COMMUNITY TREATMENT SERVICES

ADVANCE PROCUREMENT PLAN

In accordance with the Federal Acquisitions Regulations (FAR) Part 7.105, this document shall serve as a class acquisition plan for the procurement of community-based substance use disorder, mental health, sex offender treatment, and medication-assisted treatment (MAT) for offenders housed in residential reentry centers (RRC) and/or home confinement with an estimated cost exceeding $2,500,000 including the base period and all option years. The class acquisition plan addresses all applicable content elements identified by the Central Office, Administration Division, Acquisitions Branch, Section Chief, Community Treatment Services Contracting

(CTSC).

A. ACQUISITION BACKGROUND AND OBJECTIVES [FAR 7.105(a)]

1. Statement of Need [FAR 7.105(a)(1)]. The Bureau is mandated by Federal Regulations 18 U.S.C. § 3621 (e), The Violent Crime Control and Law Enforcement Act (VCCLEA) to provide substance use disorder treatment aftercare services to federal offenders. As offenders complete in-prison, substance use disorder treatment programming, the Bureau ensures that offenders receive a continuum of treatment and supervision when the offender is transferred to a residential reentry center (RRC) and/or home confinement. Research has shown that with the continuum of supervision and treatment, the chances of relapse or other behavioral problems decrease dramatically, reducing the likelihood of an offender’s return to custody. In addition, the Bureau provides Medication Assisted Treatment (MAT) services and treatment for offenders diagnosed with mental health problems, and offenders identified as needing sex offender services, who transferring from a secure Bureau facility to an RRC and/or home confinement, to ensure a continuum of treatment and supervision.

2. Applicable Conditions [FAR 7.105(a)(2)]. In order to meet the increasingly complex psychological needs of the federal offender population the Bureau continues to develop its network of contracted community-based providers to ensure treatment is provided to our offenders as they transition to the community. The Community Reentry Affairs Branch is responsible for developing and maintaining community-based substance use disorder, mental health, sex offender treatment, and MAT contracts for offenders housed in an RRC and/or home confinement.

3. Cost [FAR 7.105(a)(3)]. Accurate estimates of treatment costs are essential to the procurement of community-based substance use disorder, mental health, sex offender treatment, and MAT. Estimates must be based upon an analysis of information affecting population trends and budgetary allowances. Yearly cost estimates should be based upon historical usage for the last year, rounded up to a higher number for anticipated increases in usage, multiplied by the highest reasonable cost per line item obtain during pricing market research.

4. Capability or Performance [FAR 7.105(a)(4)]. The successful quoter must be capable of providing outpatient clinical assessments, evaluations, and reports for substance use disorder, mental health, and/or sex offender treatment services, and/or MAT; substance use disorder and mental health individual, group, and parenting and relationship counseling; case management services; MAT/psychiatric evaluations and reports; MAT administration and follow-up services;

1. Staffing Requirement: The Quoter must have key personnel to meet the solicitation requirements. The Quoter must ensure all personnel providing clinical services to Bureau offenders meet the experiential, educational, and appropriate licensure/certification as required by the state authority where the services will be rendered. [SOW 5.1]

a. Submit the Technical Personnel document that identifies the position and responsibility of all personnel proposed to meet or exceed the minimum staffing requirements of key personnel in table 1a below. All key personnel and administrative positions must be identified on this document. [SOW 5.2]

b. Submit copies of current and valid professional licenses for key personnel who will provide direct clinical services to Bureau offenders. Clinical licenses submitted must be listed in table 1b below and must correspond to the respective clinical duties performed. [SOW 5.4]

i. Staff licenses for medical staff (e.g., medical doctor, physician assistant, nurse practitioner) must meet the standards of practice established by the applicable state’s professional regulatory board in the state where services will be rendered.

ii. If submitting a non-medical license that is not listed in table 1b, complete the Mental Health/Behavioral Health Professionals Scope of Practice Summary. Any licenses other than those listed below will be reviewed on a case-by-case basis.

iii. If unable to produce an original license, provide a license verification sheet with a copy of a government-issued photo identification card for the staff member.

c. Submit the Clinical Experience document for all key personnel who will be providing direct clinical services and list total clinical experience working with a criminal justice population providing substance use disorder, mental health, or sex offender treatment services.

d. Submit resumes for key personnel listed on the Clinical Experience document. Resumes must show documented experience working with a criminal justice population providing substance use disorder, mental health, or sex offender treatment services and must correspond to information submitted on the Clinical Experience document. Documented experience on a resume must include brief descriptions of the type of clinical services provided working with a criminal justice population. [SOW 5.3]

e. Psychiatric/Medication Monitoring: Submit a Drug Enforcement Agency Controlled Substance Registration Certificate for a qualified practitioner with prescriptive authority who meets the standards of practice established by the state’s professional regulatory board to provide psychiatric evaluations, medication monitoring, and if applicable, MAT services. [SOW 5.4.5]

2. Operational Requirement – Cognitive Behavioral Therapy (CBT): The Quoter must demonstrate adherence to the CBT model of treatment or other evidence-based programming compatible with CBT. [SOW 2.2]

a. Submit two cognitive behavioral methods or techniques that will be used with Bureau offenders in the delivery of Community Treatment Services (CTS). Limit response to listing the methods or techniques that will be used; do not provide explanations or descriptions of the methods or techniques, unless not a widely known form of treatment. [SOW 2.2.1]

3. Operational Requirement – Crisis Interventions: The Quoter must provide emergency crisis intervention assessments, when necessary. The Quoter must have the ability to provide a crisis intervention evaluation and submit a report, contract line item number (CLIN) 6000, within 24 hours of the request made by CTS staff. [SOW 4.3.9]

a. Identify on the Technical Personnel document which key personnel are able to conduct a comprehensive diagnostic interview and provide the written report within 24 hours of referral for emergency crisis interventions.

