11.0 ADDITIONAL INFORMATION
11.1. Authority. Under no circumstances shall anyone other than the Contracting Officer (CO) have authority to make any commitments or changes on behalf of the Government with the contractor that affect price, quality, quantity, delivery, or any other terms and conditions of the contract, nor shall any other Government representative in any way direct the contractor or its subcontractors to operate in conflict with the contract terms and conditions. The Contractor shall immediately notify the CO, in writing, if any written or oral direction, instruction, interpretation, or determination is received from the Contracting Officer that causes or that the Contractor believes will cause a change, or that the Contractor regards as a change order.
11.2. Commencement. Upon award, the Contractor shall proceed with securing payment and performance surety bonds. No other efforts shall commence until the CO issues a Notice to Proceed (NTP), except for attendance of a predesign conference or preconstruction conference. Upon receipt of an NTP, the Contractor shall proceed with all other efforts required by the contract. Only one NTP will be issued for all project efforts. No on-site construction shall commence prior to Government approval of preconstruction submittals, including all design efforts and deliverables for design-build projects, unless expressly authorized by the CO.
11.3. Progress of Work. The scheduling and reporting of percentage of completion contemplated by FAR Clause 52.232-5 Payments under Fixed-Price Construction Contracts and 52.236-15, Schedules for Construction Contracts, shall be accomplished on or equivalent to an Air Force Form (AF) 3064, Contract Progress Schedule, and AF Form 3065, Contract Progress Report. The project schedule shall incorporate, as applicable, milestone events specified in the contract, including, notice to proceed, substantial completion, milestones related to specified work phases and site restrictions, Contractor-defined milestones to identify target dates for critical events based upon the Contractor's chosen sequence of work, and depict all major activities necessary to complete the work. The Contractor shall also prepare and submit for approval a cost breakdown of the Contract price, to be referred to as the “schedule of values”, assigning values to each major activity necessary to complete the work. Values must include all direct and indirect costs, although a separate value for bond costs may be established.
The schedule of values must contain sufficient detail to enable the Contracting Officer to evaluate applications for payment. If the percentage completed for the monthly reported period is less than the approved scheduled percentage the contractor shall provide the CO with an explanation for falling behind. If progress will not be regained within the next monthly reported period, the contractor shall provide the CO a supplementary schedule for approval demonstrating how progress will be regained.
Progress payments may be made up to substantial completion (95%) and after a pre-final inspection has occurred with the CO. The final progress payment of 5% (Final Invoice) will only be made following completion of any remaining punch-list items and final inspection, submission of the final progress report (100%), any remaining submittals, records, drawings, payrolls, Standard Form 1413s, release of claims, and other closeout documents, and turnover of Government property (materials, equipment, keys, etc.).
11.4. Submittals. All submittals will be coordinated through the Contracting Office using an AF Form 3000 Material Approval (Attachment 9). All equipment, material, and articles incorporated into the work are subject to the approval of the CO. The CO may request submittals that are absent from the submittal register but are incorporated into the work or that the contractor contemplates incorporating into the work. Each submittal is to be complete and in sufficient detail to allow ready determination of compliance with contract requirements. If the submittal is incomplete or otherwise does not provide the Government with sufficient detail, the CO may request additional information to determine compliance.
Each additional submittal request or request for additional information shall not be construed as a change, Government delay, or entitle the contractor to any equitable adjustment.
11.5. The Government shall be allotted 14 calendar days after the date the Government receives a submittal or resubmittal to complete reviews. Upon transmission of the submittal to the Government the contractor shall confirm its receipt. Approval or disapproval of a submittal shall not be construed as a complete check and indicates only that the Government objects or does not otherwise object to the submittal. Approval shall not relieve the contractor of the responsibility to meet contract requirements or for any error. Government review comments may be ‘for-information-only’ and therefore not a basis for approval or disapproval. Government review comments shall not relieve the contractor of their responsibility for quality control. All preconstruction submittals shall be approved prior to commencement of any construction at the work site, unless otherwise authorized by the CO.
