1.GENERAL-The USAG West Point requires a properly licensed and certified contractor to perform annual inspections to include Preventative Maintenance inspections and load testing on various lifting. Devices as listed below in paragraphs 11-15. The contractor is to supply all materials, equipment, and personnel to perform various load tests on installed overhead lifting devices to include a gantry and necessary hardware to attach a lifting device to the gantry as required. All devices shall be inspected, serviced, tested, and certified In Accordance With (IAW) the manufactures specifications and the OSHA 29 Part 1910.179 and or the most current regulations governing such tests. If there is any question as to the proper test and or requirement, the contractor shall consult with the applicable DPW Contracting Officers Representative (COR) for clarification.

The devices are located at Stewart International Airport, Newburgh, NY. 12550.

1.1 INSTRUCTIONS

The Contractor shall adhere to the instructions given by the COR either verbally or in writing.

The instructions will include a date by which the Contractor must respond. Contractor responses shall be made to the COR, who will then coordinate, accompany, and observe contracting personnel during work activities. All work shall conform to referenced state and federal regulations.

1.2 OPERATING HOURS

Contractor shall perform all scheduled services during normal duty hours (8:00 a.m. - 4:00 p.m.), Monday thru Friday, excluding Federal Holidays.

1.3 PERSONNEL

The Contractor shall provide a work force possessing the skills, knowledge, and training to satisfactorily perform the services required by this contract. Personnel performing work under this contract shall remain employees of the Contractor and will not be considered employees of the Government.

1.4 CONDUCT OF PERSONNEL

The KO may require the Contractor to remove from the job site, any employee working under this contract for reasons of misconduct, security, or if found to be or suspected to be under the influence of alcohol, drugs, or another incapacitating agent. Contractor employees shall be subject to dismissal from the premises. Contractor employee dismissal shall not relieve the Contractor of the requirements to provide sufficient personnel to perform work under this contract, nor shall it allows the Contractor to submit work late.

1.5 IDENTIFICATION

The Contractor shall provide an identification badge for each employee performing services under this contract. The identification badges shall contain the Contractor's name, employee's name, contract number and project description. Each Contractor employee shall conspicuously display on their person the identification badge while performing work under this contract.

1.6 ANNUAL INSPECTIONS-PREVENTATIVE MAINTENANCE- Each device listed shall be inspected annually for serviceability and preventative maintenance performed. Preventative Maintenance is intended to encompass minor repairs to include removal and or replacement of nuts, bolts, clamps and related items, cleaning, lubrication, servicing, and adjustments that should be performed during an annual inspection. The details of such inspections should be IAW the manufacturers prescribed manuals, OSHA requirements and or industry standards in lieu of or in the absence of OEM literature. As a minimum, the following items should be inspected: Hoisting and lowering mechanisms, Trolley and bridge travel, Limit switches and safety devices, Structural members, Bolts or rivets, Sheaves and drums, moving parts such as bearings, shafts, gears, rollers locking and clamping devices, Fuel, electric or other power plants, Chain-drive sprockets, Crane and hoist hooks, Electrical controllers, limit switches and push button stations, Slings (wire, metal mesh, fiber mesh, rope, etc.) Specific inspection items may vary depending on the type of crane being inspected. It is the responsibility of the contractor to ensure the manufacturer's specified inspection checkpoints are covered during the annual PM Service. The annual PM is not to be used for major repairs. If during an inspection a defect is found that exceeds the above statement with respect to minor maintenance, then that defect shall be reported to the COR. COR will notify the respective Branch/Shop Chief of any repairs needed. The shop chief is responsible for scheduling any required maintenance actions that are beyond the scope of this award. The COR shall also be notified as soon as possible of the out of service condition or defects. If an item is found to be unsafe for operation, then that item shall be properly tagged as out of service. The contractor shall not be reimbursed for any out-of-scope work. 1.7 LOAD TESTING -All lifting devices shall be load tested annually. All load tests shall be performed IAW prescribed standards as specified by the OEM literature, OSHA standards and any other recognized guidance. The lift shall not exceed the rating of the device being lifted.The contractor is to provide a calibrated scale attached between the lifting device and the loads to be tested to ensure parameters are not exceeded. In the absence of scale, certified weights shall be used. Loads shall be maintained for at least fifteen (15) minutes or as indicated by CFR 29, Part 1910.179, with no indication of stretching or fatigue of cables or chains. All lifting devices tested shall be tagged with a metal tag that is engraved or stamped indicating when the test was completed and the next test date due. Any lifting devices that fail any inspections, shall be red tagged OUT OF SERVICE. The COR shall be notified as soon as possible of the out of service condition.

