SOL-OAA-16-000189 Amendment 02
Accordingly, this Solicitation is amended as follows:
1. Cover page, page 2, Delete the following:
“The authorized NAICS Code for restricted component of this RFP is: 541712 – Research and Development in the Physical, Engineering, and Life Sciences (except Biotechnology).”
And replace it with:
“The authorized NAICS Code for restricted component of this RFP is: 541990 – All other Professional, Scientific, and Technical Services.”
2. Section B.13 NAICS CODES
Delete the following:
“The authorized NAICS Code for restricted components of this RFP is: 541712 – Research and Development in the Physical, Engineering, and Life Sciences (except Biotechnology).”
And replace it with:
“The authorized NAICS Code for restricted components of this RFP is: 541990 – All other Professional, Scientific, and Technical Services.”
3. Section K.2 52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS
Delete the following:
“(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 541990 – All other Professional, Scientific, and Technical Services
– for the unrestricted portion. The NAICS Code for restricted component of this RFP is: 541712 – Research and Development in the Physical, Engineering, and Life Sciences (except Biotechnology).
(2) The small business size standard is 1,000 employees.
(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.”
And replace with:
“(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 541990 – All other Professional, Scientific, and Technical Services
(2) The small business size standard is $15Million.”
4. K.5 52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS
Delete the following:
“(b)(1) The North American Industry Classification System (NAICS) code for this acquisition is

6. Section L.6(b) GENERAL INSTRUCTIONS – RFP INSTRUCTIONS
Add the following instructions:
“Sub-contractors may work simultaneously on awards made under both FEWSNET IDIQs.
Similarly, prime contractors on one FEWSNET 7 IDIQ may work as a sub-contractor on the other
FEWSNET 7 IDIQ.
Prime offerors must always follow applicable regulations and USAID guidance regarding conflicts of interest. Sub-contractors are restricted from working on activities where they have a conflict of interest or where they are not able to provide an independent work product due to their participation as a prime or sub-contractor on another task order award under either FEWSNET 7
IDIQ.”
7. Provide answers to the following questions
Question: On the cover page of RFP SOL-OAA-16-000189, USAID notes the following: If a small business were to be successful in proposing on both the unrestricted and restricted scopes of work, the successful Offeror would be awarded only one (1) contract, either under the
“restricted” or the “unrestricted”, due to conflict in performing both scopes of work.
Can USAID clarify if the statement above applies to consortium partners, especially small businesses? Specifically, may consortium partners—including small businesses—pursue and be awarded work under both unrestricted and restricted IDIQs in a subcontractor role?Can a
Contractor (small business or not) be both a Prime and Sub on both the Unrestricted and the
Restricted contracts?
Answer: As stated in the cover letter, companies may submit proposals for both the restricted and unrestricted awards; however they will not receive a prime contract with both restricted and unrestricted components. Sub-contractors may work on awards made under the unrestricted and restricted IDIQ.
Prime offerors must always follow applicable regulations and USAID guidance regarding conflicts of interest. Sub-contractors are restricted from working on activities where they have a conflict of interest or where they are not able to provide an independent work product due to their participation as a prime or sub-contractor on another task order award.
