About this file

This is a contract terms and conditions document for the State of Maine Department of Environmental Protection's procurement of Sorbent Booms. The contract covered the period from April 1, 2010, through April 29, 2011, with provisions for two possible one-year extensions. The scope requires the contractor to furnish sorbent booms and sorbent pads to meet the Department's normal operational requirements. Deliveries must be made to one of three Department of Environmental Protection warehouse locations in Augusta, Portland, or Bangor, with the contractor required to provide 24-hour advance notice to the appropriate contact at each facility. All deliveries must occur during normal receiving hours and arrive in first-class condition.

The estimated annual value of the contract is approximately $25,000.00, though the actual amount is contingent on quantities ordered during the contract term. Contract prices are firm throughout the duration and include all transportation charges on an FOB destination basis. The State of Maine is exempt from excise taxes and will furnish exemption certificates upon request. Vendors must accept the State of Maine Procurement Card as payment without surcharge, and pricing must remain consistent regardless of payment method. Delivery orders of $5,000.00 or less are emailed directly to vendors, while larger orders require Division of Purchases approval and encumbrance. Contractors must submit a detailed yearly purchase report, issue separate invoices for each order number referencing the contract and Federal ID number within 30 days of delivery, and may serve municipalities under state law. The State reserves the right to cancel the contract with 30 days' written notice or immediately if the contractor fails to comply with contract terms.