2.AREA INFORMATIONUSMA is a college campus with a full range of academic, social, and athletic activities. West Point is also a military installation and a national tourist attraction. West Point is a community for over one thousand five hundred (1,500) military personnel. This community has many recreational areas such as Lake Frederick located near Central Valley, and Round Pond. USMA is located just fifty (50) miles north of New York City, along the west bank of the Hudson River.3.PERIOD OF PERFORMANCE Contract will be a one time service.4.

DEFINITIONSContracting Officer (KO): A person duly appointed with the authority to enter and administer the contract on behalf of the Government.

Contracting Officer Representative (COR): An individual, designated in writing by the

KO, to act as an authorized representative of the KO to perform specific contract administrative functions within the scope and limitations as defined by the KO.

Contractor: The individual and/or business performing the work described in this SOW.

The Contractor is responsible for the proper completion of project activities in accordance with these contract specifications even where a subcontractor has been retained to perform the actual maintenance task. 5.0 ANNUAL INSPECTIONS-PREVENTATIVE MAINTENANCE- Each device listed shall be inspected annually for serviceability and preventative maintenance performed. 7.QUALITY CONTROL

The Contractor shall submit a Quality Control Plan outlining their methods to assure the quality of their services.

8.REPORTING DOCUMENTATION- A detailed report shall be provided in writing from the contractor to the COR, as to conditions and test results of each device. The report shall include the name/model, location (Building number) and size of the unit tested. The report shall also provide the test date, condition, pass or failed indication and recommendations to the Government, as to replacement or repair if needed.

9.SUBMITTALS

The Contractor shall submit the following with their Bid/Proposal:

Company qualifications to perform this work (Project Descriptions, Certifications, Licenses, etc.).

Qualifications, Certifications and Resumes of the personnel who will be performing the

Work.

Examples of the Inspection and Testing Checklists and Reports proposed to be used for this Work.

Proposed schedule for completing the Scheduled (Type 1) portion of the work.

5.SCHEDULING- The COR shall coordinate with the contractor as to priorities for PM's and Load Tests. A priority will be given to cranes and hoists with expired inspections or soon or to be expired inspections. The load tests may be performed in conjunction with the annual inspection/PM.11.

The COR and contractor are responsible for ensuring that all applicable employees have completed antiterrorism awareness training and shall certify that their workforce has completed the training through the submission of completion certificate(s) to the Contracting Officer and the Contracting Officer's Representative (if appointed) within five working days after contract award or prior to access to a Federally-controlled installation or information system.

(b) In the event that the automated system is not available (e.g., server problems), Level I AT Awareness Training can be provided by a qualified instructor. However, if the training is not completed online, the Level I AT Awareness Instructor qualification must be coordinated with the Installation Antiterrorism Officer (or Installation Security equivalent) and the resultant name(s) of approved instructors shall be provided the contracting officer or designee along with all associated cost or schedule impacts to the contract. (c) Antiterrorism performance (Level I AT Awareness Training attendance and compliance) may be documented as a performance metric under the resultant contract, and be part of past performance information in support of future source selections.

Contracting Official Representative (COR).

(1) Will ensure that all contractors/subcontractors are processed for a background check or National Agency Check with Inquiry (NACI) as needed. The background check is the minimal investigation to be adjudicated for a USMA Identification Card (yellow badge) versus the NACI, which requires fingerprinting and submission of EQIP. NACIs are required for contractors/subcontractors that require a CAC and/or government computer accounts.

(2) Will ensure that the USMA Form 13-16, Personnel Background Check, dated Apr 06, is correctly completed and signed by the COR who is a properly cleared Federal Employee.

(3) Will ensure that the USMA Form 13-16, Personnel Background Check, dated Apr 06, is submitted within 10 days prior to personnel starting projects on West Point, depending on when contract is awarded and work is scheduled to start. Waivers are made for the 10 day suspense on a case by case basis, in emergency situations as needed only.

(4) Will ensure that all identified contractors requiring a CAC and/or government computer access, submit fingerprints and complete a NACI investigation submission via EQIP, prior to being issued a CAC and/or given access to the government computer network.