4. Facility Requirement – Proposed Location(s): The Quoter must provide treatment at performance sites that meet the specified restrictions, space requirements, ADA compliance guidelines, and that do not present safety risks to the community. [SOW 7.1 & 7.2.1]

a. List addresses for all proposed performance sites, including subcontractors, who will provide the services as specified in the solicitation and be within the geographic restrictions.

b. Submit a deed, lease, bill of sale, option or intent to lease, or option to buy in the name of the Quoter, or subcontractor, if applicable, for all addresses listed in 4a.

c. Provide the methods and means that will be used to ensure individual and group rooms are private and allow for confidentiality during treatment sessions. [SOW 7.1.1]

d. Submit an office diagram (see attached example) for each proposed performance site listed in 4a. The diagram must identify all rooms that will be used for counseling space and services, i.e., individual, group, or psychiatric treatment rooms, as well as space used for a waiting, lobby or reception area. The location of the restroom facilities should also be identified.

[SOW 7.1.1]

i. Specify on the office diagram the number of individuals each group room can comfortably accommodate. Therapeutic group rooms must be primarily dedicated to treatment or reserved for outpatient community treatment services.

e. Complete and submit the attached Americans with Disabilities Act (ADA) Checklist for each proposed performance site listed in 4a. [SOW 7.1.1]

f. Complete and submit the attached Local Areas of Concern document for each proposed performance site listed in 4a. This document must identify the following areas of concern that are within the geographic restrictions as specified in the solicitation. This must include the same space and/or same building, of each proposed performance site, and include a plan to mitigate risk to children and other vulnerable populations:

i. Schools, day-care centers, playgrounds, developed or improved parks, athletic fields, churches, school bus stops, and any facilities/businesses that primarily care for/educate/entertain minors or other vulnerable populations. [SOW 7.2.1]

5. (As Applicable) Facility Requirement – Facility License: The facility must be appropriately licensed and/or certified to provide all required services on, or by, the contract effective date by the state authority where services will be rendered. [SOW 7.4]

a. Submit the required state facility license and/or certification to provide all treatment services at the proposed performance site(s) listed in 4a.

i. If in the process of obtaining a valid license, submit the completed application, provisional license, official email correspondence, and/or other official documentation as proof.

Documentation must show that the Quoter may begin services on, or by, the contract effective date.

5. Delivery or Performance-Period Requirements [FAR 7.105(a)(5)]. When working with annual requirements such as a purchase order, the Request for Contract Action (RCA) shall include the anticipated dates services are to begin and end. When working with a multi-year contract, include within the RCA the date services should begin and estimate when services will end. For replacement contracts (an existing contract is expiring and the need for services continues to exist) the beginning date must not be on or earlier than the expiration date of the current contract.

6. Trade-Offs [FAR 7.105(a)(6)]. This solicitation action will be processed as a go/no-go requirement, with award made to the lowest price, responsive and responsible quoter.

7. Risks [FAR 7.105(a)(7)]. Risks to the Government are reduced to the most practical extent by awarding firm-fixed unit price requirement type contracts whenever possible. If circumstances exist which do not permit the use of a requirements type contract, an indefinite delivery/indefinite quantity type contract will be used. These contracts provide for filling all actual purchase requirements for community-based substance use disorder treatment and mental health treatment during a specified contract period at a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. This contract type places upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. It provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties.

8. Acquisition Streamlining [FAR 7.105(a)(8)]. This subpart does not apply to the procurement described by this class acquisition plan.

B. PLAN OF ACTION [FAR 7.105(b)]

1. Sources [FAR 7.105(b)(1)]. The RCA will include a list of local prospective contractors with addresses, phone numbers and contact persons. Efforts to identify multiple sources are extremely important because competition among the contracting community has proven to be impetus to obtaining fair and reasonable quotes for these services. The incumbent contractor may be included on the source list.

2. Competition [FAR 7.105(b)(2)]. Prospective sources will be sought by synopsizing the requirement on the General Services Administration's (GSA) Federal Business Opportunities website (https://www.sam.gov) in accordance with FAR 5.201. Hard copies of the solicitation document will not be available. The site provides downloading instructions.

3. Contract Type Selection [FAR 7.105(b)(3)]. Firm-fixed-price, indefinite delivery/ indefinite quantity (IDIQ) type contract will be utilized. A firm-fixed-price contract is suitable for acquiring commercial items. An IDIQ contract provides for an indefinite quantity, within stated limits, of supplies or services during a fixed period. The Government places orders for individual requirements.

