PART A: Limitations on Subcontracting & Ostensible Subcontractor Rule

As part of ongoing market research, the VA requires clarification on your firm's ability to perform these services in full compliance with the following small business contracting regulations:

• Limitations on Subcontracting (LOS) - FAR 52.219-14: Ensures SDVOSB/VOSB businesses do not serve as pass-throughs for large entities. Applicable to all set-aside and sole source contracts under the Veterans First Contracting Program (VFCP), this rule limits subcontracting to no more than 50% of the contract value for services and requires that any subcontracts be awarded to SDVOSBs/VOSBs.

• Ostensible Subcontractor Rule -13 C.F.R. § 121.103(h)( 4): Prohibits a small business prime contractor from being unduly reliant on a subcontractor to perform the primary and vital requirements of a contract.

Please provide written responses to each of the following questions:

1. Work Distribution What percentage of the contract work will your firm perform directly versus subcontract out? (Note: Invoicing and scheduling do not constitute 51% of performance.)

2. Primary Performance Who will perform the primary and vital requirements of this contract
