Section M - Evaluation Factors for Award

ADDENDUM 52.212-2

Award will be made using Lowest Priced Technically Acceptable (LPTA) source selection procedures. Award will be made to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. LPTA is expected to result in the selection of the technically acceptable proposal with the lowest evaluated price. Award may be made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary. Award will be made to the offeror whose technical proposal conforms to the requirements of the solicitation and its price is the lowest and determined to be fair and reasonable by the contracting officer; and the contracting officer determines the offeror is responsible. Proposals submitted in response to this solicitation shall include the following:

FACTOR 1: TECHNICAL CAPABILITY EVALUATION. Technical Capability reflects the Government's confidence in each offeror's ability, as demonstrated in its offer, to provide the requirements as stated in this solicitation. The Government will evaluate whether the offeror has demonstrated that it can meet the minimum requirements in the Performance Work Statement (PWS) in the solicitation. The Contractor is required to provide as a part of the technical capability product literature, catalog price lists, warranty, guarantee, technical specs, and delivery information, if available. Offers that do not demonstrate the proposed items meets all requirements will not be considered further for award. The following adjectival ratings will be used in evaluating each Offeror's technical offer.

TECHNICAL EVALUATION

RATING DESCRIPTION

Acceptable Offer clearly meets the minimum requirements of the solicitation.

Unacceptable Offer does not clearly meet the minimum requirements of the solicitation.

Note: Any offeror receiving a rating of "Unacceptable" for Technical Capability will no longer be considered for award.

FACTOR 2: PRICE. Price will be evaluated separately from Technical and will be evaluated for fairness and reasonability in terms of the Government's requirement. Price must be determined to be fair and reasonable. Offerors' price proposals will be evaluated to determine the price is fair and reasonable in accordance with FAR 12.209. Pricing will be evaluated using various price analysis techniques and procedures similar to those listed in FAR 15.404-1(b) including, but not limited to, comparison of proposed price received in response to the solicitation with a comparison to the IGE.

52.212-2 Evaluation-Commercial Products and Commercial Services.

(Deviation 2026-O0038)

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

[Insert evaluation factors in the relative order of importance. For requests for proposals, state:

Evaluation factors other than price when combined are [significantly more important than price /approximately equal to price/significantly less important] than price. For invitations for bids, list only price and price-related factors.]

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
