INFORMATION TO ALL OFFERORS

A. This is Amendment 0009 to Solicitation SP0600-08-R-0022. The terms and conditions of the referenced solicitation, as amended, are incorporated by reference except as indicated herein. Offerors shall include a statement stating: “Offeror agrees to the terms and conditions of Solicitation SP0600-08-R-0022 and all amendments thereto”.

B. All offerors must acknowledge receipt of this amendment by completing block 8 above, and signing and dating blocks 15A, 15B, and 15C and returning this document to DESC-PLB, via facsimile 703-767-8506 or email to Luis.Beza-Cay@dla.mil or Leonard.Lamm@dla.mil or DESCPLBOFFERS@dla.mil.

C. Pursuant to Clause L2.05-5 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS (PC&S), (DESC MAR 2009) offerors agree to honor pricing indicated in their offers for a period of 120 calendar days from the date specified for receipt of offers, unless another time period is specified.

D. Pursuant to Clause L2.05-5 INSTRUCTIONS TO OFFERORS-COMMERCIAL ITEMS (PC&S), (DESC MAR 2009), while the Government intends to evaluate offers in accordance with clause M72.03-1. The Government reserves the right to conduct discussions if determined by the Contracting Officer to be necessary. Therefore, participating offerors are advised to submit their best prices with their initial offer.

E. All first time offerors, to the referenced solicitation must provide written acknowledgement of all amendments by signing and returning page one (1) of the amendments to this solicitation and also must fill out Offeror Submission Package for solicitation SP0600-08-R-0022 available at:

https://www.desc.dla.mil/DCM/DCMSolic.asp?SolicID=1301.

F. Commercial and Government Entity (CAGE CODE) Reporting: Offerors are required to submit their CAGE Code number and DUNS number in Block 8 item “Bidder Code” and “CAGE Code”. Offerors that do not know their CAGE Code and/or DUNS number should call the contract specialist of record for assistance. Offerors who have not been assigned a CAGE code and/or DUNS number should insert the word “none” in the appropriate block.

G. All US offerors must be registered in the Central Contractor Registry (CCR). See Clause I10.07 for further assistance.

H. Contracts awarded as a result of this solicitation will be “Requirements Type, Fixed Price with Economic Price Adjustment”.

I. Offers submitted in response to this amendment must be in English with offer prices stated in U.S.

dollars. Offers received in other than English with offers prices other than U.S. dollars will be rejected.

J. When submitting an offer on Line Items 103-032, 104-03, 116-03, 130-28, 170-28, 170-70, 180-28, 180-70, 182- 03, 185-28, 185-70 and 700-70 the offeror must make the following certification with a signature of the individual authorized to submit an offer under the solicitation: “I,_______________________________ of ____________________________ company certify that my company understands that deliveries to these locations are by Air and that the company is certifying that we can perform at these prices for the full Ordering and Delivery Period indicated in the Solicitation (18 months).”

K. The closing date for receipt of offers is 2 April 2010, 3:00 p.m. Eastern Time.

L. AIR DELIVERY FREE TIME AND DETENTION RATES: Unless otherwise stated in the offer, free time will be unlimited.

M. The ordering period for all items awarded under this amendment will be Date of Award through 31 May 2011.

The Delivery Period is forty-eight (48) hours after the beginning of the ordering period through 30 days after the end of the ordering period.

(a) The supplies to be furnished during the period specified in the REQUIREMENTS clause, the delivery points, methods of delivery, and estimated quantities are shown below. The quantities shown are best estimates of required quantities only. Unless otherwise specified, the total quantity ordered and required to be delivered may be greater than or less than such quantities. The Government agrees to order from the Contractor and the Contractor shall, if ordered, deliver during the contract period all items awarded under this contract. The prices paid shall be the unit prices specified in subsequent price change modifications issued in accordance with the ECONOMIC PRICE ADJUSTMENT clause.