(5) Will ensure that all government issued identification and vehicle stickers are confiscated from contractors/subcontractors upon termination of employment or end of project. These items will be returned to MPD and DES.

(6) Will ensure that all contractors requiring access to the Installation have completed antiterrorism awareness training and shall certify that their workforce has completed the training through the submission of completion certificate(s) to the Contracting Officer.

(7) Will ensure that all contractors with security clearances, per AR 381-12, have completed annual Threat Awareness and Reporting Program (TARP) training by a CI agent or other trainer and shall certify that their workforce has completed the training through the submission of completion certificate(s) to the Contracting Officer.

Force Protection Conditions (FPCON's) Clause

During higher Force Protection Conditions (FPCON's) Contract personnel are required to comply with all Antiterrorism policies and procedures while on the installation. Contract personnel may be directed to enter the installation through certain access control points where they can best be identified and searched.

Contractor personnel may be prohibited from certain portions of the installation during exercises and actual emergencies.

Contractors will comply with parking restrictions and will not park in unauthorized parking areas or within 82 feet of an inhabited building when directed.

Access control roster (personnel and vehicles) must be provided. Names / vehicles verified by the company and received background screening. Substitutes receive same vetting process prior to work.

All contractor personnel and vehicles are subject to search while on the installation.

In the event of an identified restricted/exclusion area, the contractor personnel will not be authorized without specific permission or an escort.

Access may be denied during increased readiness or Force Protection Conditions (FPCON's).

Alien Employment

The contractor shall not employ any alien who does not have a valid US Immigration I-551 or I-94. The contractor shall provide valid social security numbers and citizenship status of all employees to the Government, upon request.

E-Verify

E-Verify is an Internet based system operated by the Department of Homeland Security (DHS) in partnership with the Social Security Administration (SSA) that allows participating employers to electronically verify the employment eligibility of their newly hired employees. E-Verify is currently free to employers and is available in all 50 states. E-Verify provides an automated link to federal databases to help employers determine employment eligibility of new hires and the validity of their Social Security numbers. E-Verify are the best means for determining employment eligibility of new hires and the validity of their Social Security numbers.

Contractors shall use E-Verify on all employees that will be working on this installation, under this contract.

This shall be done prior to the employee starting work on the installation.

The United States Government has adopted a zero tolerance policy regarding trafficking in persons. Government contracts shall --

(a) Prohibit contractors, contractor employees, subcontractors, and subcontractor employees from --

Contractor Vehicles - ensure the contractor understands the parking policy dated 29 July 2013.

The local general, visitor, and government designated parking areas SHALL NOT be used by the contractor.

No general contractor or subcontractor employee parking is available near the immediate site. The contractor will need to identify and locate parking facilities for general and subcontractors off of West Point and provide a means for shuttling workers to the site. West Point shuttle services will not be used for transporting workers to the site.

Contractors and construction vehicles can only park in pre-approved designated staging areas or as identified in their contract. Central Area Parking is reserved for Staff and Faculty and requires a special pass. In accordance with AR 190-5, persons who operate a motor vehicle on West Point shall be deemed to have given consent for the removal and temporary impoundment of the privately owned vehicle (POV) and construction equipment when it is:

(1) Parked illegally

(2) Interfering with operations

(3) Creating a safety hazard

52.204-9 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR PERSONNEL (JAN 2011)

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24, and Federal Information Processing Standards Publication (FIPS PUB) Number 201.

(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:

(1) When no longer needed for contract performance.

(2) Upon completion of the Contractor employee's employment.

(3) Upon contract completion or termination.

(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.

(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor`s employees are required to have routine physical access to a Federally-controlled facility and /or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph

(b) of this section, unless otherwise approved in writing by the Contracting Officer.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)

(a) Definitions. As used in this clause-

"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.

"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.

"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall-

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the "Web Based Training" link on the WAWF home page at https://wawf.eb.mil/

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in

WAWF for this contract or task or delivery order:

(1) Document type. The Contractor shall submit payment requests using the following document type(s):

(i) For cost-type line items, including labor-hour or time-and-materials, submit a cost voucher.

(ii) For fixed price line items-

(A) That require shipment of a deliverable, submit the invoice and receiving report specified by the Contracting Officer.

(3) Document routing. The Contractor shall use the information in the Routing Data Table below only to fill in applicable fields in WAWF when creating payment requests and receiving reports in the system.

The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or (2) reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of (3) form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any (1) FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