11.6. Design-Build: For a project that is design-build in nature, where the construction contractor has overall responsibility for producing the necessary specifications and drawings to fulfil the government requirement, the Government scope of work does not specify project submittal requirements. Submittal requirements are driven by the design. It is the responsibility of the contractor to be aware of standardized and project-specific submittal requirements in the Unified Facilities Guide Specifications (UFGS) that will be applicable to the project when preparing offers and post-award activities such as developing project schedules. Applicable submittal requirements from the project scope of work or specifications may not be removed/waived by the contractor (e.g. SD-01 Preconstruction Submittals, Contractor Quality Control Plan).
11.7. Coordination: All work shall be conducted under the general direction of the CO and subject to daily inspection by the Government. References to “Contracting Officer” in the scope of work, specifications, drawings, etc. may be interchangeable with Contracting Officer’s Representative (COR), Contracting Officer’s Technical Representative (COTR), Project Manager (PM), Inspector, Subject Matter Expert (SME), “shop”-specific personnel, or other Government representative(s) that are assisting the CO with technical monitoring or administration of contract requirements, identified, appointed, or delegated certain responsibilities by the CO. Generally, this will be the PM or Inspector.
11.8. The Contractor shall confirm with the CO who is/are the responsible Government representative(s) for the Contractor to successfully coordinate all construction activities. When a work task specifically requires the presence/witness of a responsible Government representative, the Contractor shall ensure the presence/witness is coordinated not later than one week before the work task is scheduled to be completed.
11.9. All construction at the work site shall only be conducted between the hours of 7:00 am and 5:00 pm, Monday through Friday, unless otherwise authorized by the CO. Weekends, Federal holidays, and any associated ‘AF Family Day’, ‘Down Day’ or ‘Goal Day’ are non-workdays and decrease the availability of Government personnel for coordination.
11.10. Federal holidays are:
11.10.1.New Year’s Day (and associated Family Day); Birthday of Martin Luther King Jr;
Inauguration Day; Washington’s Birthday/President’s Day (associated Family Day);
Memorial Day (associated Family Day); Juneteenth National Independence Day;
Independence Day (associated Family Day); Labor Day (associated Family Day); Columbus Day; Veterans Day; Thanksgiving Day (associated Family Day); and Christmas Day (associated Family Day).
11.10.2.Further decreased availability of Government personnel shall be anticipated during the workweeks of the Thanksgiving, Christmas and New Year’s holidays. It is the responsibility of the Contractor to adequately plan for and schedule all coordination necessary (i.e. base/site access, submittals, construction) in advance of known non-workdays.
11.11. Base Access. The Visitor Control Center (VCC) must receive a Security Forces Squadron (SFS) Form 30 (Attachment 10) for each contractor and subcontractor employee that needs access to the base not later than two weeks prior to construction start or otherwise before a valid need for base access. The Contractor shall submit all project SFS Form 30s to the CO (Sponsor) for processing to the VCC prior to the two-week lead time. No consideration shall be given to the Contractor for delays or cost increases experienced due to failing to request base access in a timely manner, nor due to the denial of base access to a contractor or subcontractor employee following the Government-performed background check.
11.12. The contractor shall be responsible to track all contract employees and pass expirations for the duration of the projects, and retrieval/turn-in of passes to the VCC when the project is complete.
11.13. Base access under this contract shall adhere to the most current entry protocols found at https://www.mountainhome.af.mil/Base-Resources-Helping-Agencies/Visitors-Control-Center/
11.14. Being granted base access does not grant access to the restricted or controlled area.
Restricted or controlled area access is contingent upon base access.
11.15. Contractors needing a temporary or long-term pass for base access will need to present a Real ID compliant drivers license or two (2) forms of identification at the VCC to receive a pass.
Failure to do so may access delays that will not be construed as excusable or government-caused.
