Training services must include initial operator certification training for up to 20 personnel annually and annual renewal certification training for previously certified operators, with training dates coordinated at least 60 days in advance. All services must comply with Texas Breath Alcohol Testing Regulations and Texas Forensic Science Commission standards. The contractor must maintain an operational readiness rate of no less than 95% for all instruments and submit monthly invoices through the Wide Area Workflow (WAWF) system. Offerors must provide proof of certification from the Texas Forensic Commission/Texas Department of Public Safety authorizing them to provide maintenance on the Intoxilyzer 9000 BAT instrument. Pricing must be submitted on a firm fixed-price basis for all contract line item numbers covering the base year and option periods.

STATEMENT OF WORK

Intoxilyzer 9000 Maintenance and Training Services

Fort Hood, Texas

1. Scope

The Contractor shall provide all labor, materials, equipment, tools, transportation, and technical expertise necessary to perform maintenance, calibration, inspections, training, and related support services for two Intoxilyzer 9000 Breath Alcohol Testing (BAT) instruments. All services shall comply with Texas Breath Alcohol Testing Regulations (TBATR) requirements, Texas Forensic Science Commission standards, and Texas Department of Public Safety regulations.

2. Period of Performance

This Firm-Fixed-Price (FFP) contract consists of one (1) base year and four (4) twelve-month option years.

3. Requirements

3.1 Preventive Maintenance and Inspections

On-site inspections and preventive maintenance shall be performed on all Intoxilyzer 9000 units, including review of records, operator certification assessments, and evaluation of operational protocols.

Reference sample solutions shall be replaced and maintained during monthly inspections or when deviation exceeds 0.01%.

Noncompliance notifications shall be reported to the COR/CO within 24 hours.

3.2 Maintenance and Repairs

Equipment failures shall be reported within 24 hours of discovery.

Contractor response to Government notification of malfunction shall occur within 48 hours.

Transport to certified laboratory shall be provided when required.

3.3 Training Requirements

Initial certification training shall be conducted once per Ordering Year for up to 20 students.

Renewal training shall be conducted once per Ordering Year for previously certified operators.

Training facility support will be provided by the Government.

Training dates shall be coordinated at least 60 days in advance.

Record retention for five years, provided to the Government upon request.

Operational Readiness Rate the Contractor shall maintain an operational readiness rate of no less than 95% for all Government-owned Intoxilyzer 9000 instruments. Operational readiness is defined as the percentage of time each instrument is fully functional, calibrated, and available for use.

6. Invoicing

Monthly invoice shall be submitted through WAWF. Only authorized charges may be billed.

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(a) The Government will award a contract resulting from this solicitation to the responsible offerer whose offer conforming to the solicitation will be most advantageous to the

Government, Award will be made using the lowest price technically acceptable

(LPTA) source selection process. Award will be made to the responsible offerer on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offerer within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to Evaluation - Commercial Product and Commercial Services

ADDENDUM TO 52.212-2 Award will be made using the lowest price technically acceptable (LPT A) source selection process. Award will be made to the responsible offerer on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Award may be made without discussions with offerers ( except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offerer's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.

(a) The Government will award a contract resulting from this solicitation, to the responsible Request For Quote (RFQ) conforming to the solicitation, that is lowest price technically acceptable (LPTA). Award will be on an all or none basis. The following evaluation factors shall be used to evaluate offers: Price, Technical Acceptability, Past Performance.

EVALUATION PROCESS:

Award will be made using the lowest-price, technically-acceptable source selection process.

The Government will initially list proposals from lowest to highest price. The Government will evaluate the lowest priced proposal first. If that proposal is determined technically unacceptable, the Government will evaluate the next lowest priced proposal and continue in that manner until a proposal is rated Technically Acceptable. If a proposal is rated Technically Unacceptable, the Government will not evaluate any other factor. USING THIS PROCEDURE, THE GOVERNMENT MIGHT NOT EVALUATE ALL PROPOSALS.

The following evaluation factors shall be used to evaluate offers:

1. Price: The quote must clearly indicate the price for the base plus all option years. Price will be evaluated using various price analysis techniques and procedures IAW FAR 15.404-1 (b) including, but not limited to, comparison of proposed price received in response to the solicitation. Evaluation of price will include a determination that the price is fair and reasonable.

No telephonic questions will be accepted, only through email. A signed SF form 1449 with completed pricing data must be submitted. E-mail is the preferred method.

(b) Evaluation Process: All offers will be evaluated IAW FAR 15.305 first: Award will be made using the lowest price, technically-acceptable source selection process. The Government will initially list proposals from lowest to highest price. If a proposal is rated Technically Unacceptable, the Government will not evaluate any other factor. USING THIS PROCEDURE, THE GOVERNMENT MIGHT NOT EVALUATE ALL PROPOSALS. Proposals. Proposals receiving a rating of "less than adequate" or "not acceptable" will not be eligible for award.

(c) A written notice of award or acceptance of an offer, will be furnished via e-mail to the successful offerer and shall result in a binding contract without further action by either party.
