C802.01 Statement of Work- Basic Ordering Agreement (ELECTRICITY) (RENEWABLE ENERGY CERTIFICATES) (DLA ENERGY APR 2015)
This Basic Ordering Agreement (BOA) between [Contractor Name] (Herein “Contractor”) and the Defense Logistics Agency Energy (DLA Energy) is entered into to supply requesting agencies with Renewable Energy Certificates.
a. PURPOSE: The Government will solicit REC requirements from BOA Holders to comply with Clean Energy Target requirements set forth by Executive Order- Planning for Federal Sustainability in the Next Decade dated March 19, 2015.
RECs serve the role of helping the Government lay claim to and account for the associated attributes of renewable-based generation. The Government benefits from the purchase of RECs because RECs provide flexibility to support green power when a green power product may not be available on-site or from an electricity service provider.
b. SCOPE: The BOA Holder shall submit a Supply Plan for the RECs solicited in Schedule B when pricing is requested. See Attachment XX- Pricing and Supply Plan. Once a binding contract is in place, the Government will use the Supply Plan for inspection and acceptance of RECs. If a REC is from a source not listed on the Supply Plan, the Government will not accept the REC.
RECs must be verifiable. In other words, the RECs must be trackable from the point of generation to the point of final use in order to prevent “double sales.”
BOA Holders shall also be cognizant of the Vintage, or date of REC creation. The Government requires that the renewable attributes represented by a REC are generated within that vintage year. I.e. up to six months prior to that vintage year or up to three months after the vintage year. RECs shall be generated within the following date ranges for FY15-FY19:
| Fiscal Year |
| Qualifying Vintage Dates* |
| 2015 |
| July 1, 2014 to March 31, 2016 |
| 2016 |
| July 1, 2015 to March 31, 2017 |
| 2017 |
| July 1, 2016 to March 31, 2018 |
| 2018 |
| July 1, 2017 to March 31, 2019 |
| 2019 |
| July 1, 2018 to March 31, 2020 |
c. REQUIREMENTS/ DELIVERABLES:
Any resultant Purchase Order offered to and accepted by a BOA Holder will require the delivery of RECs specified in Section B- The Schedule. Satisfactory delivery of RECs shall include the following documentation:
1. REC Attestations- to be completed by the generator and BOA Holder
2. REC Certificate of Transfer
3. Third-party Verification Audit
The documentation listed above shall be reviewed by the Government for acceptance. The documentation will allow the Government to: 1. Verify the REC(s) came from an acceptable source listed on the Supply Plan; 2. Identify the RECs were generated in accordance with the Qualifying Vintage Dates; and 3. Ensure the RECs include all the required renewable attributes and have not been sold to another party or in a secondary market.
For “verification,” a third-party audit shall be performed. At a minimum, the annual audit report must be performed by a Certified Public Accountant within 30 calendar days after the end of the delivery period. In the event additional time is required in order to submit the annual audit report, please indicate the number of days required on Attachment [Insert Name]. Any exceptions to the 30 calendar day requirement will be subject to DLA Energy Government’s approval. The audit report shall focus on the following areas of reporting as identified below:
1. An affidavit attesting that the REC product content for the past calendar year was sufficiently generated in order to meet the quantity, renewable type, vintage and on-line date identified in Section B.
| 2. An affidavit that-- | |
| i. The offeror has not sold and will not sell the renewable power twice (as either a renewable power product or as a REC product), and in the case of a reseller that purchases a wholesale product for retail sale, reasonable measure are taken to ensure that suppliers also do not sell renewable power more than once; | |
| ii. The seller has transferred to the Requisite Customer (or has permanently retired on behalf of the Requisite Customer) the right to all emission reduction credits/allowances directly attributable to the generating unit from which the RECs are based and to which the generator is entitled, without the emission credits/allowances having been sold off separately and/or used for compliance with any local, state, or Federal Government regulatory requirement. At a minimum, NOx, SOx, and greenhouse gas credits/allowances must be transferred or retired on behalf of the Requisite Customer. | |
| iii. The offeror has not sold and will not sell any emission allowances/credits, or other environmental attributes associated with renewable power/RECs; and | |
| iv. The renewable power/REC that is used to fulfill the requirement of this solicitation are also not being used and will not be used to meet any Federal, state, or local renewable energy requirement, renewable energy procurement, renewable portfolio standard, or other renewable energy mandate. | |
| v. The awarded BOA Holder will forward the third party verification audit report to the Government agencies listed in Section B and note any contract deficiencies. |
Specifications for delivery and invoicing of RECs will be tailored for each solicitation issued under the BOA by an authorized ordering agency.