Below is a list of approved forms the member may use as a second form of ID:
State-issued Enhanced Driver’s License U.S. passport U.S. passport card DHS trusted traveler cards (Global Entry, NEXUS, SENTRI, FAST) U.S. Department of Defense ID, including IDs issued to dependents Permanent resident card Border crossing card An acceptable photo ID issued by a federally recognized Tribal Nation/Indian Tribe, including Enhanced Tribal Cards (ETCs).
HSPD-12 PIV card Foreign government-issued passport Canadian provincial driver's license or Indian and Northern Affairs Canada card Transportation worker identification credential U.S. Citizenship and Immigration Services Employment Authorization Card (I-766) U.S. Merchant Mariner Credential Veteran Health Identification Card (VHIC)
11.15.1.Individuals holding more than one acceptable credential must use the credential most accurately depicting the capacity in which the individual is acting for the specific visit to the installation. Plainly, contractors shall not use military retiree ID to enter the base if the purpose for entering the base is to perform contract work. Use the pass issued by the VCC.
11.16. Contractors are prohibited from possessing weapons, firearms, and ammunition, on themselves or within their contractor-owned or privately-owned vehicles while on Mountain Home Air Force Base.
11.17. Controlled/Restricted Area Access. Security Forces must receive and authenticate an Entry Authorization List (EAL) prior to any entry into a restricted or controlled area. The Contractor shall submit an EAL information table containing each contractor and subcontractor employee that may be required to perform work in the area to the Government PM for processing to SFS not later than 30 days prior to construction start or otherwise before a valid need for area access. The most current version of the Government template will be provided by the PM. No consideration shall be given to the Contractor for delays or cost increases experienced due to failing to request restricted or controlled access in a timely manner.
11.18. The contractor shall ensure that only the contractor and subcontractor employees listed on the authenticated EAL enter the area. Failure to comply with restricted or controlled area access protocols will result in a security violation and may suspend all or part of the work or result in removal of the unauthorized employee(s) from the base. The duration of required Government actions (e.g.
investigations) following security violations caused by a contractor or subcontractor shall not be construed as excusable delay or unreasonable Government delay.
11.19. Approval to access the base is required before approval to access to a controlled/restricted area. EALs will not be processed that list individuals that do not have approved base access. Being listed on an authenticated EAL does not grant base access.
11.20. Personnel. The Contractor shall employ sufficient management and contract administration resources, including personnel responsible for project management, field superintendence, change order administration, estimating, coordination, inspection, and quality control, to ensure proper execution and timely completion of work. The Contractor shall designate a principal of the firm or other senior management official to provide executive oversight and problem resolution resources to projects for the life of the contract. The Contractor shall employ and require its subcontractors to employ only qualified personnel to perform work required for each project.
11.21. The Government reserves the right to exclude, or remove from the worksite, any personnel for reasons of incompetence, carelessness, or insubordination, who violate rules and regulations concerning conduct on federal property, or whose continued employment on the worksite is otherwise deemed by the Government to be contrary to the public interest.
11.22. Unless expressly authorized by the CO, in the solicitation or otherwise before receipt of offers, combining or ‘dual-hatting’ of roles is not authorized. Therefore, the Contractor shall assume for the purposes of preparing their offer, and execution and timely completion of the project, that separate superintendents, quality control managers, site safety and health officers, and environmental managers are required.
11.23. If ‘dual-hatting’ is expressly authorized by the CO, in the solicitation or otherwise before the receipt of offers, the Contractor shall ensure their designee meets or exceeds the required qualifications of each role for which they are designated.
11.24. Prior to construction, the Contractor shall provide the CO with written designation for each role, proof of qualifications for each designee, and work contact information (desk/mobile phone, email). Repeated failure or excessive delay by the Contractor to meet role and qualification requirements of the contract may be deemed default and result in the Government terminating the Contractor’s right to proceed with the work under the Default Clause.
11.25. Quality Control (QC). The Contractor shall document and resolve all quality control problems and accomplish daily quality control inspections. The Contractor shall establish a method to identify poor performance and specify appropriate corrective action. All work is subject to US Army Corps of Engineers (USACE) Construction Quality Management (CQM) practices.
