the terms of the contract.
1.14.6 Recording and Preserving Historical and Archeological Finds
All items having an apparent historical or archeological interest which are discovered in the course of any construction activities shall be carefully preserved. The Contractor shall leave the archeological find undisturbed and shall immediately report the find to the Contracting Officer so that the proper authorities may be notified.
1.14.7 Contractor Staff
The Contractor shall be required to maintain a qualified Engineering staff and a dedicated Quality Control position to respond to requirements set forth in this solicitation.
1.14.8 Utilities (Work Related)
1.14.8.1 When available, water and electrical services may be used in this work at no cost to the Contractor. The Contractor shall make arrangements for such services with the Contracting Officer or his designated representative.
1.14.8.2 All temporary outages of any utility services required for the performance of work shall be scheduled with the Contracting Officer's Representative (COR) no less than two weeks in advance of such outages unless otherwise specified in the Task Order.
1.14.9 Standards of Conduct
All Defense Logistics Agency (DLA), Higher Headquarters and Depot regulations pertaining to conduct shall be adhered to by Contractor personnel. Good conduct and judgment is expected of all people entering the installations. Fighting, profane language, reckless driving or failure to respond to direct orders from any depot employee acting in an official capacity (i.e., Security Guards or Firemen) shall be sufficient reason to remove the disorderly individual from the Depot. A list of Depot rules and regulations will be provided to the Contractor during the preconstruction meeting by the Security Office representative.
1.14.10 Additional Requirements
Refer to Section 013529 SAFETY AND OCCUPATIONAL HEALTH REQUIREMENTS.

1.15 SHOP DRAWING REQUIREMENTS
The Contractor will be required to bring all shop drawings to the preconstruction meeting. This meeting will be scheduled a few weeks after award to allow the Contractor time to assemble the shop drawings. Shop drawings not provided at the preconstruction meeting are to be identified in the project submittal schedule.
1.16 BUY RECYCLE PROGRAM – N/A
1.17 PAYMENTS AND SCHEDULE OF VALUES
1.17.1 Schedule of Values
The Contractor shall submit a schedule of values of the Work including quantities and unit prices, aggregating the Contract Price. This provision applies to lump sum contracts and to lump sum items in unit price contracts. This schedule shall be satisfactory in form and substance to the Contracting Officer and shall subdivide the Work into component parts in sufficient detail to serve as the basis for progress payments during construction. As a minimum, this schedule shall include aggregates for inspection/testing, flushing, and system repair (including final system test) effort broken down by building. Upon approval of the schedule of values by the Contracting Officer, it shall be incorporated into the form of application for payment furnished to the Contracting Officer. The schedule shall indicate the percent of work completed for each component during the payment period. No payments will be made until the schedule of values has been submitted and approved by the Contracting Officer.
1.17.2 Application for Payment
The date for presentation of monthly applications for progress payments to the Depot shall be established at the preconstruction conference and will govern all such applications unless modified by the Depot and the Contractor at least twenty days prior thereto.
1.18 CONSTRUCTION PROGRESS SCHEDULE
The Contractor shall prepare and submit a construction progress schedule in accordance with Section 013201, PROJECT SCHEDULE.

WORK RESTRICTIONS
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for Contractor Quality Control approval. The following shall be submitted in accordance with Section
01330 SUBMITTAL PROCEDURES:

