52.212-2 Evaluation-Commercial Products and Commercial Services. (Tailored) (Nov 2021)
Evaluation-Commercial Products and Commercial Services (Nov 2021)
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the RFQ will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. Price - in accordance with FAR 15.403-1(c)(1), the Government intends to use adequate price competition as a basis for establishing the reasonableness of proposed prices. In accordance with FAR 31.201-3, for a price to be reasonable, it must represent the price to the Government that a prudent person would pay in the conduct of competitive business.
The Government may evaluate the offeror's proposed price using one or more of the techniques defined in FAR
15.404 in order to support the determination of reasonableness.
2. Technical - the offeror's technical proposal will be evaluated against the items in the Statement of Work (SOW) paragraph 1. The Government will evaluate the technical proposal to ensure a complete understanding of the services to be performed and to ensure the offeror's approach successfully aligns with the Government's expectations. Failure to address all tasks in SOW paragraph 1 shall render the offeror's technical proposal unacceptable.
3. Past Performance - the Government shall review recent (within the past three years) and relevant CPARS ratings for all offerors.
Marginal or Unsuccessful ratings in any rated area within the past three years for similar services shall render the offeror's past performance unacceptable. Offerors are encouraged to submit recent and relevant past performance with their proposal.
Technical is significantly more important than Past Performance. All non-price factors, when combined, are more important than price.
Fair Opportunity: Award will be based on a determination of best value to the Government, price and other factors considered. "Best Value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement.
Award on Initial Responses: The Government anticipates selecting the best value offeror from initial responses, without engaging in interchanges with offerors. Once the Government determines the apparent successful contractor, the Government reserves the right to conduct interchanges with only that Offeror to address any remaining issues, if necessary, and finalize a task order with that Offeror. These issues may include technical and price clarifications. If the parties cannot successfully address any remaining issues, that are determined pertinent at the sole discretion of the Government, the Government reserves the right to conduct interchanges with the next best-suited Offeror based on the original analysis and address any remaining issues with that Offeror. Once the government has begun interchanges with the next best value Offeror, no further communications with the previous Offeror will be entertained until after the task order has been awarded. This process shall continue until an agreement is successfully reached and a contract is awarded.
Award Determination: The Government will evaluate the responses to select the best suited Offeror. The Offeror that, in the Government's estimation, provides the greatest overall benefit in response to the requirement will be selected for the contract award. The Government will base this determination on which Offeror provides the greatest overall benefit in terms of the evaluation factors and will use the evaluation process described herein to arrive at this determination
(a) Options. Not applicable.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