(b) In an emergency, oral orders may be issued but must be confirmed in writing via a PORTS-generated order within 24 hours or one business day. See the PAPERLESS ORDERING AND RECEIPT TRANSACTION SCREENS (PORTS) INTERNET APPLICATION clause.

(c) Offers shall not be submitted for quantities less than the estimated quantities specified below for each line item. Offers submitted for less than the estimated quantities will not be considered for award, except for items specifically designated as 18-month requirements.

The Jet A1 base reference price, rounded to the 4 th decimal place, is derived based on the following calculation:

PMV=IP=IVA+TI, as identified under the “ESTRUCTURA DEL PRECIO DEL JET A1”, as published by Ecopetrol. The Base Reference Price for all Jet A1 (-03) items is $2.4736/gl.

The Regular Unleaded Gasoline base reference price, rounded to the 4 decimal place, for the above identified items is derived by combination of the Ingreso al productor, Tarifa de Marcacion, Impuesto global, Impuesto a las ventas, Margen minorista, Transporte planta de abasto a Est. de servicio, Transporte y/o manejo, and the Sobretasa, as published in the ‘ESTRUSTURAS DE PRECIOS DE COMBUSTIBLES LIQUIDOS VIGENTES A PARTIR”, under the heading Gasolina Corriente, an Ecopetrol publication. The Base Reference Price for all Gasoline (-28) items is $3.6262/gl.

The Diesel Fuel base reference price, rounded to the 4 decimal place, for the above identified items is derived by combination of the Ingresso al productor, Tarifa del Marcaion, Impuesto global, Impuets a las ventas, Margen minorista, Transprte planta de abasto a Est. de servicio, Transporte y/o manejo and the Sobretasa, as published in the ‘ESTRUSTURAS DE PRECIOS DE COMBUSTIBLES LIQUIDOS VIGENTES A PARTIR”, under the heading A.C.P.M., an Ecopetrol publication. The Base Reference Price for all Diesel (-70) items is $2.9454 /gl.

Escalation (Price adjustments): Items awarded under this solicitation will escalate (adjust) monthly, with prices effective the first (1 st ) of the month based on the published prices listed in the Ecopetrol publications identified in A-C, above. As

Ecopetrol is a Colombian Government entity, should DESC be unable to secure a copy of the referenced publication to affect timely escalation (adjustment) of prices, the vendor will be responsible for notifying the Contracting Officer of the price adjustment (SUPPLIER NOTIFICATION), such that prices may be adjusted accordingly.

52.212-3/I/II OFFEROR REPRESENTATIONS AND CERTIFICATIONS - COMMERCIAL ITEMS

An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (c) through (m) of this provision.

(a) DEFINITIONS. As used in this provision-- Emerging small business means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract, the enforcement of which can be accomplished by process of penalties.

(4) FSG 89, Food and Related Consumables;

(6) FSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) FSC 9440, Miscellaneous Crude Agricultural, and Forestry Products;

(8) FSC 9610, Ores;

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

Service-disabled veteran-owned small business concern--

By submission of its offer, the offeror certifies to the best of its knowledge and belief that no Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress or an employee of a Member of Congress on his or her behalf in connection with the award of any resultant contract. If any registrants under the Lobbying Disclosure Act of 1995 have made a lobbying contact on behalf of the offeror with respect to this contract, the offeror shall complete and submit, with its offer, OMG Standard Form LLL, Disclosure of Lobbying Activities, to provide the name of the registrants. The offeror need not report regularly employed officers or employees of the offeror to whom payments of reasonable compensation were made.

The offeror certifies, to the best of its knowledge and belief, that--

(1) The offeror and/or any of its principals

Within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed.

A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underling tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. Sec. 362 (the Bankruptcy Code).

(i) CERTIFICATION REGARDING KNOWLEDGE OF CHILD LABOR FOR LISTED END PRODUCTS (EXECUTIVE ORDER 13126). [The Contracting Officer must list in paragraph (i)(1) any end products being acquired under this solicitation that are included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, unless excluded at 22.1503(b).]
