7. NOTICE TO POTENTIAL SMALL BUSINESS OFFERORS: Based on an agreement between the DLA Energy and the Small Business Administration (SBA), SBA processes Certificate of Competency (COC) referrals prior to DLA Energy’s determination that a small business concern is an apparently successful offeror. Because of the multi-step nature of the evaluation process, delaying the COC referral of a non-responsible small business concern until it has been determined to be an apparently successful offeror could result in late awards, and significantly impact DLA Energy's support of the Military Services’ fuel requirements.

Registrations, representations, and certifications currently maintained electronically at the ORCA website (http://orca.bpn.gov), Centralized Contractor Registration (CCR) database (http://www.ccr.gov), and the Excluded Parties List System (EPLS)(https://epls.gov) have been switched to SYSTEM FOR AWARD MANAGEMENT (SAM) at www.sam.gov or by dialing (866) 606-8220. [SEE FAR 52.204-99 SYSTEM FOR AWARD MANAGEMENT (AUG 2012) (DEVIATION) FOR ADDITIONAL INFORMATION].

11. Payment term of “NET 10” will apply to all contracts awarded as a result of this solicitation.

12. The Secretary of the Navy has set a goal that by 2020 half of all the Department of the Navy’s energy will come from alternative sources. To support that goal, in June 2011, the Department of the Navy (DON), Department of Energy (DOE) and the Department of Agriculture (USDA), signed a memorandum of understanding (MOU) to “assist the development and support of a sustainable commercial biofuels industry.” Under the MOU, the USDA agreed to provide funding through the Commodity Credit Corporation (CCC.)

13. As part of the regular bulk procurement for Inland East Gulf, this solicitation is designed to assist the DON in meeting its goals to increase the use of biofuels. Under this solicitation, DON has a goal that 10% of its total military specification JP-5 aviation turbine fuel and F-76 naval distillate fuel requirements consist of biofuels. The revised F-76 (MIL-DTL-16884N) and JP-5 (MIL-DTL-5624V) specifications allow a maximum of 50 volume percent of the finished fuel to consist of synthesized blend components derived from the Hydroprocessed Esters and Fatty Acid (HEFA) or Fischer Tropsch (FT) conversion processes. Offerors are encouraged to submit alternative offers with a minimum of 10% of the permitted blends. (see OSP Package and Attachment 3)

14. CCC funds will be available to defray additional costs of producing biofuel and biofuel blends and are being provided as a biofuel production incentive under the CCC program to support agricultural products. To be eligible for CCC funding, the fuel must contain at least 10% biofuel, not to exceed 50% as permitted by the JP-5 and F-76 specifications. The biofuel must be refined from domestic feedstocks approved by the CCC as identified in the attached list. The CCC funds will be allocated through the Bid Evaluation Model (BEM). The biofuel production incentive will be paid for directly by the CCC, and will cover a portion of the offered price. An offeror will not be paid a price higher than its offered price.

15. Offers of alternative fuel blends must comply with Section 526 of the Energy Security and Independence Act. This means that the lifecycle greenhouse gas emissions of the alternative fuel must be equal to or less than petroleum based on either the Renewable Fuel Standards or the GREET Model.

16. The amount of the CCC funds to be applied as a biofuel production incentive (BPI) will be determined by the BEM per the evaluation provisions and separately listed in the contract. Contractors will be required to invoice the CCC directly for the BPI and the CCC will pay the BPI directly to the contractor. The contractor shall submit invoices to USDA/FSA, Budget Division, ATTN Tobye McClain – 355 E Street, SW, 11th Floor, Washington, DC 20024. The Prompt Payment Act will apply to CCC payments and these payments will not automatically be paid in Net 10.
