1. All sources may submit a proposal or quote as applicable. However, the Republic of Korea (ROK)-United States (U.S.) Status of Forces Agreement (SOFA), precludes the U.S.

Government from granting Invited Contractor or Technical Representative status to any offeror, for this requirement. All sources submitting a proposal or quote, as applicable, including U.

S. sources, must already have, or obtain the requisite business licenses directly from the ROK Government, and conduct business in accordance with all applicable ROK laws, including but not limited to, rules and policies regarding labor, taxation, and immigration. Any contractor not already doing business in Korea as a local source, must submit adequate verification in its initial proposal or quote, that it has the requisite authorization and capacity to compete for the requirement as a local source, and to perform the contract as a local source. If an initial proposal does not fully demonstrate this authorization and capacity, it will not be further considered for award. Whether an offeror qualifies as a local source shall be determined by the Contracting Officer.

2. LOCAL CONTRACTORS:

The proposed acquisition will be limited to local contractors. All required material, labor, transportation, and facilities and these supply items are available locally. There is nothing inherently difficult about the project that requires the presence of invited contractors.

3. The Price Proposal shall be Korea Won.

WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JAN 2023)

(a) As used in this clause- Definitions.

"Department of Defense Activity Address Code (DoDAAC)" is a six position code that uniquely identifies a unit, activity, or organization.

"Document type" means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

"Local processing office (LPO)" is the office responsible for payment certification when payment certification is done external to the entitlement system.

"Payment request" and "receiving report" are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(d) Comptroller General Examination of Record. 1. BASIS OF AWARD: This source selection follows the procedures outlined in FAR Part 13.

Offers will be evaluated based on criteria outlined in ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS -COMMERCIAL ITEMS. The Government will base the award decision on price and other factors. Noncompliance with the Request for Quote (RFQ) requirements may hinder the Government's ability to properly assess the quote, potentially leading to its elimination from further consideration for contract award.

2. Award for the Entirety of the Work: The Government intends to award one Firm Fixed Price (FFP) contract based on the complete specifications in the Performance Work Statement (PWS). Quotes that include fewer items or work than those listed in the specifications will be deemed ineligible for award. The Government plans to evaluate and award the contract without interchanges with contractors. Therefore, contractors should submit their quote best terms in their initial, considering both price and technical aspects. However, the Government reserves the right to conduct interchanges in if quote deemed necessary by the Contracting Officer.

3. Evaluation Criteria: Quotes will be evaluated based on two factors and will be applied in accordance with the Performance Work Statement (PWS):

FACTOR I - TECHNICAL: The quote shall be evaluated to determine the offeror's ability and technical approach to satisfactorily accomplish the quote Government's intent and achieve the desired quality end-products. A demonstrating an adequate understanding and approach to meeting the quote requirements will be deemed technically acceptable. If an offeror fails to meet the minimum requirements outlined in one of the two (2) subfactors below, the subfactor, and overall quote will be rated "unacceptable" and will not be eligible for award

Sub-Factor 1: Required Units and Capability

The Offeror shall demonstrate the ability to provide the following for the full period of performance (15 February - 1 April 2026):

- One (1) 40' refrigerated container at Camp Mujuk

- One (1) 40' freezer container at Camp Mujuk

- One (1) 40' refrigerated container at RLFC

- One (1) 40' freezer container at RLFC

The Offeror shall demonstrate the ability to:

- Deliver, install, level, secure, and connect all units to continuous power

- Make all units fully operational by 15 February 2026, 0900 KST

- Maintain required temperature ranges: 0C to 4C (refrigerated), -23C to -18C (freezer)

- Provide a 24/7 emergency support contact

- Respond to service interruptions within 4 hours

Sub-Factor 2: Local Source Eligibility (SOFA Compliance)

The Offeror shall demonstrate compliance with ROK licensing requirements and eligibility to perform as a local Korean contractor, in accordance with the US-ROK SOFA. Offerors must provide verification of authorization and capacity to perform as a local source.

FACTOR II - PAST PERFORMANCE: Past performance shall be evaluated on an acceptable /unacceptable basis. Offerors are authorized to provide information on the problems encountered on the identified contracts and the Offeror's corrective actions. The Government may ascertain past performance information on the Offeror from sources other than the references provided.

The offeror shall provide recent and relevant past performance in providing refrigerator service.

Recent past performance is within the last five (5) years from the issuance date of this solicitation. Relevant past performance are those that are the "same or similar" services based on size, scope, complexity, and contract type.

The past performance will be evaluated for all offeror's proposals by the Contract Specialist / Contracting Officer in the following manner:

(a) Review of the detailed explanation submitted by offerors demonstrating the relevance of the references to the requirements of the solicitation.

(b) References will be contacted by phone or email to verify contents in detail explanation and to determine record of compliance with contract requirements, accuracy of reports, technical and quality awards/certificates.

(c) The Government reserves the right to obtain past performance information from any reasonable source available, including Government database in order to evaluate past performance.

NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability /unacceptability, a neutral rating shall be considered "acceptable."

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision-

Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
