About this file

This Statement of Work (SOW) details the Department of Labor's Occupational Safety and Health Administration (OSHA) requirement for Empower Software Support and Licenses Maintenance from Waters Technologies Corporation for the Salt Lake Technical Center. The five-year contract covers base and four option periods from August 31, 2025 to August 30, 2031, consolidating two previously separate licensing packages into a single annual procurement that includes 12 named user licenses and a Work Group system with 5 user licenses.

The SOW specifies technical requirements for the Empower software, including compatibility with Windows Server 2016, LabWare LIMS, Windows 10 Enterprise, and remote access technologies. The software supports critical chromatography analysis for identifying hazardous workplace compounds across various instrument types (gas, liquid, and ion chromatography). The procurement is being conducted as a sole source acquisition, with Waters Technologies Corporation identified as the sole manufacturer, supplier, distributor, and service provider for the Waters Empower WGS FR5 SLC upgrade, to be deployed in DOL's Amazon Web Services cloud testing and production environments.

United States Department of Labor Office of the Secretary for Administration and Management Office of the Chief Information Officer Statement of WorK Occupational Safety and Health Administration (OSHA) Empower Software Support and Licenses Maintenance Background The US Department of Labor (DOL) Occupational Safety and Health Administration (OSHA) Salt Lake Technical Center (SLTC) is responsible for analyzing samples submitted by Compliance Safety and Health Officers (CSHOs) evaluating worker exposure to hazardous compounds. One of the tools used in identifying these hazards is the Waters Empower WGS. The system allows the CSHOs to take a sample at every inspection identifying potential hazards preventing exposures to these hazards.

The Salt Lake Technical Center (SLTC) has used Waters software and hardware for instrument control, data acquisition, data reduction and processing, and calculations for nearly 22 years. The software is called Empower and was formerly known as Millennium. The instrumentation that can be controlled with the software, along with the data that is collected and processed through it (the software) are crucial to the analysis and reporting of all types of chromatography.

Along with the instrumentation, the laboratory uses 420 analytical methods to generate results. Due the large number of analytical instruments supported by this software it is necessary for the proper reporting of a long and varied list of analyte contaminants including: benzene, toluene, xylene and other aromatic compounds; methanol, isopropanol, and other alcohols; n-butyl acetate, ethyl acetate, and other acetates; hexane, pentane, and other alkanes; Stoddard solvent, kerosene, and other naphtha; PCE, TCE, and other halogenated compounds; TDI, MDI, and other isocyanates; hexavalent chromium, hydrochloric acid and other ions and acid; and many other organic and inorganic compounds.

Empower is a signal processing software that provides analytical chemists with mathematical algorithms needed to process the signal and interpret it in a way that provides meaningful results from for samples analyzed. These results are the product of the analytical work of OSHA’s lab. All chromatographic types of instruments used at the Salt Lake Technical Center (SLTC) are supported by Empower including gas chromatography (for analyses of volatile organic compounds including benzene and other carcinogens), liquid chromatography (for analyses of hazardous compounds including diisocyanatos and coal tar pitch volatiles) and ion chromatography (for analyses of acid vapors and hexavalent chromium).

The testing of any competitor software in the testing environment will not validate the new Laboratory Information Management Systems (LIMS) ability to interact seamlessly with existing laboratory software and infrastructure.

Objective The purpose of this contract is to request continued support services from Waters Technologies Corporation for the Empower software. This includes direct assistance with system issues, software patching, and updates.

Additionally, this contract consolidates two previously separate licensing packages into a single annual procurement. Historically, these packages were purchased independently using separate credit card transactions, each with its own period of performance.

· Package 1 included maintenance and support for the overall production system, along with 12 named user licenses.

· Package 2 included a Work Group system with 5 user licenses, used in lower environments for development and testing.

Package 2 was recently procured and will be pro-rated for the remaining months of the current term. Moving forward, both packages will align to a unified period of performance from August 31 to August 30 each year.

Period of Performance The period of performance will be:

Base Period: August 31, 2025 – August 30, 2026 Option Period 1: August 31, 2026 – August 30, 2027 Option Period 2: August 31, 2027 – August 30, 2028 Option Period 3: August 31, 2028 – August 30, 2029 Option Period 4: August 31, 2030 – August 30, 2031

Requirements OCIO seeks Empower Software Support and License Agreement, 5-year term to support the OSHA Technical Center and requires the following, which is in alignment with the instrument process automation needs.

The work will be performed in the testing and production environments. The testing environment will be the basis of how the product software will work in the applied environment and will be moved to the applied/production environment thereafter where all the software and licenses will remain in use for their intended purpose.

Support for the deployment covered in this SOW shall be performed remotely via telephone or online tool(s). Electronic deliveries shall be made to the technical point of contact (Tech POC) and the Contracting Officer’s Representative (COR).

Contractor shall ensure that the Waters Empower WGS and FR5 SLC Upgrade will have the following specifications:

5.1.1a. Software system will be compatible with MS Windows Server 2016 or newer.

5.1.2a. Software system will be compatible with and interface with the LabWare Laboratory Information Management System (LIMS) and Electronic Lab Notebook (ELN).

5.1.3a. Software system is compatible with offsite hosting (Hosting outside local laboratory datacenter) and allow connectivity to laboratory instruments via internal network.

5.1.4a. Software solution which provides a Chromatography Data Software (CDS) package for advanced data acquisition, management, processing, reporting, and distribution for Agilent GCs or similar, Waters Acquity LCs or similar, Dionex IC or similar.

5.1.5a. Connectivity to database via existing LAC/E controllers.

5.1.6a. Compatibility with Windows 10 Enterprise or Professional, 64bit workstation operating systems.