11.26. Request for Information (RFI) Process.
11.26.1.The term RFI is typically used to request formal clarification or variation of a contract requirement, such as when details are ambiguous or absent from the scope of work, construction drawings and specifications. The Government will only respond to RFIs submitted by the prime contractor, therefore all subcontractor or supplier RFIs shall be reviewed and transmitted to the Government only by the prime contractor. RFIs should include information such as references to the construction documents applicable to the issue, affected definable features of work, problem statement, suggested solution, cost and/or schedule impact, and desired response time. The Government shall be allotted a standard response time of 14 calendar days, unless a shorter period is requested in the RFI for valid time-sensitive issues that will or may impact cost or schedule.
11.27. Site Maintenance. The Contractor shall maintain the project site in a clean, safe and orderly condition. Contractor shall secure all supplies and equipment stored on the TO project site to discourage theft or damage. Protection and security for materials and equipment on site is the sole responsibility of the Contractor. The Contractor may be required to install temporary fencing to protect the site.
11.28. Weather. The Contractor will and will cause its subcontractors to protect carefully all work and materials against damage or injury from weather. If any work or materials have been damaged or injured by reason of the failure on the part of the Contractor or its subcontractors to protect such work and materials, such will be removed and replaced at the expense of the Contractor.
11.29. Base Closure/Entry and Exit: The 366th Fighter Wing Commander may at any time deny or restrict entry or exit from Mountain Home Air Force Base. Typically, these occurrences are in the interest of heightened security conditions and public safety concerns. Contractors and their subcontractors shall anticipate the potential for minor entry or exit delays due to the nature of performing work on a military installation. Contractors shall further anticipate the potential for base closure or delayed reporting of Government personnel due to expected or occurring poor weather conditions. Public notifications of base closures and delayed reporting of Government personnel due to poor weather conditions are available on the Mountain Home Air Force Base Gunfighters Facebook page.
11.30. Delays in Entering or Leaving the Work Area: If the work site is located in a restricted or controlled area, the Contractor may experience delays due to compliance with entrance/exit requirements of the restricted/controlled areas. The Contractor shall not be compensated for reasonable delays in accessing these restricted/controlled areas. The Contractor may also be requested to leave a restricted or controlled area at any time. The Contractor shall not be compensated for reasonable delays due to these security measures. The CO may extend the completion date when there is a change in security designations that limit or diminish Contractor access to a work site after commencement of work. The CO may also extend the completion date to offset undue delays, singular or cumulative, due to contractor compliance with base and site security restrictions.
11.31. Nuclear Density Gauge (NDG). NDGs require authorization to be brought onto the base.
Authorization shall be requested for each gauge via material submittal 30 days prior to a valid need to be brought onto the base. No consideration shall be given to the Contractor for delays or cost increases experienced due to failing to request authorization in a timely manner. The following documentation is required with each submittal:
U.S. Nuclear Regulatory Commission (NRC) Form 241 Leak test certificate Radiation Safety and NDG training certificates Radiation Safety Officer contact information
11.32. Waste. Disposal of any Mountain Home Air Force Base waste at the Idaho Regional Waste Services Simco Road Regional Landfill, now known as Sawtooth Regional Landfill, is prohibited unless otherwise indicated by the CO.
11.33. Dig Permit. Call DiglIne to initiate the dig permit process. Digline will give a confirmation number and confirmation email. Complete an Air Force Form 103 including sections 1-7 and a description of work in section 18. Input the Digline confirmation number in section 14 under Remarks.
Provide a map of the work site requiring locates. Submit the AF 103, map, and Digline confirmation email to 366CE.CSU@us.af.mil for processing, and Cc the PM and CO. Once approved the dig permit will be emailed back.
11.34. It is the responsibility of the contractor to submit, track, and renew dig permits in a timely manner to allow the Government to process and approve prior to any beginning of work requiring digging or extending of work requiring digging. Processing may take up to 15 days. Failure to do so may result in delays that shall not be construed as Government delay or entitle the contractor to any equitable adjustment.
