If an Offeror objects to such release in the base contract or contract modifications, the Offeror must notify the contracting officer in writing prior to the closing date identified in this solicitation and include the rationale for the objection consistent with the provisions of FOIA. A release determination will be made based on rationale given.

Addendum to 52.212-4, Contract Terms and Conditions - Commercial Products and Commercial Services
SECTION H NARRATIVE:
H.1 Ordering For Multiple Awards
H.1.1 For Task Orders beyond the guaranteed contract minimum, the Government intends to issue awards competitively in accordance with (IAW) Fair Opportunity provision of FAR 16.505(b), unless an exception exists in FAR 16.505(b)(2)(i).
H.1.2 Generally, offerors will be allowed one week to respond to a request for a task order proposal.
H.1.3 Firm Fixed Price CLINs: Base contract(s) unit range prices for CLINs 1001-1002, 2001-2002, 3001-3002, 4001-4002, and 5001-5002 constitute ceiling prices. As such, offerors are not allowed to propose higher prices than the ceiling prices. An offeror may propose lower than the ceiling prices during Fair Opportunity competition.
(a) Each awardee shall be provided a fair opportunity to be considered for each order in excess of $3,500.00, unless one of the exceptions outlined in subparagraph (b) is met. The basis for award will be identified in Task Order
Proposal Request(s). The Contracting Officer, in making the decision in the award of any individual task order, shall consider price or cost under each order as one of the factors in the selection decision; however, the decision may result in an award to other than the lowest priced proposal. The Contracting Officer may also consider the following criteria when developing factors in the selection decision tailored for each individual order:
The Contracting Officer may use streamlined procedures, including oral presentations, when selecting an order awardee. The competition requirements of FAR Part 6 and the policies of FAR subpart 15.3 do not apply to the ordering process and the Contracting Officer is not required to use a formal evaluation plan or scoring of offers.
Additionally, if the order does not exceed the simplified acquisition threshold, the Contracting Officer need not contact each of the multiple awardees under the contract before selecting an order awardee if the Contracting Officer has information available to ensure that each awardee is provided a fair opportunity to be considered for each order.
A multiple contract awardee may at any time after contract award offer a lower price than that provided for in this contract, and the Contracting Officer may accept the contractor's lower cost/price in making decisions in the award of any order.
The Government intends to evaluate and award task orders without discussions. However, the Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary.
(b) Awardees need not be given a fair opportunity to be considered for a particular order in excess of $3,500.00 under this contract if the Contracting Officer determines that:
(1) The agency need for the supplies or services is of such urgency that providing a fair opportunity would result in unacceptable delays;
(2) Only one contractor is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;
(3) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order; or
(4) It is necessary to place an order to satisfy a minimum guarantee.
(c) Task orders are not subject to protest under FAR Subpart 33.1, unless the order is in excess of $10 Million, increases the scope, period, or maximum value of the contract. However, concerns with the award of orders can be brought to the attention of the ACC-DTA ombudsperson, Mr. Kiemba Knowlin (ACC-DTA, Michigan), kiemba.a.knowlin.civ@army.mil, 586-282- 8460.
H.1.4 In accordance with (IAW) Federal Acquisition Regulation (FAR) 16.504(a)(4)(ii), the minimum quantity of supplies and services the Government will acquire under the Transcription contract is $8,000.00. The Government will satisfy this minimum quantity requirement by issuing the first Task Order (TO) for the stated minimum at the time of contract award.
H.1.5 The Government is NOT obligated to purchase any additional requirements beyond the Minimum Guaranteed Amount.
H.1.6 The maximum quantity of supplies and services the Government can acquire under the IDIQ contract is $357,000.00.
H.1.7 Contractor Performance Assessment Reporting System (CPARS)
H.1.8 The contractor will register at the CPARS Access site: http://www.cpars.csd.disa.mil/cparsmain.htm.
H.1.9 The contractor's performance under this contract shall be assessed by the Government. An interim assessment will be prepared every 12 months and a final assessment will be prepared when the contract is physically complete. The Contracting Officer (Assessing Official), the Contract Administration Office, or any other Government source deemed appropriate will provide to the Procuring Contracting Officer (PCO) information relative to the contractor's performance in the following areas: Technical (Quality of Product or Services); Schedule; Cost Control; and Management (Subcontract Management, Program Management or Other Management). The assessment/review will be accomplished using the Contractor Performance Assessment Reporting System (CPARS). The completed evaluations shall not be released to anyone other than Government personnel and the contractor whose performance is being evaluated.
H.2.1 In accordance with Federal Acquisition Regulation (FAR) 16.504(a)(4)(ii), the guaranteed minimum amount of services the Government will acquire under each MA IDIQ contract awarded under the ACC-DTA CMH MA
IDIQ suite is $1,000. The Government will satisfy this minimum quantity requirement at the time of MA IDIQ contract award through the first Task Order for delivery of the corporate quality control plan.
H.2.2 IAW FAR 16.504(a)(4)(ii), the maximum quantity of services the Government will order against ACC-DTA
CMH MA IDIQ suite is $20 million, to include the five ordering periods for all MA IDIQ contracts.
H.2.3 The Order limitations are specified in FAR 52.216-19 of this contract.
H.2.4 The Contracting Officer, at his/her discretion, may add additional clauses/provisions at the task order level.
The Contracting Officer will include any such clauses/provisions in the task order solicitation request.
H.3 CONTRACT ORDERING PERIODS
H.3.1 All Task Order awards will be based on competitive proposals received exclusively from ACC-DTA CMH
MA IDIQ contractors, herein referred to as MA IDIQ contractors. Each MA IDIQ contract contains five ordering periods as defined below:
First ordering year of the contract is the date of award plus 364 days.
Second ordering year of the contract is 365 days through 729 days after contract award.
Third ordering year of the contract is 730 days through 1,094 days after contract award.
Fourth ordering year of the contract is 1,095 days through 1,459 days after contract award.
Fifth ordering year of the contract is 1,460 days through 1,824 days after contract award.
