52.212-2 Evaluation-Commercial Products and Commercial Services. (Nov 2021)

Evaluation-Commercial Products and Commercial Services (Nov 2021)

The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement. The Government will award a single contract to the offeror whose proposal is technically acceptable, the lowest price, is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), Part 12 Acquisition of Commercial Items, in conjunction with FAR Subpart 13.5, and FAR 19, Small Business Program, as supplemented, by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS), and whose offer conforms to the solicitation's requirements (to include all stated terms, conditions, and all other information required by the solicitation). Offers that fail to address all the requirements set forth in the Solicitation will be rejected. The Government intends to evaluate proposals and award a contract without discussions. Therefore, the Offeror's submission should contain their best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to reject an offer upon initial submission and not consider it for contract award if any required data is absent or the data received conveys a misunderstanding of the requirement.

BASIS FOR AWARD:

The Government will evaluate the contractor's technical proposal to ensure that it reflects a sound understanding of this requirement and complies with the requirements in the solicitation. An evaluation will be made to verify that the offeror is capable of providing the required services at a fair market price. Award will be made based on lowest priced technically acceptable (LPTA) offeror. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement.

The following factors shall be used to evaluate offers:

EVALUATION CRITERIA. Evaluation criteria consist of factors and elements. The proposal will be evaluated under three evaluation factors:

Technical, Price and Past Performance.

Factor 1: Technical

Subfactor 1 - Staffing Approach

Subfactor 2 - Relevant Work

Factor 2: Price

Factor 3: Past Performance

Factor 1 - Technical. The Technical factor evaluation provides an assessment of the offeror's capability to satisfy the Government's minimum requirements. The Technical factor has two subfactors.

Subfactor 1 - Staffing Approach: The staffing approach satisfied the following requirements:

(a) The Offeror provided a matrix that listed the proposed labor categories, number of personnel and hours proposed IAW the PWS.

(b) The Offeror provided explanations or supporting data (matrix, charts, or other graphics) determined necessary for the Government to fully understand your methodology and approach.

(c) The Offeror provided qualification/certifications associated with each labor category that demonstrates the skills considered necessary for each labor category proposed.

(d) The Offeror provided the necessary membership IAW the PWS.

Subfactor 2 - Relevant Work:

(a) The Offeror provided a minimum of 5 years of experience in general rigging and repair of obstacles, inspection, and testing of safety items IAW the PWS. The offer included qualified personnel to perform structural/civil engineering services with a minimum of five years' experience.

(b) The Offeror provided a maximum of five examples of work experience related to this requirement, within the last five years.

The Technical Factor will receive one of the adjectival ratings defined below:

Table 1: Technical Acceptable/Unacceptable Adjectival Ratings

TECHNICAL ACCEPTABLE/UNACCEPTABLE RATINGS

Ra Rating Definition

Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 2 - Price.

The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 13.106-3(a) will be the primary means of assessing price for commercial items to determine price reasonableness. To be viable for award, an Offeror's price must be determined fair and reasonable. The Offeror's total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of all CLINs to include all ordering periods and to include the option to extend services in accordance with FAR 52.217-8.

Total Evaluated Price (TEP): The TEP to be used for the determination of price reasonableness will be calculated as follows: The sum of all CLINs (ordering periods and 1/2 of the fifth ordering period price as an evaluation of potential pricing under FAR Clause 52.217-8.

Offerors are not required to enter a price for the 52.217-8 six month period.

(a) Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Factor 3 - Past Performance.

The past performance evaluation will assess the offeror's probability of meeting the solicitation's requirements as indicated by that offeror's record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror's recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror's proposal and data obtained from other sources, such as the Contractor Performance Assessment Reporting System (CPARS) or similar systems.

Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.

Table 2: Past Performance Adjectival Ratings

Past Performance Evaluation Ratings

Rating Definition

Acceptable Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.

Unacceptable Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
