4.0 Content Requirement

All information should be confined to the appropriate file. The Offeror should confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.

VOLUME I - TECHNICAL INFORMATION

Volume I shall be organized into the following sections:

1) Factor 1 – Past Performance

a. The Offeror should submit three (3) projects that best demonstrate its team’s experience on recent and relevant projects that are similar in scope, complexity, size, and price to the work required under this solicitation for all submitted projects.

If more than three (3) projects are submitted, only the first three (3) projects will be evaluated.

At least one project shall be provided for the prime Offeror (the entity signing the SF1442). If the Offeror is a Joint Venture (JV), recent and relevant project experience shall be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have experience, such projects shall be submitted for each Joint Venture partner.

If the Offeror is a JV, it should follow the JV Procedures outlined in Attachment 2.

Offerors should submit a signed copy of their current joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement, or letter of commitment for each member of the Offeror’s team for which experience is being demonstrated. Offeror’s providing firm commitments in the form of the documents listed at the beginning of this paragraph may be more highly rated due to reduced risk to the Government.

If an Offeror is utilizing experience of affiliates, subsidiaries, parent, LLC, LTD member companies (i.e., Offeror’s name is not exactly as stated on the SF1442), the proposal should clearly demonstrate how that affiliate/subsidiary/parent firm will have meaningful involvement in the performance of this contract. The relevant consideration is whether the resources of the parent or affiliated company – its workforce, management, facilities, or other resources – will be provided or relied upon for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance. The proposal must demonstrate similarity of the parent or affiliate’s proposed role on this procurement and the parent or affiliate’s proposed role submitted for experience in order to receive credit for the parent or affiliate’s experience.

After contract award, any subcontractors that were specifically identified in the proposal shall not be replaced or substituted unless the Contractor obtains the Contracting Officer’s written consent.

Projects provided must be completed in the last six (6) years, as of the issue date of this Request for Proposals (RFP), to be considered recent.

A project is defined as work performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather, Offerors should submit the work performed under a task order as a project.

b. For all submitted projects, Offerors shall provide the following information:

i. A narrative of the project that clearly describes the scope of work performed, and the relevancy to, the project requirements of this RFP (i.e., unique features, area, construction methods, etc.). Offerors should include:

• Type of contract (e.g., Design-Build (DB) or Design-Bid-Build (DBB));

• Role on the contract (i.e. Prime or Sub) for each member of the proposed team who participated in the project execution;

• Month/year that construction started and month/year construction completed. (Projects provided must be 100% completed within the past six (6) years.);

• Total contract award value and final cost of construction (if Prime) and the value of the work specifically performed by the prime and each relevant team subcontractor involved with the project;

• Specialized construction features of the project; and

• Customer’s point-of-contact who can be reached for references (phone number and email address).

Photos to supplement the description are acceptable; however, a narrative description is still required.

ii. For Federal Government projects with a Past Performance Information Retrieval System/Contractor Performance Assessment Reporting System (CPARS) evaluation: Offerors should provide the contract number, contract place of performance, and DUNS number. In the case of Indefinite Delivery type contracts, GSA contracts, and Blanket Purchase Agreements, Offerors should include Task or Delivery Order numbers.

For non-Federal Government projects, commercial projects, and Federal Government projects without a CPARS evaluation: Offerors shall provide a Past Performance Questionnaire (Attachment 2). The Offeror should completed Blocks 1-4 of the PPQ and send it to the non-Federal project client or commercial project client. The client should complete Blocks 5-8 along with the two page questionnaire. The Offeror should include the PPQ in Volume I of the proposal.

If the Offeror is unable to obtain a completed PPQ from a client for a project before the proposal closing date, the Offeror should complete and submit, with the proposal, the first page of the PPQ, which will provide contract and client information. The Government may make reasonable attempts to contact the client noted for that project to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires.

Alternatively, Offerors may submit a previously completed copy of a PPQ for a completed contract or task order.

