Existing systems operated by any entity, including another state system, and any planned system whose application would take precedence over Cal OES application will not cause unacceptable interference into the propose state system.

B. Frequency Coordination

The Contractor must perform frequency coordination services in accordance with the requirements of CFR section 90.175 (47CFR90.175) for frequencies in the frequency bands including,

i. Frequencies between 25 and 470 MHz as listed in the CFR;

ii. In the event that CFR section 90.20 requires concurrence from a specific frequency coordination organization, the Contractor must assume responsibility for obtaining that concurrence prior to forwarding the application to the FCC for further processing.

iii. Frequencies between 450 and 470 MHz used for fixed operations pursuant to CFR Section 90.261;

The Contractor shall review the Cal OES application to ensure that it is complete and that it is in compliance with applicable sections of the CFR to include, as a minimum, the sections listed below. Any discrepancy found between the Cal OES application, as submitted, and the applicable FCC requirement shall result in notification to the designated Cal OES Representative who shall be given a minimum of (10) working days to resolve the discrepancy before the application is rejected;

ii. CFR Section 90.205 Power and Antenna Height Limitations applicable to the 150-170 MHz bands and 450-470 MHz;

iii. In certain instances, Cal OES may desire to submit an engineering justification for approval based upon service area radii in accordance with CFR Section 90.205, Note 4 of Tables 1 and 2. In such cases, the Contractor shall provide the FCC a written explanation of their processes and procedures that ensure that such justifications are forwarded to the FCC for processing;

Agreement A241012270 prevented the application from being forwarded to the FCC for further processing. The application may be returned electronically; however, the application shall not be returned without having first contacted Cal OES representative allowing Cal OES an opportunity to correct the discrepancies.

Agreement A241012270 termination of the contract. The State is entitled to seek any and all relief it may be entitled to as a result of such non-disclosure.

The State reserves the right to amend the contract, without additional cost, to incorporate GenAI Special Provisions into the contract at its sole discretion and/or terminate any contract that presents an unacceptable level of risk to the State.

10. CAL OES RESPONSIBILITIES

i. Failure by the Contractor to respond to Cal OES’ initial problem notification within the required time limit may result in immediate termination of the Contract. In the event of such termination, Cal OES shall pay all amounts due the Contractor for all work accepted prior to termination.

c. Cal OES will, within five (5) business days after receipt of the Contractor’s corrective action plan, notify the Contractor in writing whether it accepts or rejects the plan.

i. If Cal OES rejects the corrective action plan, the Contractor will submit a revised plan within three (3) business days. Failure by the Contractor to respond to Cal OES’ notification may result in immediate termination of the Agreement.