1.2 SPECIAL SCHEDULING REQUIREMENTS
1.2.1 The DDJC will remain in operation during the entire construction period.
This facility is in operation 24 hours a day, 6 days a week, year around.
The Contractor shall conduct his operations so as to cause the least possible interference with normal operations at this facility.
1.2.2 Permission to interrupt any roads on this base and/or utility services shall be requested in writing a minimum of 14 calendar days prior to the desired date of interruption.
1.2.3 The work under this contract requires special attention to the scheduling and conduct of the work in connection with existing operations and other projects that may be underway concurrently with this project. Identify on the construction schedule each factor which constitutes a potential interruption to operations or other projects.
1.2.4 Work will be phased to reduce interruption to mission and office functions.
1.3 CONTRACTOR ACCESS AND USE OF PREMISES
1.3.1 Activity Regulations
Ensure that Contractor personnel employed and working on this Defense Depot become familiar with and obey Defense Depot regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and egress. To minimize traffic congestion, delivery of materials shall be outside of peak traffic hours (6:30 to 8:00 a.m. and 3:30 to 5:00 p.m.) unless otherwise approved by the Contracting Officer. Wear hard hats in all construction areas and in other designated areas. Do not enter any RESTRICTED areas unless required to do so and until cleared for such entry. The Contractor's equipment shall be conspicuously marked for identification.
1.3.2 Working Hours
Regular working hours shall consist of a 9-hour period established by the Contracting Officer, normally Monday through Friday, 7:00 a.m. to 3:30 p.m., excluding Government holidays.
1.3.3 Work Outside Regular Hours
Work outside regular working hours requires Contracting Officer approval.
Make application 7 calendar days prior to such work to allow arrangements to be made by the Government for inspecting the work in progress, giving
Page 2/3 the specific dates, hours, location, type of work to be performed, contract number and project title. Based on the justification provided, the Contracting Officer may approve work outside regular hours. During periods of darkness, the different parts of the work shall be lighted in a manner approved by the Contracting Officer. Make utility cutovers after normal working hours or on Saturdays, Sundays, and Government holidays unless directed otherwise.
1.3.4 Occupied and Existing Buildings
The Contractor shall be working in existing buildings and around existing buildings which are occupied. The existing buildings and their contents shall be kept secure at all times.
1.3.5 Utility Cutovers and Interruptions
1.3.5.1 Make utility cutovers and interruptions after normal working hours or on Saturdays, Sundays, and Government holidays. Conform to procedures required in the paragraph "Work Outside Regular Hours."
1.3.5.3 Operation of Station Utilities: The Contractor shall be responsible for the operation of control devices in the DDJC utilities system, including water, sewer, electrical, and steam services. The Government will provide supervision and direct which control devices to operate. The Contractor shall not operate control devices except when the COR is present. The Contractor shall notify the Contracting Officer giving reasonable advance notice when such operation is required.
1.4 SECURITY REQUIREMENTS
1.4.1 Personnel and Vehicle Security
1.4.1.1 Commercial Vehicles
Vehicle passes will be issued for both contractor personal vehicles and for each commercial vehicle required for the job, authorizing entry and parking within the DDJC. Every vehicle entering the DDJC will display the pass on the dashboard or visor (facing outward). The pass will be visible at all times while in the DDSP. Parking is limited to those areas that are specifically identified on the pass. If additional passes are required, present adequate justification to the Pass and ID Office via the Contracting Officer.
1.4.1.2 Parking
Do not park on or block the marked fire lanes or crane rail traveling zones (marked in yellow) at any time. An exception may be made for vehicles which are part of the equipment needed to do the required work.
1.4.1.3 Vehicle Searches
Vehicles are subject to search while entering, remaining in, or leaving the Depot. Methods of search include, but are not limited to visual search and search by trained canine.

Contractor personnel will not be permitted to enter Depot buildings, spaces, and areas not covered by this contract except on prior approval of the Depot department/office/shop having jurisdiction of the areas.
Coordinate action with the Contracting Officer to obtain such entry approval.
Contractor employees will be allowed to use the following DDJC cafeterias during normal hours of operation:

1.4.1.5 Identification Badges - comply with the following:
1.4.1.5.1 Submit a Visit Request for each person that will be required to work on-site to the Security Officer via the Contracting Officer at least 1 week prior to the start date. Request forms will be provided by the Contracting Officer or the COR.
1.4.1.5.2 Contract employees and representatives requiring access are U.S.
citizens or legal residents of U.S.
1.4.1.5.3 Under no circumstances shall contractor personnel hand carry their own visit request.
1.4.1.5.4 Contract employees shall provide documented proof of U.S. citizenship or legal residency to the Pass and ID Office prior to being issued a Depot badge.
1.4.1.5.5 Contract employees shall be available for interviews upon request by the Depot Security Specialist.
1.4.1.5.6 Contract employees shall wear and display the Depot badge at all times while entering, remaining in, and exiting Depot spaces and each badge shall be used only by the specific individual named on the badge.
1.4.1.5.7 Maintain strict accountability over identification badges and passes issued by the Pass and ID Office both on and off base. Return badges/passes to the Pass Office immediately upon termination of any employee, expiration, completion of contract, or when no longer required.
1.4.2 Photographs
Photography is prohibited on the Depot. When operationally required, submit a written request containing specific justification and details to the Security Officer via the COR.

1.2 QUALIFICATIONS
The Contractor shall designate an authorized representative who shall be responsible for the preparation of all required project schedule reports.