The PPQ must have used Attachment 2 and bear the client’s signature. The Offeror may retain PPQs in its files for submission on future procurements. In cases where the validity of the completed PPQ is questioned, contracting personnel may contact the reference for verification or additional information. USACE does not intend to create or maintain a database of PPQs submitted by Offerors. Therefore, it will be the Offeror’s responsibility to ensure that the submission of PPQs in its proposal are relevant to the solicitation. Alternatively, the Offeror may obtain an updated/new PPQ from its client(s) for submission as provided above.

Offerors may also include performance recognition documents received within the last 6 years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

These documents do not replace the previously mentioned requirements.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

VOLUME II - PRICE

Volume II shall consist of the Offeror’s proposed ID/IQ Contract Binding Rates; the Bid Schedule for the Seed Task Order, and the Offeror’s Price Proposal Breakdown for the Seed Task Order. There are no page limitations for this volume.

1) ID/IQ Contract Binding Rates

Each Offeror shall submit binding hourly rates for the following personnel:

• Project Manager

• Site Superintendent

• Contractor Quality Control (CQC) Manager

• Site Safety and Health Officer (SSHO)

Binding hourly rates for each of these personnel must be submitted for 1 October to 30 September of each of the five years of the contract’s period of performance. These rates will become a part of the contract and shall be used in pricing the Seed Task Order and all task orders for the life of the contract. Binding rates shall be burdened with taxes, insurance, and home office overhead but shall not include job site overhead or profit. Offerors shall use the table in the “Binding Rates” Government-provided Excel spreadsheet (Attachment 3) to submit their binding rates.

At contract award, the binding rates will be incorporated into the contract and will not be renegotiated.

Offerors shall submit pricing for an additional 6-month period of time after the 5th year of the contract, in the event the contract time is extended under the contract clause 52.217-8, Option to Extend Services.

2) Seed Task Order Bid Schedule

This solicitation includes a Seed Task Order that will be awarded concurrently with the ID/IQ Contract. After the pool of MATOC awardees is selected based upon the best value to the Government, the Seed Task Order will be awarded to the MATOC awardee with the lowest price. The Seed Task Order statement of work is attached in the document entitled “Attachment 5: Pavement Repairs Union Village Dam, Thetford, VT Statement of Work.” The Offeror’s proposed Price for the Seed Task Order should be presented as firm fixed price, using the Bid Schedule provided (Attachment 6). No unauthorized alterations to the bid schedule will be allowed and the Offerors must submit pricing for all line items. The Offeror’s pricing submitted in the Seed Task Order Bid Schedule shall use the Year 1 labor rates the Offeror submits for the ID/IQ Contract Binding Rates. The Seed Task Order will be subject to construction wage determination VT20200066 dated 02/07/2020, Attachment 7 to this solicitation.

3) Price Proposal Breakdown for the Seed Task Order

Offerors shall also submit their price proposal breakdown used to develop their pricing shown on the Seed Task Order Bid Schedule. At a minimum, Offerors need to show a breakdown of all labor, material, equipment, sub-bids and indirect costs, including mark-ups, of each sub-task of the Seed Task Order. Offerors need to show how they calculated the Seed Task Order price, accurately indicating how all costs total up to the costs proposed on the Bid Schedule. Price Proposal Breakdowns need to show that binding rates submitted for the ID/IQ Contract Binding Rates were utilized in the Seed Task Order Bid Schedule. Binding rates and all costs shown on the worksheets need to be clearly traceable to the Seed Task Order Bid Schedule line items. Format, level of detail, and software for estimating is not prescribed, but the Price Proposal Breakdown should present an organized Work Breakdown Structure (WBS) of sufficient detail and depth of major features of work, labor costs, material costs, equipment cost, subcontract costs, and all other indirect costs, including markups. The WBS and prices within should total up without error into that of the Seed Task Order Bid Schedule.

