ADDENDUM TO FAR 52.212-2

Evaluation Factors for Award ADDENDUM TO FAR 52.212-2 Evaluation – Commercial Products and Commercial Services

1.0 Basis for Award

This acquisition is a small business set-aside. This is a Lowest Priced Technically Acceptable (LPTA) source selection. The acquisition process will be conducted in accordance with (IAW) Federal Acquisition Regulation (FAR) 15.101-2 and FAR Part 12, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). The LPTA source selection process is appropriate when best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

1.1 Number of Contracts to be Awarded

One contract may be awarded to the offeror who is deemed responsible IAW the FAR, as supplemented, whose proposal conforms to all the solicitation's requirements and all other information required by the addendum to FAR 52.212-1, Instructions to Offerors - Commercial Items of this solicitation. However, the Government reserves the right not to award a contract, depending on the quality of the proposals, and prices submitted.

1.2 Discussions

The Government intends to evaluate proposals and award a contract without discussions with offerors.

However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer (KO) to be necessary (see FAR 52.212-1(g)). Clarifications conducted to resolve minor or clerical errors will not constitute discussions and the KO reserves the right to award a contract without the opportunity for proposal revisions.

1.3 Solicitation Requirements (Terms and Conditions)

Offerors shall provide the information described in the addendum to FAR 52.212-1, Instructions to Offerors - Commercial Items. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations, and certifications, and SOW requirements, in addition to those identified as factors and subfactors.

Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. The Government reserves the right to determine any such exceptions unacceptable, and the proposal, therefore, ineligible for award. In the case that a discrepancy exists between the addendum to FAR 52.212-1, Instructions to Offerors – Commercial Items and the addendum to FAR 52.212-2, Evaluation - Commercial Items, the evaluation criteria in the addendum to FAR 52.212-2, Evaluation - Commercial Items will take precedence.

2.0 EVALUATION STEP 1 - PRICE

Initially, the Government shall place all proposals meeting solicitation terms and conditions in order from lowest to highest based on price. The Government will evaluate the three lowest priced offers to establish adequate price competition.

2.1 Total Price (TP)

Evaluation of proposed pricing will be based on review of all prices provided in the CLIN Schedule. The offeror's proposed price will be reviewed for compliance with the instructions provided in the addendum to FAR 52.212-1, Instructions to Offerors - Commercial Items.

3.0 EVALUATION STEP 2 - TECHNICAL

Next, the Government will evaluate the three lowest total evaluated priced offerors’ technical proposals to assign an Acceptable/Unacceptable rating. The purpose of the technical factor is to assess whether the offeror's proposal will satisfy the Government's minimum requirements. There is one Technical factor for this solicitation. For a lowest evaluated priced offeror to receive a rating of Acceptable, the Technical factor must receive a rating of Acceptable.

If a lowest evaluated priced offeror receives an Unacceptable rating in the Technical factor, the evaluation of the proposal will stop.

Technical factor: The offeror shall provide documents that show adequate responses to SOW paragraph 2.

Immersion Cleaning and Wastewater Minimization System Specifications through SOW paragraph 10.

Environmental Requirements. The offeror will receive an Acceptable rating by submitting documentation that meet the requirements of the SOW. If the offeror does not submit documents or submits documents that do not meet the requirements of the SOW, then the offeror will receive a rating of Unacceptable.

Technical Rating Description Acceptable - Proposal meets the requirements of the solicitation.

Unacceptable - Proposal does not meet the requirements of the solicitation.

4.0 EVALAUTION STEP 3 - PAST PERFORMANCE VOLUME

Next, the Government will evaluate the three lowest total evaluated priced, technically acceptable offerors’ past performance to assign an Acceptable or Unacceptable rating. The past performance evaluation results in an assessment of the Government's confidence in the offeror's probability of meeting the minimum past performance solicitation requirements.

4.1 Evaluation of Past Performance

The contractor shall describe its ability to perform the proposed requirements by submitting three past performance citations related to contracts/orders it has held within the last 5 years that are similar in scope, magnitude, and complexity to the tasks described in this solicitation. The past performance evaluation will consider each offeror's demonstrated recent and relevant record of performance in supplying equipment that meet or are similar to the SOW requirements. The three aspects of past performance evaluation are recency, relevancy, and how well the offeror performed on prior contracts/orders. These will be evaluated to establish an Acceptable or Unacceptable rating.

The past performance evaluation may include key subcontractors, if applicable.

4.1.1 Recency Assessment

An assessment of the past performance information will first be made to determine if it is recent. To be recent, the effort must be ongoing or must have been performed during the past five years from the date of issuance of this solicitation. Past performance information that fails this condition will not be further evaluated.

4.1.2 Relevancy Assessment

Next, the Government will conduct an evaluation of all recent past performance information obtained to determine how closely the requirements performed under those contracts/orders relate to the requirements of this solicitation.

The offeror will be evaluated with respect to its past performance of projects similar in size, complexity, dollar value, contract type, and/or degree of subcontracting to the requirements.

The Government is not bound by an offerors' opinion of a project's relevancy. In determining relevancy for individual contracts/orders, consideration will be given to the effort, or portion of the effort, being proposed by the offeror, or subcontractor, whose contract is being reviewed and evaluated. The past performance information provided, and information obtained from other sources may be used to establish the degree of relevancy of past performance.

4.1.3 Performance Assessment

The Government will consider how well the offeror performed on prior recent and relevant contracts/orders in determining the Acceptable or Unacceptable rating. The assessment consists of an evaluation of all past performance information available and a determination whether the offeror has a combined Satisfactory rating for all reports.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 [a][2][iv]). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

Past Performance Rating Description:

Acceptable - Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.

Unacceptable - Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

5.0 BEST VALUE DETERMINATION

The Government will evaluate the three offerors with the lowest total evaluated prices. The three offers will be evaluated to ensure Acceptable ratings in all factors have been identified. If one of these three offers receive an Unacceptable rating in any factor, the next lowest total evaluated priced offer will be evaluated, and this process will continue until there are three offers with the lowest total evaluated prices and Acceptable ratings in all factors, or until all offerors have been evaluated. The one offer with the lowest total evaluated price with Acceptable ratings is considered to represent the best value for the Government and will receive the award.