PART 3 EXECUTION
3.1 GENERAL REQUIREMENTS
Pursuant to the Contract Clause, SCHEDULE FOR CONSTRUCTION CONTRACTS, a Project Schedule as described below shall be prepared. The scheduling of construction shall be the responsibility of the Contractor. Contractor management personnel shall actively participate in its development.
Subcontractors and suppliers working on the project shall also contribute in developing and maintaining an accurate Project Schedule. The approved Project Schedule shall be used to measure the progress of the work, to aid in evaluating time extensions, and to provide the basis of all progress payments. The Project Schedule shall be manpower loaded.
3.2 BASIS FOR PAYMENT
The schedule shall be the basis for measuring Contractor progress. Lack of an approved schedule or scheduling personnel will result in an inability of the Contracting Officer to evaluate Contractor=Contractor's progress for the purposes of payment. Failure of the Contractor to provide all information, as specified below, shall result in the disapproval of the entire Project Schedule submission and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes. In the case where Project Schedule revisions have been directed by the Contracting Officer and those revisions have not been included in the Project Schedule, then the Contracting Officer may hold retainage up to the maximum allowed by contract, each payment period, until revisions to the Project Schedule have been made.
3.3 PROJECT SCHEDULE
The computer software system utilized by the Contractor to produce the Project Schedule shall be capable of providing all requirements of this specification. Failure of the Contractor to meet the requirements of this specification shall result in the disapproval of the schedule. Manual methods used to produce any required information shall require approval by the Contracting Officer.
3.3.1 Use of the Critical Path Method
The Critical Path Method (CPM) of network calculation shall be used to generate the Project Schedule. The Contractor shall provide the Project Schedule in either the Precedence Diagram Method (PDM).
3.3.2 Level of Detail Required