For proposal preparation purposes, the expected or approximate date for initiation of contract performance of the Seed Task Order is 30 September 2020.

4) Each Offeror shall complete (fill-in and signatures) the solicitation sections indicated below:

• Standard Form 1442 (SF 1442), Solicitation, Offer and Award

• Acknowledgement of Amendments, if any

• Contract Administration Data – Bidding Schedule

• Representations, Certification and Other Statements of Offerors

5) Each Offeror shall submit a bid guarantee in accordance with FAR 52.228-1 for the Seed Task Order. Class Deviation 2020-O0016 allows that bond forms be completed as indicated in the instruction portion of each form, except that a seal is not required. This deviation also allows that electronic signatures and electronic, mechanically-applied, or printed dates may be used on bonds and shall be considered original signatures and dates, without regard to the order in which they were affixed. Scans of wet signatures will not be considered digital signatures. The Government encourages bid bonds to be electronically signed and submitted along with the rest of the proposal.

Electronic proposal submissions must include either an electronically signed bid guarantee or a scanned copy of the original guarantee with “wet” signature.

If the offeror chooses to submit a guarantee with a “wet” signature or raised seal, the original must be mailed or delivered to the below address and received by the proposal due date and time:

Attn: Sara J. Torres – Contracting Division Solicitation W912WJ20R0015 U.S. Army Corps of Engineers 696 Virginia Road Concord, MA 01742

E. DISCUSSIONS

1.0 General Information

The Government intends to award without discussions. Therefore, the Offeror’s proposal should contain the Offeror’s best terms from a technical and a price standpoint. Proposals will be analyzed to determine which is most advantageous to the Government based upon information provided in response to evaluation factors. The Government reserves the right to conduct discussions if the Source Selection Authority (SSA) later determines them to be necessary.

2.0 Discussion Scheduling

If discussions are necessary, they will be conducted in writing with the Offerors.

SECTION M

A. BASIS FOR AWARD

Evaluation of offers will be made using the best value trade-off process in accordance with FAR Part 15, and contracts will be awarded to the best overall (i.e., best value) proposals that are determined to be most beneficial to the Government; with appropriate consideration given to the evaluation factors.

Firm-fixed price (FFP) Task Orders will be issued under this Paving MATOC. Task Orders will be awarded on the basis of lowest price conforming to the requirements of the RFP.

B. FACTORS TO BE EVALUATED

The evaluation factors are:

Factor 1 – Past Performance Factor 2 – Price

The non-Price evaluation factor is approximately equal to Price.

NOTE: The Government may evaluate proposals as submitted without conducting discussions. Offerors should not assume that they will have an opportunity to clarify or correct anything in their proposal.

The Government will award one contract each, to a target of four (4) Offerors with the best overall proposals that are determined to represent the best value to the Government, with appropriate consideration given to the price and non-price factors.

A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach,” Paragraph C of this section. During evaluations of each proposal, the Government will assign an adjectival rating for Factor 1 with a written narrative evaluation reflecting the identified.

C. EVALUATION APPROACH

1.0 Overall Approach

All proposals shall be subject to evaluation by a Source Selection Team (SST). The overarching evaluation approach for all factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the Offeror’s past performance satisfied the requirements specified in the solicitation. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the solicitation.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven performance. The proposal will be evaluated to determine the extent to which the Offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

NOTE: For submission requirements designated as “shall” or “must,” failure to provide the requested information will be considered a deficiency and the specified factor will be rated “unacceptable,” and the Offer will be considered un-awardable unless revised. For submission requirements designated as “should,” Offerors who demonstrate their ability to meet the requirement may be considered more favorably. Offerors are cautioned that award may be made without discussions, and Offerors may not have the opportunity to submit revised proposals.

