Statement of Work Washington Headquarters Services / Facilities Services Directorate

Arc Flash Rated and Non-Arc Flash Uniforms

Date: 11 August 2023

Part 1: General Information.

1.1 Scope: This Statement of Work (SOW) defines the effort required for the purchase, manufacture, and distribution of Arc Flash Rated and Non-Arc Flash Personnel Protective Equipment (PPE) Uniform Components for the Washington Headquarters Services (WHS)/Federal Facilities Division (FFD) Uniform Program. The uniform components shall be either purchased or manufactured in accordance with the garment specifications, various textiles specifications and quality requirements contained in Attachment 1 Pentagon Uniform Components List.

1.2 Description of Product: The Contractor shall provide all services including labor, equipment, tools, materials, and facilities to manufacture and distribute National Fire Protection Association (NFPA) 70E compliant and the Berry Amendment Act compliant uniform components for the FFD employees in an efficient and accountable manner. These products include, but are not limited to the purchase, manufacture and distribution of all Arc Flash Rated and Non-Arc Flash uniform components. A complete list of uniform components required by the employees is set forth in Attachment 1.

The Berry Amendment is outlined in the Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 225.7002 “Restrictions on food, clothing, fabrics, and hand or measuring tools” section and clauses 252.225-1 and 252.225-12.

1.3 Background: The requiring agency, WHS/FFD, has a requirement for its Wage Grade employees to wear uniforms that are in compliance with the regulations of the NFPA standard 70E.

The NFPA 70E Standards for Electrical Safety in the Workplace outline the requirements for employees to use proper Personal Protective Equipment (PPE). The PPE must protect the employees to NFPA 70E standard PPE category 2 (minimum ARC rating of 8 cal/cm2) and category 4 (minimum ARC rating of 40 cal/cm2) for specialized operations. The PPE including all accessories (patches, name tapes, Velcro strips shirts and jackets must contain ARC flash (flame resistant) material). The PPE should include long sleeved shirt and long pants or long-sleeved coveralls. Each employee is required to be in uniform every day; therefore, this contract will be put in place to provide the employees with the ability to meet their uniform requirements. An ARC flash is an undesired electric discharge that travels through the air between conductors or from a conductor to a ground. The resulting explosion can cause fires and serious harm to people and equipment.

1.4 Purpose: The purpose of this contract is to purchase, manufacture, and warehouse/maintain a small inventory, and distribute uniform components to employees of the FFD in an efficient and accountable manner for initial and emergency issuances. This requirement is Firm Fixed Price (FFP).

1.5 Period of Performance: Date of award through November 30, 2023

1.6 Objectives: FFD has the following objectives of the Uniform Program:

1.6.1 Project a distinctive and professional image to DOD’s workforce and visitors.

1.6.2 Provide adequate safety and protection against Arc Flash hazard. Provide the employees with functional, durable, economical, and comfortable clothing that will allow the employees to accomplish their assigned duties.

Provide the PPE as required by the union agreement between WHS/FFD and the International Brotherhood of Electrical Workers Local 26.

1.6.3 Promote employee distinction between supervisors and non-supervisors employees. Ensure the highest possible degree of consistency in uniform appearance in order to provide visible evidence of the agency’s continued success as a High-Performance Organization (HPO).

1.6.4 Maintain a uniform distribution system which provides quality uniforms in a timely manner and is financially accountable and cost effective.

1.6.5 All uniforms will be Berry Amendment Act compliant (including the material, threads, dyes, and the Velcro attachments) and will be made in the United States of America from American raw materials.

1.6.6 FFD places great emphasis on professional appearance and considers the uniformed employee as one of the most visible symbols of the division here at the DOD. Uniforms that are safety compliant, comfortable, durable, economical, easily maintained, and professional in appearance are important to the image of a HPO and the ability of its employees to perform their duties.

1.7 Key Personnel: The Contractor shall staff professional, skilled, and efficient key personnel identified below to support the FFD Uniform Program:

1.7.1 Point of Contact: The Contractor shall provide a single point of contact to coordinate primarily with the Government’s Technical Representative and the Contracting Officer, if needed.

Part 2: Deliverables.

2.1 The Contractor certifies that all material in the uniforms conforms with the Berry Amendment Act and that Defense Federal Acquisition Regulation Supplement (DFARS) clause 252.225-7012 “Preference for Certain Domestic Commodities” is flowed down to all subcontracts or purchase orders.

Part 3: Requirements.

3.1 Manufacture and Distribution of Uniforms: Uniform components shall be purchased or manufactured in accordance with both general and item-specific in the Uniform Component List.

3.1.1 70E Protective Clothing Shirt: Contractor shall provide Navy Blue shirts that are flame resistant with a minimum HRC2 ATPV (8 cal/cm2) lightweight flame-resistant material with two chest pockets with flap. All buttons on the shirt must be Navy Blue. There will be two adjacent cuff buttons to allow for a fit adjustment. Shirts must be a lightweight material with a minimum of 6 ½ ounces to a maximum of 7 ½ ounces.