The Project Schedule shall include an appropriate level of detail. Failure to develop or update the Project Schedule or provide data to the Contracting Officer at the appropriate level of detail, as specified by the Contracting Officer, shall result in the disapproval of the schedule. The Contracting Officer will use, but is not limited to, the following conditions to determine the appropriate level of detail to be used in the Project Schedule.
3.3.2.1 Activity Duration
Contractor submissions shall follow the direction of the Contracting Officer regarding reasonable activity durations. Reasonable durations are those that allow the progress of activities to be accurately determined between payment periods (usually less than 2 percent of all non-procurement activities' Original Durations are greater than 20 days).
3.3.2.2 Procurement Activities
Tasks related to the procurement of long lead materials or equipment shall be included as separate activities in the project schedule. Long lead materials and equipment are those materials that have a procurement cycle of over 90 days. Examples of procurement process activities include, but are not limited to: submittals, approvals, procurement, fabrication, and delivery.
3.3.2.3 Government Activities
Government and other agency activities that could impact progress shall be shown. These activities include, but are not limited to: approvals, inspections, utility tie-in, Government Furnished Equipment (GFE) and Notice to Proceed (NTP) for phasing requirements.
3.3.2.4 Responsibility
All activities shall be identified in the project schedule by the party responsible to perform the work. Responsibility includes, but is not limited to, the subcontracting firm, contractor work force, or government agency performing a given task. Activities shall not belong to more than one responsible party. The responsible party for each activity shall be identified by the Responsibility Code.
3.3.2.5 Work Areas
All activities shall be identified in the project schedule by the work area in which the activity occurs. Activities shall not be allowed to cover more than one work area. The work area of each activity shall be identified by the Work Area Code.
3.3.2.6 Modification or Claim Number
Any activity that is added or changed by contract modification or used to justify claimed time shall be identified by a mod or claim code that changed the activity. Activities shall not belong to more than one modification or claim item. The modification or claim number of each activity shall be identified by the Mod or Claim Number. Whenever possible, changes shall be added to the schedule by adding new activities.
Existing activities shall not normally be changed to reflect modifications.
3.3.2.7 Bid Item
All activities shall be identified in the project schedule by the Bid Item to which the activity belongs. An activity shall not contain work in more than one bid item. The bid item for each appropriate activity shall be identified by the Bid Item Code.
3.3.2.8 Phase of Work
All activities shall be identified in the project schedule by the phases of work in which the activity occurs. Activities shall not contain work in more than one phase of work. The project phase of each activity shall be by the unique Phase of Work Code.
3.3.2.9 Category of Work
All Activities shall be identified in the project schedule according to the category of work which best describes the activity. Category of work
Page 5/10 refers, but is not limited, to the procurement chain of activities including such items as submittals, approvals, procurement, fabrication, delivery, installation, start-up, and testing. The category of work for each activity shall be identified by the Category of Work Code.
3.3.2.10 Feature of Work
All activities shall be identified in the project schedule according to the feature of work to which the activity belongs. Feature of work refers, but is not limited to a work breakdown structure for the project. The feature of work for each activity shall be identified by the Feature of Work Code.
3.3.3 Scheduled Project Completion
The schedule interval shall extend from NTP to the contract completion date.
3.3.3.1 Project Start Date
The schedule shall start no earlier than the date on which the NTP was acknowledged. The Contractor shall include as the first activity in the project schedule an activity called "Start Project". The "Start Project" activity shall have an "ES" constraint date equal to the date that the NTP was acknowledged, and a zero day duration.
3.3.3.2 Constraint of Last Activity
Completion of the last activity in the schedule shall be constrained by the contract completion date. Calculation on project updates shall be such that if the early finish of the last activity falls after the contract completion date, then the float calculation shall reflect a negative float on the critical path. The Contractor shall include as the last activity in the project schedule an activity call "End Project". The "End Project" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.
3.3.3.3 Early Project Completion
In the event the project schedule shows completion of the project prior to the contract completion date, the Contractor shall identify those activities that have been accelerated and/or those activities that are scheduled in parallel to support the Contractor's "early" completion.
Contractor shall specifically address each of the activities noted in the narrative report at every project schedule update period to assist the Contracting Officer in evaluating the Contractor's ability to actually complete prior to the contract period.
3.3.4 Interim Completion Dates
Contractually specified interim completion dates shall also be constrained to show negative float if the early finish date of the last activity in that phase falls after the interim completion date.
3.3.4.1 Start Phase
The Contractor shall include as the first activity for a project phase an activity called "Start Phase X" where "X" refers to the phase of work. The "Start Phase X" activity shall have an "ES" constraint date equal to the date that the NTP was acknowledged, and a zero day duration.
3.3.4.2 End Phase
The Contractor shall include as the last activity in a project phase an activity called "End Phase X" where "X" refers to the phase of work. The "End Phase X" activity shall have an "LF" constraint date equal to the completion date for the project, and a zero day duration.
3.3.4.3 Phase X
The Contractor shall include a hammock type activity for each project phase called "Phase X" where "X" refers to the phase of work. The "Phase X" activity shall be logically tied to the earliest and latest activities in the phase.
3.3.5 Default Progress Data Disallowed
Actual Start and Finish dates shall not be automatically updated by default mechanisms that may be included in CPM scheduling software systems. Actual Start and Finish dates on the CPM schedule shall match those dates provided
Page 6/10 from Contractor Quality Control Reports. Failure of the Contractor to document the Actual Start and Finish dates on the Daily Quality Control report for every in-progress or completed activity, and failure to ensure that the data contained on the Daily Quality Control reports is the sole basis for schedule updating shall result in the disapproval of the Contractor's schedule and the inability of the Contracting Officer to evaluate Contractor progress for payment purposes. [Updating of the percent complete and the remaining duration of any activity shall be independent functions. Program features which calculate one of these parameters from the other shall be disabled.]
3.3.6 Out-of-Sequence Progress
Activities that have posted progress without all preceding logic being satisfied (Out-of-Sequence Progress) will be allowed only on a case-by-case approval of the Contracting Officer. The Contractor shall propose logic corrections to eliminate all out of sequence progress or justify not changing the sequencing for approval prior to submitting an updated project schedule.
3.3.7 Negative Lags
Lag durations contained in the project schedule shall not have a negative value.
3.4 PROJECT SCHEDULE SUBMISSIONS
The Contractor shall provide the submissions as described below. The data disk, reports, and network diagrams required for each submission are contained in paragraph SUBMISSION REQUIREMENTS.
3.4.1 Preliminary Project Schedule Submission
The Preliminary Project Schedule, defining the Contractor's planned operations for the first 60 calendar days shall be submitted for approval within 14 calendar days after the NTP is acknowledged. The approved preliminary schedule shall be used for payment purposes not to exceed 180 calendar days after NTP.
3.4.2 Initial Project Schedule Submission
The Initial Project Schedule shall be submitted for approval within 40 calendar days after NTP. The schedule shall provide a reasonable sequence of activities which represent work through the entire project and shall be at a reasonable level of detail.
3.4.3 Periodic Schedule Updates
Based on the result of progress meetings, specified in "Periodic Progress Meetings," the Contractor shall submit periodic schedule updates. These submissions shall enable the Contracting Officer or to assess Contractor's progress. If the Contractor fails or refuses to furnish the information and project schedule data, which in the judgement of the Contracting Officer or authorized representative, is necessary for verifying the contractor's progress, the Contractor shall be deemed not to have provided an estimate upon which progress payment may be made.
3.4.4 Standard Activity Coding Dictionary
The Contractor shall use the activity coding structure defined in the Standard Data Exchange Format (SDEF) in ER 1-1-11, Appendix A. This exact structure is mandatory, even if some fields are not used.
3.5 SUBMISSION REQUIREMENTS
The following items shall be submitted by the Contractor for the preliminary submission, initial submission, and every periodic project schedule update throughout the life of the project:
3.5.1 Data Disk
Two data disks containing the project schedule shall be provided. Data on the disks shall adhere to the SDEF format specified in ER 1-1-11, Appendix A.