2.0 Evaluation of Factors

To be considered for award, the Offeror must achieve a confidence assessment rating of “Neutral Confidence” or greater, for Factor 1. Confidence assessment ratings of “Limited Confidence” or “No Confidence” ratings for factors could indicate a lack of understanding concerning mission requirements and will result in the entire proposal receiving an unfavorable rating causing it to be eliminated from the competition.

2.1 Factor 1: Past Performance

This factor is used to evaluate the Offeror’s experience in successfully completing recent and relevant projects. This factor will be rated using the confidence assessment ratings presented in Table 2, below.

Factor 1 Evaluation Approach

There are three aspects to the past performance evaluation: recency, relevancy, and quality of performance which are combined to establish one performance assessment for each Offeror.

Recency: projects provided must be completed within the past six (6) years, as of the issue date of this RFP, to be considered recent. Projects completed more than six years from this date will not be considered.

Relevancy will be determined by projects that demonstrate completion of projects similar in scope, complexity, size, and cost or price to the seed task order. When determining the relevancy of projects submitted for experience, the role performed by the Offeror or its subcontractor will be considered for consistency with the proposed role to be performed by the Offeror or subcontractor on the Paving MATOC. Failure to provide agreements or letters of commitment, as applicable, may result in a lower rating for this factor.

The proposal review will only consider the experience or past performance of an Offeror’s parent or affiliated companies where the firm’s proposal demonstrates that the resources of the parent or affiliated company will affect the performance of the Offeror. The relevant consideration is whether the resources of the parent or affiliated company – its workforce, management, facilities or other resources – will be provided or relied up on for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance. The proposal must demonstrate a connection between the affiliate’s proposed role on the Paving MATOC and the role of the affiliate on the past performance submitted in order to receive credit for the affiliate’s past performance.

At a minimum, a project considered relevant must include:

1. New construction or rehabilitation of roadways, curbs and gutters, or parking areas with construction costs of $150,000 or more.

A project not meeting this requirement will automatically receive no higher than a Somewhat Relevant rating.

Proposals ratings for past performance relevancy will be based on a holistic review of all projects. A rating of Somewhat Relevant or Not Relevant on any project may influence the proposal rating but will not automatically lead to a Somewhat Relevant or Not Relevant rating overall.

Proposals may be more highly rated for relevancy if they include projects that demonstrate any of the following.

Proposals demonstrating all of the following will be the most highly rated for relevancy:

1. New construction or rehabilitation of roadways, curbs and gutters, or parking areas with construction costs of $500,000 or more.

2. Work performed at U.S. Military Installations or other Federal Facilities.

3. Work performed for the U.S. Army Corps of Engineers.

Offerors whose record or relevant past performance demonstrates achieving strict delivery schedules may be more highly rated.

Relevancy will be evaluated using the ratings in Table 1.

Table 1 – Past Performance Relevancy Ratings

Adjectival Rating

Description

Very Relevant

Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant

Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant

Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

In addition, Factor 1 will examine the quality of projects reviewed for this factor. A separate quality assessment rating is not required; rather, the past performance confidence assessment rating is based on the Offeror’s overall record or recency, relevancy, and quality of performance.

The Government will evaluate the record of past performance for the Offeror to ascertain the probability of successfully performing the requirements under this solicitation. The Government team will review all past performance information collected and determine the quality of the Offeror’s performance, general trends, and usefulness of the information and incorporate these into the performance confidence assessment. The overall performance confidence assessment will be evaluated using Table 2.

Absent any recent and relevant past performance history, or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will be assigned a “Neutral Confidence” rating.

2.2 Factor 2: Price

The Offeror’s price proposal shall consist of its proposed Binding Rates Schedule; the Seed Task Order Bid Schedule; and a Seed Task Order Price Proposal Breakdown that shows how the prices presented in the Seed Task Order Bid Schedule were developed. The Government will evaluate the Offeror’s entire price proposal to determine whether the proposed price is fair and reasonable.

Table 2 – Performance Confidence Assessment Rating Method

Adjectival Rating

Description

Substantial Confidence

Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