3.1.2 70E Protective Clothing Polo Shirt: Contractor shall provide Navy Blue Polo shirts that are flame resistant with a minimum HRC2 ATPV (8 cal/cm2) lightweight flame resistant, with or without a chest pocket and without flap and button. All buttons on the shirt must be Navy Blue.

NOTE: This item does not require a chest pocket if one is not available in current stock.

3.1.3 70E Protective Clothing Cargo Pant: Contractor shall provide Navy Blue flame resistant work pants with a minimum HRC2/ASTM F1506 NEPA 70E (8 cal/cm2) lightweight flame resistant. Arc-resistant button or clip closure at the waist, triple stitched on both sides brass or plastic zipper fly (must meet required Arc-rating), two reinforced 7” deep back pockets with navy blue secured Velcro flaps. Cargo pocket on the outside of each leg will be 7” deep with navy blue secured Velcro flaps, triple stitched main seams and leg opening to fit over boots. Each belt loop must be doubled stitched. Cargo Pants must be a lightweight material with a minimum of 7 ounces to a maximum of 9 ounces. The cargo pants fabric (to include the color and button color) must match all other items, with no exceptions.

3.2 Delivery: Contractor shall deliver the uniforms to the address below:

3.2.1 Inspection and Acceptance: Acceptance of delivery shall be made upon inspection of uniforms. This acceptance of delivery shall not waive the Government’s rights under the warranty clauses.

3.2.2 The Contractor must make immediate written notification to the Contracting Officer and the Government’s Representative with all pertinent details on the proposed replacement, to include Arc Flash Ratings with pictures.

3.2.3 If the uniforms do not meet the specified requirements ratings, the uniforms will be returned or rejected at the Contractor’s expense and must be replaced within two weeks with the correct uniforms.

3.2.4 Submittals: Technical Data Sheets or Specifications and care instructions for all flame resistant clothing must be provided at time of delivery.

Part 4: Measuring

4.1 The Contractor shall provide the following measuring requirements:

4.1.1 Within fifteen (15) calendar days of award, the Contractor shall visit the site to perform 100% measurements of approximately 42 employees. The first shipment is for 42 personnel per shipment and 504 uniform items (to include pants, shirts, nametags, patches, etc.) to begin to deliver 60 days after award of order as detailed in the note below and every 30 days after until order is complete. Uniform package shall be bundled in sets of 12 by personnel to include nametags (6). ARC ratings and weight shall be based on details below as well as the Hazard Risk Categories (HRC).

Part 5: Warranty Information/Requirements

5.1 All new uniforms shall carry a one-year manufacturer’s warranty against defects. This warranty includes the Contractor’s certification that all deliverables satisfy the requirements of the SOW.

5.2 Replacement Cost: Upon Contracting Officer determination, including any determinations after

Acceptance, that work under this contract has failed, does not meet contract requirements or is otherwise defective, Contractor must replace or rebuild work to acceptable condition complying with requirements of contract documents. Contractor is solely responsible for cost of replacing or rebuilding defective work regardless of whether Government has benefitted from use of work through portion of its anticipated useful service life. After replacement or rebuilding, Contractor will reinstate warranty by written endorsement.

Reinstated warranty shall be equal to original warranty with equitable adjustment for depreciation. One example of a defect is the fading of the navy-blue dye that would warrant replacement of the garment.

5.3 The Government’s rights under the above warranty are in addition to any other rights the Government may have and does not diminish or limit those rights.

Part 6: Security Requirements

Contractors shall follow all Pentagon security policies and procedures.

6.1 The Pentagon is designated as a Restricted Area.

Contractor employees who require escorted entry to meet contractual requirements must have a valid need for access, be a U.S. citizen, and have no derogatory information in their background that would question their trustworthiness or reliability. Government issued identification cards and badges are the property of the U.S.

Government and shall not be retained by the cardholder upon completion of contract, termination of employment, or removal from contract performance. All identification will be turned into the cognizant Security Office when no longer required for performance on the contract or upon expiration. Unauthorized possession of Government issued identification can be prosecuted under Section 701, Title 18, USC.

The Contractor shall provide, to the cognizant Government Representative, visit request information containing full name (last, first, middle), social security number, date of birth, place of birth, and citizenship, and vehicle information for the driver 72 hours in advance of the delivery. Failure to provide security eligibility information shall delay and/or deny the individual access to the facility.

The Contractor shall comply with all applicable security regulations and guidance in effect during the performance of this contract to include the delivery of the uniforms.

6.2 Denial of Entry.

The U.S. Government reserves the right to terminate the entry of any Contractor employee upon disclosure of information which indicates the individual's continued entry to the installation is not in the best interest of national security. The violation of or deviation from the established security procedures by Contractor employees may also result in denial of entry.

6.3 Operations Security (OPSEC).

The Contractor shall comply with those OPSEC measures which may be required by the U.S. Government to protect and control indicators that give an insight into military operations, plans or other activities. Information about Pentagon contracts and or details about the facility will not be discussed with unauthorized persons, discarded as unclassified trash, posted on a webpage or released to the public without approval from the cognizant Security Office. Information should only be released to authorized personnel on a "need to know" basis. Additionally, Contractors will not confirm or deny information about Pentagon to reporters, radio stations or any person without an official "need to know".