3.5.1.1 File Medium
Required data shall be submitted on a CD
3.5.1.2 Disk Label
A permanent exterior label shall be affixed to each CD submitted. The label shall indicate the type of schedule (Preliminary, Initial, Update, or Change), full contract number, project name, project location, data date, name and telephone number of person responsible for the schedule.
3.5.1.3 File Name
Each file submitted shall have a name related to either the schedule data date, project name, or contract number. The Contractor shall develop a naming convention that will ensure that the names of the files submitted are unique. The Contractor shall submit the file naming convention to the Contracting Officer for approval.
3.5.2 Narrative Report
A Narrative Report shall be provided with the preliminary, initial, and each update of the project schedule. This report shall be provided as the basis of the Contractor's progress payment request. The Narrative Report shall include: a description of activities along the 2 most critical paths, a description of current and anticipated problem areas or delaying factors and their impact, and an explanation of corrective actions taken or required to be taken. The narrative report is expected to relay to the Government, the Contractor=Contractor's thorough analysis of the schedule output and its plans to compensate for any problems, either current or potential, which are revealed through that analysis.
3.5.3 Approved Changes Verification
Only project schedule changes that have been previously approved by the Contracting Officer shall be included in the schedule submission. The Narrative Report shall specifically reference, on an activity by activity basis, all changes made since the previous period and relate each change to documented, approved schedule changes.
3.5.4 Schedule Reports
The format for each activity for the schedule reports listed below shall contain: Activity Numbers, Activity Description, Original Duration, Remaining Duration, Early Start Date, Early Finish Date, Late Start Date, Late Finish Date, Total Float. Actual Start and Actual Finish Dates shall be printed for those activities in progress or completed.
3.5.4.1 Activity Report
A list of all activities sorted according to activity number.
3.5.4.2 Logic Report
A list of Preceding and Succeeding activities for every activity in ascending order by activity number. Preceding and succeeding activities shall include all information listed above in paragraph Schedule Reports.
A blank line shall be left between each activity grouping.
3.5.4.3 Total Float Report
A list of all incomplete activities sorted in ascending order of total float. Activities which have the same amount of total float shall be listed in ascending order of Early Start Dates. Completed activities shall not be shown on this report.
3.5.4.4 Earnings Report
A compilation of the Contractor's Total Earnings on the project from the NTP until the most recent Monthly Progress Meeting. This report shall reflect the Earnings of specific activities based on the agreements made in the field and approved between the Contractor and Contracting Officer at the most recent Monthly Progress Meeting. Provided that the Contractor has provided a complete schedule update, this report shall serve as the basis of determining Contractor Payment. Activities shall be grouped by bid item and sorted by activity numbers. This report shall: sum all activities in a bid item and provide a bid item percent; and complete and sum all bid
Page 8/10 items to provide a total project percent complete. The printed report shall contain, for each activity: the Activity Number, Activity Description, Original Budgeted Amount, Total Quantity, Quantity to Date, Percent Complete (based on cost), and Earnings to Date.
3.5.5 Network Diagram
The network diagram shall be required on the initial schedule submission and on monthly schedule update submissions. The network diagram shall depict and display the order and interdependence of activities and the sequence in which the work is to be accomplished. The Contracting Officer will use, but is not limited to, the following conditions to review compliance with this paragraph:
3.5.5.1 Continuous Flow
Diagrams shall show a continuous flow from left to right with no arrows from right to left. The activity number, description, duration, and estimated earned value shall be shown on the diagram.
3.5.5.2 Project Milestone Dates
Dates shall be shown on the diagram for start of project, any contract required interim completion dates, and contract completion dates.
3.5.5.3 Critical Path
The critical path shall be clearly shown.
3.5.5.4 Banding
Activities shall be grouped to assist in the understanding of the activity sequence. Typically, this flow will group activities by category of work, work area and/or responsibility.
3.5.5.5 S-Curves
Earnings curves showing projected early and late earnings and earnings to date.
3.6 PERIODIC PROGRESS MEETINGS
Progress meetings to discuss payment shall include a monthly onsite meeting or other regular intervals mutually agreed to at the preconstruction conference.
