STATEMENT OF WORK:

BIS ANNUAL UPDATE CONFERENCE ON EXPORT CONTROLS

AND POLICY

FOR

BUREAU OF INDUSTRY AND SECURITY (BIS)

The Department of Commerce, Bureau of Industry and Security (BIS) is seeking venue for its Annual Update Conference on Export Controls and Policy.

1. BACKGROUND

The BIS Update Conference on Export Controls and Policy is the Department of Commerce’s flagship event on U.S. export controls. The Conference provides an opportunity for exporting companies to interact with the U.S. Government officials who implement the export control regulations, practices and policies intended to advance U.S. national security, foreign policy, and economic interests. Presenters and attendees include high level U.S. Government officials, foreign government and business representatives, export managers, corporate attorneys, and consultants. In addition, government and private sector vendors participate as exhibitors to offer information and services related to export control and compliance activities.

This annual conference has been held in Washington, DC for the past thirty-six years. The conference attendance continues to grow, and normally reaches maximum capacity.

2. SCOPE OF WORK

The purpose of this requirement is to provide BIS a venue for 1-year. This acquisition would include procuring a venue with meeting space (with Wi-Fi capability), including ballroom facilities, breakout rooms (with overflow rooms), five (5) meeting rooms, two (2) office spaces, exhibit areas, food and beverage, audio visual, internet, and telecommunications equipment and services, virtual capabilities, guest rooms, storage space, and on-site parking for conference staff. As BIS will use an APP for electronic submission of questions during the sessions and also for the collection of evaluation at the end of all sessions, the venue must ensure sufficient Wi-Fi bandwidth for use with APPs. Contractee will also provide on-site security as necessary.

• The conference is a 3-day event, with virtual capabilities and includes a pre-conference day immediately before the event for set-up and a post-conference day immediately after the event for breakdown, equaling a total of four days for conference-related activities. Depending on the timespan of the event, storage space may be required for days in advance of or after the four days. The two days of the conference must be Tuesday through Friday, and cannot be held over a federal holiday. Conference activities begin at approximately 7:00 a.m. and will end between 5:30 p.m. and 9:30 p.m. The contractee and government representative will coordinate these activities with the venue’s sales and convention services staff.

• The conference facility shall be located within the Washington Metropolitan area

• Commerce’s order of preference for the meeting is:

o March 2025

• The facility must block all required ballroom, meeting rooms, exhibit space, registration areas, planner office and storage space for the dates of the conference, and for pre- and post-conference days. All space must be contiguous. Commerce must be informed of any other events occupying the facility at the same time of the proposed conference dates. In addition, Commerce must be informed in advance of any subsequent requests to schedule other trade related events coincidental to this conference. (See below: A. Meeting Space Requirements)

1 The combined total seating for all breakout rooms must be a minimum of 100 and a maximum of 250seats.

Ballroom cannot be used as a breakout room due to timing of food & beverage events in the ballroom.

2 All breakout sessions will be set up theater style or a mix of classroom/theater as space permits, also overflow rooms for each, except on Day 3, where capacity-flexible meeting space, including one space for 50 rounds is required.

B. Food and Beverage Requirements The numbers of attendees indicated for each function is an estimate. The actual attendee count may be lower. The Contractor/Government representative will provide the hotel with a final guarantee seventy-two (72) hours before each function.

Indicate the full price for each food and beverage function including a breakdown of the price per person for each function, the cost of additional bartenders, servers or attendants, as well as any applicable service charge. As a U.S. Government agency, Commerce is tax exempt.

A guest room block at a discounted conference rate, at or near the prevailing U.S. Government per diem rate. The discounted conference rate should include complimentary access to fitness facilities and in-room internet access. Commerce does not guarantee the room block. Contractee/Commerce will receive one (1) complimentary room for every forty (40) revenue-producing guest rooms occupied. All complimentary room nights earned will be made available to the U.S. Government and such room nights must be reserved and held outside of the room block and after the room block closes until the U.S.

Government determines that they are not needed for the conference. If Commerce does not utilize the complimentary room nights, their monetary value shall be deducted from the conference invoice.

Parking Passes at 30 per day.

Provide for handling and moving between 500 and 1000 boxes of incoming and 100 to 500 boxes of outgoing conference materials/supplies as needed, and assistance to Exhibitors, as requested.

Exhibitors are responsible for their own handling fees.

6.0 PERIOD OF PERFORMANCE

The total period of performance with all options exercised is for 1year from date of award.

7.0 CONTRACT TYPE

The government anticipates issues a firm fixed price contract.

8.0 QUALIFICATIONS

The Contractor is responsible for and shall ensure staff are properly trained and hold the appropriate credentials as required for the services being performed.

9.0 CONFLICTS OF INTEREST

Contractor and subcontract personnel performing work under this task order may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications, or work statements, etc.), or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the CO immediately whenever he/she becomes aware that such access or participation may result in any actual or potential OCI and may merit the submittal of a plan to the CO to avoid or mitigate any such OCI. This mitigation plan would be determined to be acceptable solely at the discretion of the CO. In the event the CO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may employ other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

10.0 DATA RIGHTS

The Government has unlimited rights to all documents/material produced under this task order. All documents and materials, to include the source code of any software produced under this contract, shall be Government owned and the property of the Government with all rights and privileges of ownership/copyright belonging exclusively to the Government. These documents and materials may not be used or sold by the Contractor without written permission from the CO. All materials supplied to the Government shall be the sole property of the Government and may not be used for any other purpose.

This right does not abrogate any other Government rights

11.0 REPORTS AND DELIVERABLES

The Contractor shall attend progress meetings requested by the contracting activity or task order administration. The Contracting Officer, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the CO will apprise the Contractor of how the government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

12.0 ACCESSIBILITY REQUIREMENTS (Section 508)

Section 508 of the Rehabilitation Act, as amended by the Workforce Investment Act of 1998 (P.L. 105- 220), requires that when Federal agencies develop, procure, maintain, or use electronic and information technology (EIT), they must ensure that it is accessible to people with disabilities. Federal employees and members of the public with disabilities must have equal access to and use of information and data comparable to that of non-disabled Federal employees and members of the public.
