Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror, whose offer conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The Government reserves the right to award to other than the lowest-priced offeror if it is determined that a higher-rated technical or past performance quote justifies the price premium. In accordance with the Revolutionary FAR Overhaul (RFO) Part 12, evaluation will be based on a best value approach. RFO Part 15 is not applicable to this acquisition.
Technical Approach. The Government will evaluate each quote to determine if it contains sufficient information to provide the Government reasonable expectation that the vender understands the requirement and is capable of achieving the performance objectives as defined in the PWS.
Past Performance. Past performance will be evaluated to assess the offeror's probability of meeting the solicitation requirements based on historical contract execution. This evaluation will include, but is not limited to, data retrieved in accordance with 252.204-7024, Notice to Prospective Suppliers on Use of Supplier Performance Risk System (SPRS), and relevant past performance references. The Government reserves the right to use its own internal resources /databases as part of the past performance evaluation.
Price. Although this is a firm-fixed-price contract, the Government will evaluate each offer for price realism to assess the offeror's understanding of the requirements and associated performance risk. Accordingly, an offer may be determined unacceptable if the proposed price is evaluated as either unreasonably high or unrealistically low.
(b) . The Government will evaluate offers for award purposes by adding Options (if applicable) the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) . A written notice of award or acceptance of an offer furnished to the Notice of award successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
