Solicitation Number: 12444522R0001 Mark Twain National Forest Tree Planting Services IDIQ Page 2 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

This solicitation is issued as Request for Request for Proposal (RFP).

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-07.

This procurement is set aside for 100% total small business. The NAICS code is 115112 and the Small Business Size Standard is $8 million.

Schedule of Items/Price Schedule: IDIQ contracts will include a Schedule of Items. Each task order will also include an independent schedule of items. See Attachment 1, and 5, and Sections labeled SCHEDULE OF ITEMS for more information. The quantities described on the Schedule of Items represent the Government’s best estimate of its requirements for the period of contract performance. The Government reserves the right to order quantities in excess of the stated estimated quantities on the Schedule. However, such quantities shall not exceed 150% of the total estimated contract dollar amount. It is estimated that the Government’s requirements for any additional quantities for each line item will be in approximately the same proportions that each item currently bears relative to the entire estimate Description of Requirement: This solicitation is for multiple award, Indefinite Delivery – Indefinite Quantity (IDIQ) contracts for Tree Planting services on the Mark Twain National Forest. Work is described in Attachment 2 and is prescribed in each Task Order. The 2022 Tree Planting Task Order 1 is listed as Attachment 5 to this solicitation.

The Forest Service may award one or more IDIQ contracts from this solicitation. The 2022 Tree Planting Task Order 1 will be awarded with an IDIQ contract. The maximum award amount of all IDIQs combined, shall not exceed $600,000. Future Task Orders will be solicited amongst contractors receiving IDIQ contracts from this solicitation as described in this document. Award will be made to the best value to the Government based on technical, consideration of other non-price factors, and price, and offers that are determined responsible and responsive to this solicitation. Pricing for Task Order 1 will also be used to determine price competition. Quantities identified in Task Order Schedule of Items are estimated quantities.

There is no organized site visit planned however many of the areas are open to the public or arrangements can be made to allow access. Acceptance: Acceptance will be determined by inspection of work performed and will be based on adherence to the specifications within the contract. Reference the PWS for discussion of payment terms.

Invoicing: The "Submit Invoice-to" address for USDA orders is the Department of Treasury's Invoice Processing Platform (IPP). All invoices are to be submitted online via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm. Your company must register at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish an account in order to submit an invoice on this project.

52.212-1 Instructions to Offerors – Commercial Items (SEP 2021) (Provision) Addenda to provision 52.212-1:

Contact Danette Cappello at danette.cappello@usda.gov for more information or with questions concerning this solicitation. All questions must be received via email by 3pm CST, 21 December 2021. Proposals shall be submitted electronically to: danette.cappello@usda.gov. No Facsimile proposals will be accepted.

Proposals must be submitted no later than 1pm CST, 6 January 2022.

Late proposals will NOT be considered. All offerors must be registered in www.sam.gov in order to receive award. Registering in SAM is free. Renewing/maintaining registration in SAM is also free.

In order to be considered for award offerors must submit the following documentation:

1. Offer Submission Package - Completed Schedule of Items – Attachment 1, and Schedule of Items from the task order (Attachments 5), for which districts you would like to be considered for award. Contractors wishing to propose on this requirement must propose pricing for each least one district. The tabs on the Schedule of Items spreadsheet represent the districts;

2. Technical Proposal – Proposal must adequately discuss each of the technical factors stated in the text of FAR 52.212-2 (pages 5-7 of this document); or completed Attachment 6 – Experience Questionnaire.

3. 52.212-3 Offeror Representations and Certifications - If reps and certs ARE completed on www.sam.gov, offeror only needs to complete subsection b of the clause as reproduced on page 8-9 of this document, along with the other clauses. If reps and certs are not completed on www.sam.gov, you must print clause 52.212-3 in its entirety and submit it with your offer.

4. Employment of Eligible Workers - Workforce Certification (found on page 36 of this document)

7. Any/all amendments MUST be acknowledged in writing – email acknowledgement is acceptable unless otherwise stated in the amendment.

It is the offerors responsibility to confirm receipt of the offer.

By submitting the offer, the Contractor agrees to all terms, conditions, clauses, and provisions included in the solicitation and agrees to furnish any awarded items at the price set in the schedule. The offer is valid for 30 after the closing date of the solicitation unless a formal extension is granted by the contractor.

52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Cost to the Government is not expected to be the controlling factor in the selection of Contractors for this solicitation. The degree of importance of cost as a factor could become greater depending upon the quality of the offers for other factors evaluated. The following factors will be used in the technical evaluation of offers listed in descending order of importance:

Technical Proposal Evaluation Factors:

Factors I and II are significantly more important than III and IV. Factors III and IV are of equal importance. Subfactors listed are of equal importance.

I. PAST PERFORMANCE

a. List jobs that are of a similar nature you have completed in the last 3 years. Supply the project owners name and a contact address and/or telephone number for each project involved.

b. List any projects on which you defaulted or failed to complete on schedule. Explain how and why this occurred.

c. How did you maintain quality in workmanship on these projects?

II. EXPERIENCE AND KEY PERSONNEL

Indicate who you plan to have on site as supervisor. Also list any personnel you expect to be working on the project(s). Indicate the type of experience and number of years, related to this type of work.