4. Source-Selection Procedures [FAR 7.105(b)(4)]. All solicitations issued using full and open competitive procedures shall allow for a response time consistent with the size and complexity of the requirement. Unless urgent and compelling circumstances exist, the minimum response time required by FAR 5.203 will be provided. The evaluation process consists of assessing each quote against the standard evaluation criteria. Each quote will be judged by the same standard, assessing only those items which have been identified in the solicitation. Each quote will then be ranked in relationship to the other quotes submitted. Evaluation factors will be tailored to each acquisition and shall include only those factors that are considered integral for achieving the objectives of the quote.

5. Acquisition Considerations [FAR 7.105(b)(5)]. The Bureau is mandated by Federal Regulations 18 U.S.C. § 3621 (e), The Violent Crime Control and Law Enforcement Act (VCCLEA) to provide substance use disorder treatment services to federal offenders. It is, therefore, essential that the continuity of such programs be maintained in order to ensure that services are available as mandated. In addition, MAT, mental health and sex offender treatment is needed to ensure continuity of care and public safety. In order to maintain this continuity, contracts for these services are procured inclusive of options to extend the term of the contract, not to exceed nine years. The use of options allows the Government to take advantage of the constant availability of these services as well as the contractor’s decreasing unit costs derived from increased efficiency and the distribution of start-up and non-recurring costs.

6. Budgeting and Funding [FAR 7.105(b)(6)]. Budget estimates are derived by developing an Independent Government Estimate (IGE) for each contract requirement. The IGE is developed by the Contracting Officer in conjunction with program staff by examining the potential need for the services being procured and reviewing the cost of contracts for similar services recently awarded in the surrounding geographic area. Community based substance use disorder treatment, MAT, mental health and sex offender treatment are awarded as firm-fixed price requirements type contracts, therefore funds are obligated by each delivery order. In the event that an indefinite-quantity contract is awarded, the specified minimum quantity is obligated and ordered within the initial fiscal year of the appropriation. Funds for requirements beyond the minimum guaranteed amount are then obligated by each delivery order.

7. Product or Service Descriptions [FAR 7.105(b)(7)]. The description of community-based substance use disorder, mental health, sex offender treatment, and MAT contain the necessary minimum requirements of the Government and set forth the essential physical and functional characteristics of the services required. These definitions can be found in the SOW.

8. Priorities, Allocations, and Allotments [FAR 7.105(b)(8)]. This subpart does not apply to procurements described by this class acquisition plan.

9. Contractor Versus Government Performance [FAR 7.105(b)(9)]. The Bureau has determined through a comprehensive, consistent, and equitable cost analysis that contracting with private sector agencies and individuals for community-based substance use disorder treatment, MAT, and mental health treatment is the most economically efficient method of providing these needed services. The decision to procure these services through private sector agencies and individuals is in compliance with the guidance provided by OMB Circular Number A-76.

10. Inherently Government Functions [FAR 7.105(b)(10)]. This subpart does not apply to the procurement described by this class acquisition plan.

11. Management Information Requirements [FAR 7.105(b)(11)]. Monitoring instruments and schedules for community-based substance use disorder, MAT, mental health, and sex offender treatment are designed to assist Bureau staff in making a thorough program evaluation and are based on the contract requirements as detailed in the SOW. Policy defining how and when monitoring inspections are conducted is included in Program Statement 7430.02, Community Transitional Drug Abuse Treatment.

12. Make or Buy [FAR 7.105(b)(12)]. This subpart does not apply to the procurement described by this class acquisition plan.

13. Test and Evaluation [FAR 7.105(b)(13)]. This subpart does not apply to the procurement described by this class acquisition plan.

14. Logistics Considerations [FAR 7.105(b)(14)]. This subpart does not apply to the procurement described by this class acquisition plan.

15. Government-Furnished Property [FAR 7.105(b)(15)]. This subpart does not apply to the procurement described by this class acquisition plan.

16. Government-Furnished Information [FAR 7.105(b)(16)]. This subpart does not apply to the procurement described by this class acquisition plan.

17. Environmental and energy conservation objectives [FAR 7.105(b)(17)]. This subpart does not apply to the procurement described by this class acquisition plan.

18. Security considerations [FAR 7.105(b)(18)]. This subpart does not apply to the procurement described by this class acquisition plan.

19. Contract Administration [FAR 7.105(b)(19)]. Administration of a contract resulting from the solicitation of this requirement will be the responsibility of an assigned Contracting Officer. The assigned Contracting Officer (CO) will appoint a Contracting Officer Representative (COR) to provide contract administration duties and perform other duties as assigned to ensure contractor compliance with the requirement of the SOW.

20. Other Considerations [FAR 7.105(b)(20)]. None

21. Milestones for the Acquisition Cycle [FAR 7.105(b)(21)]. Milestones for the acquisition cycle of this procurement are in accordance with the milestone data entry sheet attached.

22. Identification of Participants in Acquisition Plan Preparation [FAR 7.105(b)(22)].