III. COMPANY ORGANIZATION

Describe the company’s overall business experience and expertise.

IV. QUALITY CONTROL/SAFETY PLANS

a. Provide an explanation of how you plan to maintain quality control.

b. Provide a safety plan. It needs to include but is not limited to the following: safety equipment to be used; discussions planned related to safety before work starts; traffic control when needed, first aid equipment/materials that will be available.

V. BIO-PREFERRED PRODUCTS – Offeror must demonstrate that an effort is made to utilize bio-based products in its operations. Products can be found at www.biopreferred.gov Price Proposal. Price is secondary to the technical proposal contents discussed above but will be included in the evaluation process as a consideration of award. The price proposal consists of the price submitted the Schedule of Items/Pricing from this request for proposal. This price will be utilized to evaluate the accuracy of the contractor’s estimating system. The prices will be compared with the Government estimated price.

Past performance and other Technical Evaluation factors, when combined, are more important than price.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Technical Evaluation Criteria Factors:

1. Past Performance

Acceptable
To receive a rating of Acceptable for this factor, technical proposal must demonstrate that offeror has sufficient experience with projects similar in scope to this work.

Technical proposal must contain the requested examples of experience performing this work.

Unacceptable
Offeror fails to demonstrate they have an Acceptable Level of experience.

Experience – Offeror must demonstrate experience with project(s) similar in scope to the requirements detailed in the Statement of Work. Offeror may submit projects in which they performed as either a prime or sub-contractor. Work performed by the offeror must have exceeded $5,000. Offerors are requested to submit AT LEAST 3 past projects – no more than 10 projects will be considered. If more than 10 are submitted, only the first 10 will be evaluated. For all projects submitted, offeror must provide the following information:

a) Contract number

b) Contract/award amount

c) Brief description of the work performed

d) Location of work performed

e) Date begun/completed

f) Name/address/telephone number of person to contact for further information This factor will be evaluated on whether the projects were completed with minimal instances of poor or late performance – and with only moderate customer oversight. Note – Technical Evaluators may use their personal knowledge of the offeror’s prior experience and/or consider information not contained in the proposal as long as it can be validated (i.e. additional information obtained from discussing a project with the POC).

IMPORTANT PLEASE READ – It is vital you provide all of the requested information. If you do not provide enough information to validate previous relevant experience that example may not be considered. If the Government elects not to enter Discussions there will be no avenue to clarify the information. Ensure you have included the requested information

2. Experience and Key Personnel –

Acceptable
To receive a rating of Acceptable for this factor, technical proposal must demonstrate that offeror has available personnel (with an adequate skill level) to work on simultaneous task orders. Required skill levels refer to the skills required to perform the tasks required by the Statement of Work.
Unacceptable
Offeror fails to demonstrate they have the staffing to perform to an Acceptable Level.

3. Company Organization-

Acceptable
To receive a rating of Acceptable for this factor, technical proposal must demonstrate that offeror has suitable business experience to perform at an Acceptable Level.
Unacceptable
Offeror fails to demonstrate they have applicable business experience to perform at an Acceptable Level.

4. Quality Control /Safety Plans– Offeror must demonstrate a focus and emphasis on proactive quality control and safety in their day to day operations. Offeror shall not rely on the Government/COR/CO to alert them to deficient performance or safety hazards.

Acceptable
To receive a rating of Acceptable for this factor, technical proposal must demonstrate that offeror has a methodology to practice proactive Quality Control and Safety in their work.

Offeror also must demonstrate how this methodology is communicated to employees as well as integrated into their day to day operations.

Unacceptable
Offeror fails to demonstrate the ability to practice Quality Control and Safety for this work and/or how it will be communicated to their employees.

5. Bio-Preferred Products – Offeror must demonstrate that an effort is made to utilize bio- based products in its operations. Products can be found at www.biopreferred.gov .

Acceptable
To receive a rating of Acceptable for this factor, technical proposal must demonstrate that offeror shall make an effort to utilize bio-based products in its operations.

Technical proposal shall contain a list of products which vendor will make an effort to utilize.

Please reference the Technical Proposal Guide for examples of products that may be appropriate for this work.

Unacceptable
Offeror fails to demonstrate they shall make an effort to utilize bio-based products in its operations.

52.212-3 Offeror Representations and Certifications – Commercial Items (FEB 2021) (DEVIATION JUL 2020) (Provision)

If Offeror Representations and Certifications are not complete in SAM the offeror shall submit a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with your offer. The full provision is available from http://www.acquisition.gov/far/.

(d) Comptroller General Examination of Record. 52.216-18 Ordering (AUG 2020)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued for a period of 5 years after contract award.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c)A delivery order or task order is considered “issued” when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor—

(1) Any order for a single item in excess of $150,000.00;

(2) Any order for a combination of items in excess of $600,000.00; or

(3) A series of orders from the same ordering office within 30 calendar days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 calendar days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after expiration of the Period of Performance indicated on any Task Orders that were issued before the contract expiration.

52.216-32 Task-Order and Delivery-Order Ombudsman (Sep 2019)

(a) In accordance with 41 U.S.C. 4106(g), the Agency has designated the following task-order and delivery-order Ombudsman for this contract.
